It retains the same class of goods (gearbox parts meeting the same engine-output threshold and the same parts list) and changes only the tariff subheading and the Schedule 4 item reference. There is no material growth in scope beyond the original purpose of prescribing tariff treatment for the listed goods; the change is procedural and classificatory rather than substantive."},"complexity_factors":["Very short instrument: single revocation and single replacement (two tables).","Use of tariff classification codes (8708.99.99 -> 8708.40.59) which require cross-reference to the Harmonized System for detail.","Cross-reference to another statute: Part III of Schedule 4 to the Customs Tariff Act 1995 (the Schedule 4 item number in Column 2 determines final treatment).","Technical goods description with a long parts list (questions of scope and matching may require technical judgement).","Effective date and \"last date of effect\" entries introduce a narrow transitional/temporal issue around 01.01.2007.","Administrative dependency on Customs systems recognising new TCO number and classification for processing entries."],"plain_english_summary":"**What this instrument does (mechanically)\n\n- Revokes an existing Tariff Concession Order (TCO No. 9700044) and replaces it with a new Tariff Concession Order (TCO No. 0614565). The power used is s.269SD(2) of the Customs Act 1901. (See instrument heading and first paragraph.)\n\n- The revocation takes effect from 1 January 2007. The new TCO is recorded as having effect from that same date. (See paragraph (a) and TABLE B.)\n\n- The goods involved are specific parts for gearboxes that meet a stated engine-output threshold (\"having an engine output NOT less than 640 Nm\"). The listed parts include gears, shafts, bearings, housings, pistons, synchromesh, speedometer drives, yokes, and similar components. (See TABLE A and TABLE B descriptions.)\n\n- The replacement changes the customs tariff classification number applied to those goods from 8708.99.99 (old table) to 8708.40.59 (new table). It also changes the Schedule 4 item number that applies to them (old record shows \"5031.12.06\" as last date of effect; new record shows item number \"50\" in Column 2). (See TABLE A and TABLE B.)\n\nWho is affected\n\n- Importers and customs brokers who bring these gearbox parts into Australia. They must use the new TCO number and the new tariff classification when lodging customs entries from the effective date.\n- Manufacturers, suppliers and overseas sellers of the listed gearbox parts, because the tariff classification applied on import (and any concession, exemption or condition tied to Schedule 4) determines duty and entry treatment.\n- The Australian Customs administration (the CEO or delegate implementing entries and record-keeping). The delegate who signed is named on the instrument. (See end of instrument.)\n\nWhy it matters (practical effect and what to watch for)\n\n- Tariff heading change: The instrument changes the numerical tariff classification for the same described goods. That change can alter how duty, quota, anti-dumping, or other tariff-based measures apply because those measures are keyed to tariff headings and to the Schedule 4 item cited. (See TABLE A and TABLE B.)\n\n- Schedule 4 treatment: The instrument states the goods in TABLE B are ones \"to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of TABLE B applies.\" That means the particular Schedule 4 item (Column 2) governs any concessional or particular treatment (for example, a concession or exemption) for those goods. The instrument does not itself state the rate or nature of the concession; to know that you must read the specified item in Part III of Schedule 4. (See instrument text and TABLE B.)\n\n- Administrative and compliance consequences: Importers and their agents need to update documentation, classification coding and customs entries to reflect the new TCO number and tariff heading from 1 January 2007. Mistakes in classification around the effective date could create delays, reassessments or administrative penalties.\n\nOfficial rationale and an analyst's test of trade-offs\n\n- The instrument gives no policy narrative other than effecting a revocation and replacement. The explicit mechanical purpose is to continue tariff-concession treatment for the listed gearbox parts under a revised tariff subheading and a specified Schedule 4 item. (See instrument text and TABLE B.)\n\n- Costs and incentives: The principal direct cost falls on importers and customs agents in the form of administrative updating (re-labelling entries, amending internal systems, training). If the Schedule 4 item or the new tariff subheading carries different duty consequences, the cost may be financial (higher or lower duty) and could change supplier pricing, sourcing or inventory timing.\n\n- Implementation risk and compliance burden: The switch requires Customs systems and border agents to recognise the new TCO number and classification. Transitional shipments near 1 Jan 2007 could be disputed if documentation uses the old TCO; importers should check post-entry amendment processes. There is a non-zero risk of misclassification disputes because the descriptive text is long and the tariff heading changed (8708.99.99 -> 8708.40.59).\n\n- Effects on competition and private choice: Mechanically, the instrument does not create new licensing, ownership or operating restrictions. Its effect is restricted to tariff classification and the particular Schedule 4 item—so its competitive impact will flow from any duty or concession differences that attach to that Schedule 4 item. To know whether it narrows or broadens market access (and for whom) you must inspect the relevant Part III Schedule 4 item referenced (Column 2 in TABLE B) and compare duty/concession rates under the old and new entries.\n\nKey documentary pointers (where to look next)\n\n- Compare the text of Part III of Schedule 4 (the item numbered in TABLE B Column 2) to see the precise concessional treatment. The instrument itself does not state the rate or condition.\n- Check customs entry records and advice around shipments crossing the 1 January 2007 effective date to avoid disputes.\n\nSource pointers in the instrument: action taken under s.269SD(2) of the Customs Act 1901; revocation listed in TABLE A (TCO 9700044) and replacement in TABLE B (TCO 0614565); signed by a delegate of the CEO (Robert Crawford) dated 20 June 2007."},"kimi_summary":{"content_quality":"ok","complexity_score":3,"scope_assessment":{"changed":false,"description":"This is a routine administrative update to a specific tariff concession.
