It does not broaden the subject matter or add new regulatory obligations beyond changing the tariff classification number and the Schedule 4 item that applies. The action is mechanical (reclassification/replacement) rather than a substantive extension of scope beyond the original purpose of providing a concession for that specific type of cable."},"complexity_factors":["Single-item instrument affecting one commodity description","Short text (two tables, brief operative paragraph)","Only two statutory cross-references (s.269SD(2) Customs Act 1901; Part III of Schedule 4 to the Customs Tariff Act 1995)","No nested exceptions, conditions, or transitional rules beyond the single effective date","Requires administrative translation into tariff system (reclassification) but no complex legal definitions inside the instrument itself"],"plain_english_summary":"**What this instrument does (mechanics)\n\n- This is a revocation-and-replacement of a single Tariff Concession Order (TCO). Under section 269SD(2) of the Customs Act 1901 a delegate of the Chief Executive Officer revokes TCO No. 9711089 and replaces it with TCO No. 0614502. The change takes effect from 1 January 2007. \n\n- Practically, the instrument removes the old tariff concession entry for a specific type of computer local-area-network (LAN) cable and inserts a new entry describing the same goods but under a different Customs Tariff classification number and a different Schedule 4 item number. The new entry is set out in TABLE B of the instrument and the revoked entry is set out in TABLE A.\n\n**Who is affected\n\n- Importers and customs brokers who import the described LAN cables. \n- Businesses that rely on the tariff concession (that is, the particular duty treatment available under Part III of Schedule 4 to the Customs Tariff Act 1995). \n- The Australian Customs administration, which implements the changed classification and processes concession claims.\n\n**Why it matters (practical consequences)\n\n- Tariff classification determines the duty rate and whether a concession (reduced or nil duty) applies. Changing the tariff heading (from 8544.41.90 to 8544.42.19) and the Schedule 4 item number (to item 50) changes which statutory concession applies to those imports. That can change the duty payable or the administrative conditions for claiming the concession. \n\n- Importers who previously relied on the old TCO must use the new TCO number and classification on customs declarations and supporting documents from the stated effective date (01.01.07). Failure to do so can lead to incorrect duty assessment, delays, or compliance issues.\n\n**Source claim and mechanical test against costs, incentives and risks\n\n- The instrument invokes the statutory power in section 269SD(2) of the Customs Act 1901 to revoke and remake tariff concession orders. The stated effect is technical: to replace one TCO with another and set a new Schedule 4 item number. \n\n- Costs and incentives: any change in applicable duty or claim conditions imposes direct costs on affected importers (if duty increases) or provides a direct benefit (if duty decreases). There are also one-off compliance costs: updating commercial and customs systems, amending invoices/declarations, and training staff or brokers. Those costs are concentrated on the importers of this particular cable type; they are diffuse across other traders (no immediate economy-wide effect). \n\n- Administrative and implementation risk: low to moderate. The instrument is administrative and narrow in scope, so the main risks are miscoding in customs software, miscommunication to brokers/importers, and transitional declaration errors at lodgement. \n\n- Behavioural effects: importers may change declaration practices, documentation, or sourcing if the new tariff/item produces a different duty outcome. Customs may need to adjust audit or verification checks for that commodity.\n\n**What the instrument does not do\n\n- It does not create a new broad policy or new regulatory regime. It does not in itself set tariff rates; it reallocates which Schedule 4 item applies to the described goods and changes the tariff classification number used for those goods.\n\n**Relevant legal references in the instrument\n\n- Revocation power: section 269SD(2) of the Customs Act 1901 (delegated revocation of TCOs). \n- The tariff concession application point: Part III of Schedule 4 to the Customs Tariff Act 1995 (which lists concession items)."},"flash_summary_failed":{"failed":true,"reason":"A positive credit balance is required for all requests, including BYOK, so fallback providers remain available.
