The revocation takes effect from 1 January 2007. (Authority: s269SD(2) of the Customs Act 1901, instrument text.)\n\n- The goods affected are insect traps and lures (including both a trap body and synthetic pheromone attractant, or the trap bodies or synthetic pheromone attractants imported separately). The instrument moves the concessional treatment onto a different customs classification code: the earlier order was under tariff heading 3808.10.90; the replacement order is under 3808.91.90. The new TCO links those goods to the item in Part III of Schedule 4 to the Customs Tariff Act 1995 listed as \"50\" (instrument, Table B). \n\n**Who this affects**\n\n- Importers of insect traps and synthetic pheromone attractants, including companies that import complete traps or import the components (trap bodies or synthetic pheromone attractants) separately.\n- Customs brokers, freight forwarders and agents who declare these goods at the border and apply tariff concessions.\n- Any manufacturers or distributors whose cost/pricing depends on import duty on these items.\n- The Australian Border Force and Department of Home Affairs functionaries responsible for applying tariff classifications and concession items.\n\n**Why it matters (practical consequences)**\n\n- The instrument preserves (or continues) a tariff concession for these goods but shifts it onto a new TCO number and a different tariff subheading (3808.91.90) and attaches it to Schedule 4 item 50. That changes how import declarations must be made (importers must quote the new TCO and the new tariff classification) and requires customs systems and paperwork to be updated.\n\n- The economic effect for an importer depends on what item 50 in Part III of Schedule 4 actually provides (for example, an exemption or a concessional duty rate). If item 50 gives the same concession previously enjoyed, the practical impact is administrative (new code/number). If item 50 is narrower or broader than the old item, duty liability and therefore import cost may change.\n\n**Official rationale and assessment**\n\n- The instrument’s stated action is administrative: revoke an old TCO and make a replacement TCO that applies to the same described goods (instrument text, Tables A and B). That is consistent with routine updating of tariff instruments — for example, to reflect changes in tariff classification codes or to reissue a concession under a new order.\n\n- Costs, incentives and trade-offs:\n  - Who pays: the immediate economic incidence falls on importers (and downstream buyers) if the concession’s scope or rate changes; otherwise they bear the administrative cost of updating declarations and systems.\n  - Who decides: the decision is exercised by a delegate of the Chief Executive Officer under s269SD(2) of the Customs Act 1901; discretionary administrative action is involved in revoking and reissuing TCOs.\n  - Behavioural effects: importers need to use the new TCO number and tariff code on import declarations; brokers and IT systems must be updated. If the concession becomes less favorable, import volumes or sourcing may change; if unchanged or more favorable, importing may be unchanged or increase.\n  - Compliance burden: primarily operational — updating codes, paperwork, and possibly accounting for a different Schedule 4 item in duty calculations. Customs must update its systems and guidance.\n  - Implementation risk: risk of mis-declared goods or delays at the border if importers or brokers continue to use the old TCO or the wrong tariff heading, or if automated systems are not synchronised.\n  - Competition and market effects: if the concession reduces duty, it lowers cost for importers relative to domestic producers; if the concession is narrowed or withdrawn, it raises import costs and may affect competition. The instrument itself does not state the monetary or competitive effects — those turn on the content of Schedule 4 item 50 and current duty rates (see Table B).\n\n**What to check if you are affected**\n\n- Confirm whether Schedule 4 item 50 provides the same concession previously applied under the revoked TCO (cross‑reference Part III of Schedule 4 to the Customs Tariff Act 1995).\n- Update import declarations, internal customs codes and brokerage instructions to use TCO 0614052 and tariff classification 3808.91.90 from 1 January 2007.\n- If unsure about classification or entitlement, seek a binding ruling or advice from customs/border authorities to avoid mis-declaration risk.\n\n**Reference to the legal mechanics**\n\n- Revocation and reissue are made under s269SD(2) of the Customs Act 1901 (instrument opening line). The new order links the goods to an item in Part III of Schedule 4 to the Customs Tariff Act 1995 (instrument Table B)."}},"importantCases":[],"_links":{"self":"/api/acts/tariff-concession-revocation-order-hs2007-123a-tariff-concession-order-0614052","history":"/api/acts/tariff-concession-revocation-order-hs2007-123a-tariff-concession-order-0614052/history","analysis":"/api/acts/tariff-concession-revocation-order-hs2007-123a-tariff-concession-order-0614052/analysis","conflicts":"/api/acts/tariff-concession-revocation-order-hs2007-123a-tariff-concession-order-0614052/conflicts","importantCases":"/api/acts/tariff-concession-revocation-order-hs2007-123a-tariff-concession-order-0614052/important-cases","documents":"/api/acts/tariff-concession-revocation-order-hs2007-123a-tariff-concession-order-0614052/documents"}}
