the administrative and operational footprint for Sunshine Coast waterways by creating a dedicated statutory authority and moving functions and management roles that previously sat with other State entities. Concretely, it appoints the Authority as manager of specified public marine facilities (including Mooloolaba Harbour on commencement — s 83), adds waterways to the Transport Infrastructure regime and gives the Authority powers over navigation aids (s 91) and sediment management (s 12(d)). It centralises revenue flow rules (fees generally to consolidated fund, s 59) while allowing retained receipts for facility management, and empowers the Minister with transfer notices (ss 65–66) and directions (s 55), increasing executive discretion over assets, instruments and program consistency (ss 20–21). These changes shift who decides (Minister and Authority/board), who pays (State consolidating most receipts, with some retained by the Authority), and impose new compliance, commercial and stakeholder‑consultation obligations on the Authority and affected third parties (eg councils, operators) (ss 15, 18–19)."},"complexity_factors":["Establishes a new statutory body with corporate status that represents the State and is subject to multiple public‑sector Acts (ss 8–11).","Broad and open‑ended functions and powers (property, contracts, commercial arrangements, infrastructure, navigation and sediment management) create operational and commercial discretion (ss 12–13).","Requires a 10‑year waterways management strategy and rolling 4‑year management programs that the Minister must approve, with ministerial power to direct amendments (ss 14–21).","Board governance, appointment rules, disqualification grounds, suspension powers and conflict‑of‑interest rules impose detailed compliance and governance processes (ss 22–42).","Chief executive appointment framework sits outside the Public Sector Act for the Authority, with distinct terms, disqualification and disclosure rules (ss 43–53, 76).","Ministerial direction power is broad and mandatory to obey, paired with quarterly and annual reporting obligations (ss 55–57), creating centralised executive oversight and compliance burden.","Financial regime: most receipts (eg fees) must be paid into the consolidated fund, but amounts recovered while acting as a facility manager may be retained (s 59), affecting revenue incentives and accounting flows.","Transfer notices permit the Minister to transfer State businesses, assets, liabilities, leases and instruments to the Authority and to change reservations or trustee arrangements — a unilateral statutory mechanism with conditions (ss 64–66).","Cross‑Act amendments extend the Authority’s role across Transport Infrastructure, Marine Safety and Marine Pollution legislation and insert transitional management arrangements (ss 77–97, sch 2).","Specific operational powers such as setting up aids to navigation, managing public marine facilities, and being taken as facility manager for Mooloolaba Harbour introduce asset‑management and safety responsibilities (ss 79, 91, 83).","Criminal history checks, confidentiality rules and mandatory disclosure obligations add personnel‑screening and privacy compliance layers (ss 61–63).","Delegation constraints (eg part 3 functions not delegable by the Authority) and statutory review requirements (3‑yearly reviews and regulation‑making power) add governance complexity (ss 67–69)."],"plain_english_summary":"This Bill creates the Sunshine Coast Waterways Authority to plan, manage and develop specified Sunshine Coast waterways and related marine infrastructure. It gives the Authority corporate powers, a board and a chief executive, and tools to manage navigation, infrastructure and sediment, and to run or become manager of public marine facilities (including Mooloolaba Harbour). The Minister approves strategies and programs and can give directions; the Authority collects some fees but most receipts go to the consolidated fund.
