The revocation and replacement are done under section 269SD(2) of the Customs Act 1901 (the delegate of the Chief Executive Officer makes the change).\n- The replacement updates the tariff classification (from 8421.19.90 to 8421.19.00) and assigns a different Schedule 4 item number (the instrument shows the previous Schedule 4 item and the new one). The new TCO takes effect from 01 January 2007 (the instrument is dated 20 June 2007).\n- The instrument says the goods in Column 1 of Table B are goods to which the item in Part III of Schedule 4 to the Customs Tariff Act 1995 specified in Column 2 of Table B applies. In short: the product description is retained but the tariff heading/subheading and Schedule 4 reference have been updated.\n\n**Who this affects**\n\n- Importers of the described centrifuges and their customs brokers, because tariff classification and Schedule 4 treatment determine the duty payable and whether a concession applies.\n- Domestic businesses that buy or distribute these centrifuges (they may face different landed costs depending on tariff treatment).\n- The Australian Customs administration, which must apply the new TCO when assessing imports and may need to handle queries, claims for refunds, or reclassification questions.\n\n**Why it matters (mechanisms, not opinion)**\n\n- Tariff concession orders determine whether a particular imported good receives a reduced rate of duty (or another special tariff treatment) by linking a product description to an item in Schedule 4 of the Customs Tariff Act 1995. Changing the TCO therefore changes which Schedule 4 item applies to these centrifuges and can change the tariff outcome (how much duty is payable and any concession conditions).\n\n**Stated purpose and practical implications**\n\n- The instrument itself makes an administrative substitution: revoke an older TCO and make a new one with an updated tariff classification and Schedule 4 item number (s269SD(2) Customs Act 1901; reference to Part III of Schedule 4, Customs Tariff Act 1995).\n- Mechanically, this can alter the import duty rate or the eligibility for concession treatment for the named centrifuges. The likely immediate effects are changes in compliance paperwork, the tariff treatment applied at import clearance, and possibly the landed cost for affected buyers.\n\n**Who pays, who decides, what behaviours change**\n\n- Who pays: importers ultimately pay any increased duty; if the concession reduces duty, importers benefit. Downstream purchasers pay indirectly via changes in importers' prices.\n- Who decides: the decision is made by a delegate of the Chief Executive Officer under s269SD(2) of the Customs Act 1901; the instrument ties the goods to an item in Part III of Schedule 4 of the Customs Tariff Act 1995.\n- Behaviour changes: importers may reschedule shipments, seek refunds or reviews for shipments straddling the change date, reclassify goods, or ask suppliers to alter product specifications to meet a concessional description. Customs and brokers must apply the new classification and manage any transitional claims.\n\n**Costs, incentives and implementation risks**\n\n- Administrative/compliance costs: importers and customs brokers must confirm classification and may need to lodge adjustments or refund claims if prior treatment changes. Customs will need to update systems and guidance.\n- Revenue and distributional effect: the change reallocates costs between importers/consumers and the budget depending on whether the new Schedule 4 item is more or less favourable. The beneficiaries are concentrated (importers of these centrifuges); any fiscal cost or benefit is spread across revenue collection.\n- Legal/operational risk: precise product descriptions and tariff subheading changes can create disputes over which shipments qualify. Importers may seek review or further concessions where the new wording is ambiguous.\n\n**Net description of scope**\n\n- This instrument is narrowly targeted: it deals only with the tariff treatment of a defined class of centrifuges. It does not create new regulatory powers, broader trade policy, or rules beyond replacing one TCO with another and changing the tariff line/Schedule 4 reference.\n\n(References: revocation under section 269SD(2) of the Customs Act 1901; linkage to Part III of Schedule 4 to the Customs Tariff Act 1995 as expressed in the instrument's Table B.)"},"kimi_summary":{"content_quality":"ok","complexity_score":3,"scope_assessment":{"changed":false,"description":"This is a routine administrative update to a specific tariff concession.
