This Declaration may be cited as Superannuation (PSS) Membership Inclusion Declaration No. 9.\n\n\\[NOTE: This Declaration commences on gazettal: see Acts Interpretation Act 1901, ss. 46a and 48.\\]\n\nInterpretation\n\n2. In this Declaration:\n\n“mobility allowance” means an allowance of that name payable in accordance with a determination made under section 82d of the Public Service Act 1922;\n\n“the Act” means the Superannuation Act 1990.\n\n  \nInclusions\n\n3. Section 6 of the Act applies to a person who:\n\n(a) is eligible to be paid a mobility allowance or would be eligible to be paid the allowance except for the amount of income that the person is receiving; and\n\n(b) was, immediately before first becoming eligible to be paid the allowance:\n\n(i) a member of the Superannuation Scheme; or\n\n(ii) an eligible employee for the purposes of the Superannuation Act 1976 who had made an election and declaration under subsection 244 (1) of that Act.\n\n\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\n\nNOTE\n\n> Note: 1.
