and\n\n (b) that person ceases to exist on or before the date of assessment;\n\n  then, for the purposes of the Act, the levy amount for that person for the eligible levy period starting immediately after the relevant eligible revenue period is zero.\n\nLevy amount – for participating persons under external administration, wound up, in receivership etc\n\n (3) If:\n\n (a) a person is a participating person for an eligible revenue period (the relevant eligible revenue period); and\n\n (b) that person is a Chapter 5 body corporate on or before the date of assessment;\n\n  then, for the purposes of the Act, the levy amount for that person for the eligible levy period starting immediately after the relevant eligible revenue period is the amount worked out using the formula:\n\n \n\nLevy contribution factor   x   Overall levy target amount\n\n \n\nNote 1: External administration is primarily dealt with by Chapter 5 of the Corporations Act 2001. Chapter 5 includes provisions dealing with schemes of arrangement, administration, receivership and winding up.\n\nNote 2: The Telecommunications (Industry Levy) Act 2012 imposes levy on the levy amount.\n\nLevy amount – for all other participating persons – current eligible levy period\n\n (4) For the current eligible levy period, if:\n\n (a) a person is a participating person for the eligible revenue period; and\n\n (b) subsections (2) and (3) of this instrument do not apply to that person;\n\n  then, for the purposes of the Act, the levy amount for the current eligible levy period for that person is the amount worked out using the formula:\n\n \n\nLevy contribution factor x (Overall levy target amount + Previous levy deficit  + $8,000,000)\n\nAdjustment factor\n\n \n\nNote: The Telecommunications (Industry Levy) Act 2012 imposes levy on the levy amount.\n\nLevy amount – for all other participating persons – future eligible levy period\n\n (5) For a future eligible levy period, if:\n\n (a) a person is a participating person for an eligible revenue period (the relevant eligible revenue period); and\n\n (b) subsections (2) and (3) of this instrument do not apply to that person;\n\n  then, for the purposes of this Act, the levy amount for that person for the eligible levy period starting immediately after the relevant eligible revenue period is the amount worked out using the formula:\n\n \n\nLevy contribution factor x (Overall levy target amount + Previous levy deficit)\n\nAdjustment factor\n\n \n\nNote: The Telecommunications (Industry Levy) Act 2012 imposes levy on the levy amount.\n\n\n\n\n \n\nSchedule 1—Repeals\n\nLevy Amount Formula Modification Determination 2015\n\n1  The whole of the instrument\n\nRepeal the instrument\n\n \n\n \n","sortOrder":0}],"analysis":{"kimi_summary":{"content_quality":"ok","complexity_score":4,"scope_assessment":{"changed":false,"description":"The Determination remains tightly scoped to its original purpose: modifying the levy formula for specific circumstances (insolvency, cessation) and specific time periods. It makes the levy zero for entities that cease to exist before the ACMA assessment, applies a specific formula for entities under Chapter 5 external administration, and—for 2019–20—adds a one‑off $8,000,000 to the levy pool to be shared by remaining participants.
