Information may be inserted in this column, or information in it may be edited, in any published version of this Act.\n\n3  Definitions\n\n (1) In this Act:\n\nacquisition has the same meaning as in the GST Act.\n\nadministered assets and liabilities item means an amount set out in Schedule 2 in relation to a non‑corporate entity opposite the heading “Administered Assets and Liabilities”.\n\nadministered item means an amount set out in Schedule 2 opposite an outcome for a non‑corporate entity under the heading “New Administered Outcomes”.\n\nAppropriation Act (No. 2) 2025‑2026 means the Act (if any) with that name passed by the 47th Parliament.\n\nAppropriation Bill (No. 2) 2025‑2026 means the Bill with that name introduced into the 47th Parliament.\n\ncorporate entity means:\n\n (a) a corporate Commonwealth entity within the meaning of the Public Governance, Performance and Accountability Act 2013; or\n\n (b) a Commonwealth company within the meaning of that Act.\n\ncorporate entity item means the amount set out in Schedule 2 in relation to a corporate entity under the heading “Non‑operating”.\n\ncurrent year means the financial year ending on 30 June 2026.\n\nexpenditure means payments for expenses, acquiring assets, making loans or paying liabilities.\n\nFinance Minister means the Minister administering this Act.\n\nGST Act means the A New Tax System (Goods and Services Tax) Act 1999, as it applies because of Division 177 of that Act.\n\nNote: Under Division 177 of the GST Act, that Act applies notionally to the Commonwealth and Commonwealth entities. They are therefore notionally liable to pay GST, are notionally entitled to input tax credits and notionally have adjustments.\n\nGST qualifying amount means:\n\n (a) an input tax credit (within the meaning of the GST Act); or\n\n (b) a decreasing adjustment (within the meaning of the GST Act).\n\nimportation has the same meaning as in the GST Act.\n\nitem means any of the following:\n\n (a) a State, ACT, NT and local government item;\n\n (b) an administered item;\n\n (c) an administered assets and liabilities item;\n\n (d) an other departmental item;\n\n (e) a corporate entity item.\n\nnon‑corporate entity means:\n\n (a) a non‑corporate Commonwealth entity within the meaning of the Public Governance, Performance and Accountability Act 2013; or\n\n (b) the High Court.\n\nother departmental item means an amount set out in Schedule 2 in relation to a non‑corporate entity opposite the heading “Equity Injections”.\n\nPortfolio Budget Statements means the Portfolio Budget Statements tabled in the Senate or the House of Representatives in relation to the Appropriation Bill (No. 2) 2025‑2026.\n\nportfolio statements means the Portfolio Budget Statements.\n\nspecial account has the same meaning as in the Public Governance, Performance and Accountability Act 2013.\n\nState, ACT, NT and local government item means an amount set out in Schedule 2 opposite an outcome for a non‑corporate entity under the heading “Payments to States, ACT, NT and local government”.\n\n (2) To avoid doubt, for the purposes of other laws this Act is to be treated as an Appropriation Act.\n\n4  Portfolio statements\n\n (1) The portfolio statements are declared to be relevant documents for the purposes of section 15AB of the Acts Interpretation Act 1901.\n\nNote: See paragraph 15AB(2)(g) of the Acts Interpretation Act 1901 which provides that the material that may be considered in the interpretation of a provision of an Act includes any document that is declared by the Act to be a relevant document.\n\n (2) For the purposes of this Act and the Appropriation Act (No. 2) 2025‑2026, the portfolio statements are taken to cover both the Bill for this Act and the Appropriation Bill (No. 2) 2025‑2026.\n\n5  Notional transactions between entities that are part of the Commonwealth\n\n  For the purposes of this Act, notional transactions between non‑corporate entities are to be treated as if they were real transactions.\n\nNote: This section applies, for example, to a “payment” between non‑corporate entities that are both part of the Commonwealth. One of the effects of this section is that the payment will be debited from an appropriation for the paying non‑corporate entity, even though no payment is actually made from the Consolidated Revenue Fund. This is consistent with section 76 of the Public Governance, Performance and Accountability Act 2013.\n\nPart 2—Appropriation items\n\n \n\n6  Summary of appropriations\n\n  The total of the items specified in Schedule 2 is $10,919,452,000.\n\nNote 1: Items in Schedule 2 can be adjusted under Part 3 of this Act.\n\nNote 2: Sections 74 to 75 of the Public Governance, Performance and Accountability Act 2013 also provide for the adjustment of amounts appropriated by this Act.\n\n7  State, ACT, NT and local government items\n\n (1) The amount specified in a State, ACT, NT and local government item for an outcome for a non‑corporate entity may be applied for the purpose of making payments to or for the States, the Australian Capital Territory, the Northern Territory and local government authorities for the purpose of contributing to achieving that outcome.\n\n (2) If the portfolio statements indicate that activities of a particular kind were intended to be treated as activities in respect of a particular outcome, then expenditure for the purpose of carrying out those activities is taken to be expenditure for the purpose of contributing to achieving the outcome.\n\n8  Administered items\n\n (1) The amount specified in an administered item for an outcome for a non‑corporate entity may be applied for expenditure for the purpose of contributing to achieving that outcome.\n\n (2) If the portfolio statements indicate that activities of a particular kind were intended to be treated as activities in respect of a particular outcome, then expenditure for the purpose of carrying out those activities is taken to be expenditure for the purpose of contributing to achieving the outcome.\n\n9  Administered assets and liabilities items\n\n (1) The amount specified in an administered assets and liabilities item for a non‑corporate entity may be applied for expenditure for the purpose of contributing to achieving any outcome specified for the entity:\n\n (a) in Schedule 2 to this Act; or\n\n (b) in Schedule 1 to the Supply Act (No. 1) 2025‑2026.\n\n (2) If the portfolio statements indicate that activities of a particular kind were intended to be treated as activities in respect of a particular outcome, then expenditure for the purpose of carrying out those activities is taken to be expenditure for the purpose of contributing to achieving the outcome.\n\n10  Other departmental items\n\n  The amount specified in an other departmental item for a non‑corporate entity may be applied for the departmental expenditure of the entity.\n\n11  Corporate entity items\n\n (1) The amount specified in a corporate entity item for a corporate entity may be paid to the entity to be applied for the purposes of the entity.\n\n (2) If:\n\n (a) an Act provides that a corporate entity must be paid amounts that are appropriated by the Parliament for the purposes of the entity; and\n\n (b) Schedule 2 contains a corporate entity item for that entity;\n\nthen the entity must be paid the full amount specified in the item.\n\nPart 3—Advance to the Finance Minister\n\n \n\n12  Advance to the Finance Minister\n\n (1) This section applies if the Finance Minister is satisfied that there is an urgent need for expenditure, in the current year, that is not provided for, or is insufficiently provided for, in Schedule 2:\n\n (a) because of an erroneous omission or understatement; or\n\n (b) because the expenditure was unforeseen until after the last day on which it was practicable to provide for it in the Bill for this Act before that Bill was introduced into the House of Representatives.\n\n (2) This Act has effect as if Schedule 2 were amended, in accordance with a determination of the Finance Minister, to make provision for so much (if any) of the expenditure as the Finance Minister determines.\n\n (3) The total of the amounts determined under subsection (2) of this section and subsection 12(2) of the Appropriation Act (No. 2) 2025‑2026 cannot be more than $600 million.\n\n (4) Subsection (3) of this section prevails over subsection 12(3) of the Appropriation Act (No. 2) 2025‑2026.\n\n (5) A determination made under subsection (2) of this section is a legislative instrument, but neither section 42 (disallowance) nor Part 4 of Chapter 3 (sunsetting) of the Legislation Act 2003 applies to the determination.\n\nPart 4—Debit limits\n\n \n\n13  Debit limits\n\nGeneral purpose financial assistance\n\n (1) The debit limit for the current year for the purposes of section 9 of the Federal Financial Relations Act 2009 is $5,000,000,000.\n\nNational partnership payments\n\n (2) The debit limit for the current year for the purposes of section 16 of the Federal Financial Relations Act 2009 is $37,000,000,000.\n\n14  Adjustments for GST\n\n  If:\n\n (a) a payment in respect of an acquisition or importation is made in reliance on a debit limit specified in section 13; and\n\n (b) a GST qualifying amount arises for that acquisition or importation;\n\nthen the debit limit is increased by the amount of the GST qualifying amount.\n\nPart 5—Miscellaneous\n\n \n\n15  Crediting amounts to special accounts\n\n  If any of the purposes of a special account is a purpose that is covered by an item (whether or not the item expressly refers to the special account), then amounts may be debited against the appropriation for that item and credited to that special account.\n\n16  Conditions etc. applying to State, ACT, NT and local government items\n\n (1) This section applies to any payment made out of money appropriated by a State, ACT, NT and local government item for an outcome specified in column 2 of the table in Schedule 1.\n\n (2) The payment:\n\n (a) must be made on the terms and conditions (if any) from time to time determined, in the way described in subsection (3), as applying to payments made:\n\n (i) in relation to the outcome; and\n\n (ii) to or for a State, the Australian Capital Territory, the Northern Territory or a local government authority; and\n\n (iii) out of money appropriated by an annual Appropriation Act; and\n\n (b) must be made in accordance with any determination in writing made by the Minister specified, in column 4 of the table in Schedule 1, for the outcome as to amounts and times of payments.\n\n (3) The way of determining the terms and conditions applying to payments described in paragraph (2)(a) is for the Minister specified, in column 3 of the table in Schedule 1, for the outcome to make the determination in writing before or after the commencement of this Act.\n\n (4) Determinations mentioned in paragraph (2)(a) and determinations made under paragraph (2)(b) are not legislative instruments.\n\n (5) This section does not limit the Commonwealth’s power to:\n\n (a) apply terms and conditions to payments made out of money that is not appropriated by a State, ACT, NT and local government item; or\n\n (b) determine the amounts and times of those payments.\n\n17  Appropriation of the Consolidated Revenue Fund\n\n  The Consolidated Revenue Fund is appropriated as necessary for the purposes of this Act, including the operation of this Act as affected by the Public Governance, Performance and Accountability Act 2013.\n\n18  Repeal of this Act\n\n  This Act is repealed at the start of 1 July 2028.\n\nSchedule 1—Payments to or for the States, ACT, NT and local government\n\nNote: See section 16.\n\n \n\n \n\n| Column 1 | Column 2 It provides temporary funding authority pending passage of the full Appropriation Bills, covering the period from 1 July 2025 until the main budget legislation is enacted. The structure—covering equity injections, administered assets and liabilities, and state payments—aligns with standard Supply Act practice. It also provides for GST adjustments to increase those debit limits where a GST qualifying amount arises (s 14).\n\n- Declares the Portfolio Budget Statements (portfolio statements) to be relevant documents for interpreting the Act and to be taken as covering both the Bill for this Act and the related Appropriation Bill (No. 2) 2025–2026 (s 4).\n\n- Treats internal (notional) transactions between non‑corporate Commonwealth entities as if they were real transactions for appropriation and accounting purposes (s 5).\n\n- Allows amounts appropriated under an item to be debited and credited to a special account if the special account's purposes overlap the item (s 15).\n\n- Requires payments to or for States/territories/local government that are made under the items in Schedule 1 to be made on the terms and conditions determined by the relevant Minister and in accordance with any written payment schedules set by the Minister in column 4 of Schedule 1 (s 16 and Schedule 1).\n\n- Includes standard formal provisions: appropriation of the CRF for operation of the Act (s 17), and repeal of the Act from 1 July 2028 (s 18).\n\n\nWho this affects\n\n- Commonwealth departments and agencies listed in Schedule 2 (they are direct recipients of departmental and non‑operating appropriations).\n- Corporate Commonwealth entities and Commonwealth companies receiving equity injections or payments (definitions, s 3; corporate entity items, s 11).\n- States, the Australian Capital Territory, the Northern Territory and local government authorities that receive or are paid for programs funded under the \"State, ACT, NT and local government\" items (s 7; Schedule 1).\n- The Finance Minister (decision‑making discretion under s 12) and Ministers specified in Schedule 1 (who set terms/conditions and payment timing under s 16).\n- Parliament and accounting officers to the extent the Act changes how appropriations are adjusted and interpreted (s 4, s 12(5)).\n\n\nWhy it matters (official purpose and how the mechanics trade off against other considerations)\n\n- Officially: the Act provides legal authority to spend specified sums on Commonwealth programs and to make certain payments to States/territories/local government and corporate entities (s 6; Schedule 2). It also declares documents that help interpret the scope of those appropriations (s 4).\n\n- Flexibility for urgent needs: s 12 gives the Finance Minister a post‑enactment route to add urgent or unforeseen items into Schedule 2 (mechanism: determination that amends Schedule 2 notionally). That is intended to let the executive address genuine omissions or late emergencies, but it creates a trade‑off between speed and parliamentary oversight because: the Minister’s determinations are legislative instruments (so they are formal) yet s 12(5) expressly removes the usual parliamentary disallowance and sunsetting oversight for those determinations. This reduces the usual parliamentary check on post‑enactment additions. (See s 12(2)–(5).)\n\n- Administrative discretion over intergovernmental payments: s 16 authorises Ministers named in Schedule 1 to set terms, conditions, amounts and payment timing for the payments to or for States/territories/local government. That concentrates decision authority in the specified Ministers and means recipients need to meet ministerial conditions to receive funds (s 16(2)–(3)). The Act also clarifies that such determinations are not legislative instruments (s 16(4)), so those terms and conditions are not subject to standard legislative instrument tabling/disallowance rules.\n\n- Accounting and budgeting effects: treating notional intra‑Commonwealth transactions as real for appropriation purposes (s 5) affects departmental appropriation debits and departmental reporting even where no cash leaves the CRF — this is an accounting mechanism that preserves appropriation discipline across internal transfers.\n\n- Concentration of funded activity: the Schedule shows large, concentrated amounts for particular portfolios (for example defence and infrastructure entries — see Schedule 2), which creates concentrated benefits for those sectors. The Act fixes those allocations for the period and therefore constrains alternative uses of the CRF in 2025–26 (s 6 and Schedule 2).\n\n\nImplementation, costs and risks (mechanisms — not value judgements)\n\n- Who pays: the ultimate source is the Consolidated Revenue Fund. The Act appropriates the CRF as necessary for the purposes set out (s 17).\n\n- Oversight/implementation risk: the Finance Minister’s post‑enactment amendment power (s 12) and the carve‑outs from disallowance and sunsetting (s 12(5)) reduce parliamentary oversight over any additions made under that power. The s 16 non‑instrumental ministerial determinations also avoid legislative instrument procedures. Those features increase executive flexibility but change the available oversight channels.\n\n- Compliance and administrative burden: recipients (States, local governments, agencies, corporate entities) will need to comply with ministerial terms and conditions and with the reporting/accounting practices required by PGPA and other cross‑referenced legislation (see s 3 definitions and note linking to PGPA).\n\n- Effects on private enterprise and markets: the Act itself is an appropriations instrument rather than a regulatory or policy instrument. It transfers public funds to particular programs and entities (including equity injections to some corporate Commonwealth entities). Those transfers may alter contract opportunities, demand for private sector suppliers (notably in defence, infrastructure, and services), and competitive dynamics where government funding supports particular providers. The Act does not itself change tax, competition or market rules, but the allocation of funds is a material input into market opportunities (see Schedule 2 entries and corporate entity/non‑operating items in s 11).\n\n\nKey statutory references (mechanics): s 3 (definitions); s 4 (portfolio statements as interpretive material); s 5 (notional transactions treated as real); s 6 and Schedule 2 (total appropriation and line items); s 7–11 (how different item types may be applied); s 12 (Finance Minister advance power and limits); s 13–14 (debit limits; GST adjustments); s 15–16 (special accounts and conditions for State/territory/local payments); s 17 (appropriation of CRF); s 18 (repeal date).\n\n\nBottom line in one sentence: This Act provides legal authority to spend about $10.92 billion from the CRF on specified Commonwealth programs and recipients in 2025–26, sets limits and accounting rules for intergovernmental and departmental payments, and creates limited executive mechanisms (notably a capped advance power for the Finance Minister and ministerial condition‑setting for State payments) that increase post‑enactment flexibility while narrowing some formal parliamentary oversight paths (see s 6, s 12, s 16)."}},"importantCases":[],"_links":{"self":"/api/acts/supply-act-no-2-2025-2026","history":"/api/acts/supply-act-no-2-2025-2026/history","analysis":"/api/acts/supply-act-no-2-2025-2026/analysis","conflicts":"/api/acts/supply-act-no-2-2025-2026/conflicts","importantCases":"/api/acts/supply-act-no-2-2025-2026/important-cases","documents":"/api/acts/supply-act-no-2-2025-2026/documents"}}
