The original order (Table A) covered water‑cooled chillers with cooling capacity not less than 80 kW. The replacement (Table B) limits coverage to chillers with capacity either not greater than 200 kW or not less than 2850 kW, excluding the intermediate range (approximately 201–2849 kW). This narrows and reconfigures the set of imports eligible for the listed Schedule 4 item."},"complexity_factors":["Numeric capacity thresholds (kW) create product‑specific boundaries and a discontinuity between mid‑range capacities","Legal cross‑references to Schedule 4 of the Customs Tariff Act 1995 determine tariff outcome","Use of a specific Customs Tariff classification code (8418.69.00) requires technical product matching","Revocation and replacement mechanism exercised by a CEO delegate under s.269SC(4) of the Customs Act 1901","Immediate retrospective/forward effect dated (6 February 2009) requiring prompt administrative application"],"plain_english_summary":"This instrument revokes a prior Tariff Concession Order and replaces it with a new order, effective 6 February 2009, that redefines which water‑cooled chillers qualify for a Schedule 4 tariff item by changing the cooling‑capacity thresholds. It mechanically changes which imported chillers attract the listed tariff concession. Importers of water‑cooled chillers, customs officials and businesses relying on tariff treatment are affected because the change alters which shipments qualify for the concession and so can change duty costs and compliance steps."},"kimi_summary":{"content_quality":"ok","complexity_score":2,"scope_assessment":{"changed":false,"description":"This is a standard administrative instrument exercising specific powers under the Customs Act 1901. Importers of mid-sized chillers (200–2850 kW) lose the reduced duty and will pay full tariffs, while Australian manufacturers of mid-sized units gain protection from cheaper imports. This shifts competitive balance in the chiller market."}},"importantCases":[],"_links":{"self":"/api/acts/tariff-concession-revocation-order-19-2009-tariff-concession-order-0904091","history":"/api/acts/tariff-concession-revocation-order-19-2009-tariff-concession-order-0904091/history","analysis":"/api/acts/tariff-concession-revocation-order-19-2009-tariff-concession-order-0904091/analysis","conflicts":"/api/acts/tariff-concession-revocation-order-19-2009-tariff-concession-order-0904091/conflicts","importantCases":"/api/acts/tariff-concession-revocation-order-19-2009-tariff-concession-order-0904091/important-cases","documents":"/api/acts/tariff-concession-revocation-order-19-2009-tariff-concession-order-0904091/documents"}}
