This Declaration may be cited as Superannuation (PSS) Membership Inclusion Declaration No. 1.\n\nInterpretation\n\n2. In this Declaration, unless the contrary intention appears:\n\n“eligible employee” has the meaning given by the 1976 Act;\n\n“1976 Act” means the Superannuation Act 1976;\n\n“the Act” means the Superannuation Act 1990.\n\n  \nInclusions\n\n3. Section 6 of the Act applies to a class of persons each of whom:\n\n(a) is a director or an employee of the Dairy Research and Development Corporation; and\n\n(b) either:\n\n(i) was a member of the Superannuation Scheme (other than a person to whom Part IV of the Public Service Act 1922 applied) immediately before becoming a person specified in paragraph (a); or\n\n(ii) has made an election and declaration under subsection 244 (1) of the 1976 Act; and\n\n(c) has not at any time since becoming a person specified in paragraph (a) ceased to be such a person; and\n\n(d) since becoming a person specified in paragraph (a) has not been a member of another superannuation scheme applying in relation to that person's employment with the Dairy Research and Development Corporation, other than the Superannuation Scheme; and\n\n(e) is not a person to whom Part IV of the Public Service Act 1922 applies.\n\n\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\n\nNOTE\n\n1.
