This Declaration may be cited as Superannuation (PSS) Membership Inclusion Declaration No. 10.\n\n> Note: \\[NOTE: This Declaration commences on gazettal: see Acts Interpretation Act 1901, ss. 46A and 48.\\]\n\nInterpretation\n\n2. In this Declaration:\n\n“Act” means the Superannuation Act 1990;\n\n“Corporation” means the Fisheries Research and Development Corporation.\n\nInclusion of certain persons as members of the Superannuation Scheme\n\n3. (1) For the purposes of paragraph 6 (1) (j) of the Act, a person who:\n\n(a) either:\n\n(i) was an employee, or a director, of the Corporation on 1 September 1992; or\n\n(ii) became an employee, or a director, of the Corporation before the commencement of this Declaration; and\n\n(b) has not ceased to be either an employee or a director of the Corporation; and\n\n(c) has elected, other than under section 8 of the Act, to become a member of the Superannuation Scheme before the day on which this Declaration is notified in the Gazette;\n\nis declared to be a person to whom section 6 of the Act applies.\n\n(2) Subclause (1) has effect in relation to a person on and from:\n\n(a) 1 September 1992; or\n\n(b) the day on which the person became an employee, or a director, of the Corporation;\n\nwhichever is the later.\n\n\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\n\nNOTE\n\n> Note: 1.
