It does not broaden the classes of goods covered or introduce new policy beyond reclassification and reassignment of the concession item. The effect is procedural/administrative rather than an extension of scope."},"complexity_factors":["Very short instrument (2 pages)","Single substantive action: revocation and replacement of one Tariff Concession Order","Only 2 tariff classification codes involved (8708.91.99 -> 8708.91.39)","Single statutory cross‑reference (s.269SD(2) of the Customs Act 1901) and link to Part III, Schedule 4 of the Customs Tariff Act 1995","One effective date (01.01.2007) and one new Schedule 4 item number (50)","Technical product description includes precise numeric pressure ranges that require careful reading to match goods to the concession","Potential for clerical confusion because the product description is nearly identical between old and new entries"],"plain_english_summary":"**What this instrument does (plain English)**\n\n- This instrument revokes a previous Tariff Concession Order (TCO 9802008) and replaces it with a new Tariff Concession Order (TC 0614547) that covers the same described goods. The revocation and replacement take effect from 1 January 2007.\n\n- The goods affected are described as: “COOLERS, CHARGE AIR TO AIR, cast aluminium body, serpentine or plate‑fin design, vacuum brazed core matrix, working pressure not less than 24 171 kg/sq m and not exceeding 31 077 kg/sq m.” In plain terms: specific types of intercoolers (charge‑air coolers) used in automotive or industrial air charge systems.\n\n**Who this affects**\n\n- Importers and customs brokers who bring these specific coolers into Australia.\n- Suppliers, distributors or manufacturers who claim or rely on the tariff concession when importing those coolers.\n- Australian Customs/Border Force staff administering tariff concession entries.\n\n**How it works mechanically**\n\n- Legal power: the delegate of the Chief Executive Officer acted under section 269SD(2) of the Customs Act 1901 to make the change.\n- Revocation: Tariff Concession Order Number 9802008 (which had been applied to the goods) is revoked with effect from 01.01.2007.\n- Replacement: a new Tariff Concession Order (TC 0614547) is made covering the same product description but recorded under a different tariff classification code (from 8708.91.99 to 8708.91.39) and tied to a different Schedule 4 item number (from 5031.12.06 to 50).\n- The Schedule 4 item number identifies which entry in Part III of Schedule 4 to the Customs Tariff Act 1995 applies — in practice this determines whether a concessional tariff (lower duty or exemption) is available and which administrative rules apply when an importer claims that concession.\n\n**Why it matters (practical effects and incentives)**\n\n- Administrative: importers must use the new TCO number and the new tariff classification on import declarations from the effective date. Customs paperwork, entry lines and broker systems may need updating.\n\n- Financial: if the change alters which Schedule 4 item applies (and therefore the specific concession), it can change the duty payable or the conditions under which a concession is granted. The instrument itself substitutes the item number; users must check the Customs Tariff Act 1995 (Part III, Schedule 4) to see the exact tariff treatment attached to item 50.\n\n- Compliance risk and costs: there is a modest risk of misclassification or clerical error when switching to the new code/number. That can create delays, reassessments or duty liabilities until declarations are aligned with the new TCO.\n\n- Decision and enforcement: the delegate made the administrative decision to revoke and remake the TCO. Ongoing enforcement and interpretation of eligibility rest with Customs officials applying the Customs Act and the Customs Tariff Act provisions.\n\n**Mechanisms to watch (implementation trade‑offs)**\n\n- Concentrated impact: benefits or costs are concentrated on the relatively small set of businesses importing these specific coolers. Administrative burdens (system updates, re-training of brokers) are borne by those importers and their agents.\n\n- Clarity vs. disruption: the instrument appears to be a technical reclassification (new tariff subheading and Schedule 4 item). That clarifies the legal entry for future imports but creates a short window where old documents and systems must be updated.\n\n**Key references in the instrument**\n\n- Power used: section 269SD(2) of the Customs Act 1901.\n- Tariff connection: Part III of Schedule 4 to the Customs Tariff Act 1995 (the Schedule 4 item number determines concessional treatment)."},"kimi_summary":{"content_quality":"ok","complexity_score":3,"scope_assessment":{"changed":false,"description":"This is a narrow, technical administrative instrument that performs a straightforward substitution of one tariff concession for another.
