It affects importers of specific pipes certified to AS 1163, API 5L B/X42 or ASTM A53 B in narrow diameter ranges (≈88–90mm, 114–115mm, 141–142mm), 4–10mm wall thickness, ≥6m length. Mechanically, the scope of goods covered appears constant, but the legal classification and therefore the duty treatment and administrative consequences for importers have changed; the Order is made under s269SD(2) of the Customs Act 1901 and is given a retrospective date (06.11.03)."},"complexity_factors":["Technical product specification: detailed standards (AS1163, API 5L B/X42, ASTM A53 B) and precise size tolerances require documentary proof from importers.","Tariff classification change: movement between headings 7306.30.00 and 7306.19.00 alters legal duty treatment and requires customs reclassification.","Retroactive effective date: Order takes effect 06.11.03 though instrument is dated 23 October 2008, creating potential retrospective liability or adjustment issues for importers.","Cross-reference to Schedule 4 Part III: applicability depends on the Schedule 4 item number (item 50), so duty consequences require reading another Act (Customs Tariff Act 1995).","Administrative discretion and delegation: decision recorded as made under s269SD(2) by a CEO delegate (Wendy Knowles), concentrating determinative authority in the executive administration.","Formatting/record ambiguities in the instrument (e.g. '50N/A' entry and split Tables A/B) which may complicate interpretation and compliance checks."],"plain_english_summary":"This instrument revokes Tariff Concession Order 0314212 and substitutes a new Tariff Concession Order (TC 0835803) that reclassifies certain ERW steel tubes/pipes (specified by standards and sizes) from tariff heading 7306.30.00 to 7306.19.00. It is signed by a delegate of the Chief Executive Officer under s269SD(2) of the Customs Act 1901 and takes effect from 6 November 2003. Importers of the described tubes are the primary parties affected because the change alters the legal tariff classification that determines duty treatment."},"flash_summary_failed":{"failed":true,"reason":"Unauthenticated.
