It gives the government special powers to intervene when these bodies are failing financially or operationally, and sets rules for how they can borrow money and collect rates.\n\n**Key parts explained:**\n\n**Part II — The \"Nuclear Option\" for Failing Authorities**\n- If the Auditor-General finds an elected authority (like a water board or port authority) is in serious financial trouble, guilty of gross mismanagement, or incompetent, they can issue a \"warning notice\"\n- The authority gets a month to respond\n- If the Governor isn't satisfied, a three-person review committee (including the Solicitor-General) examines the case\n- Ultimately, the Governor can **sack the entire elected body** and appoint a **commission of three people** to run the authority instead\n- This commission takes over all property, powers, contracts, and duties of the original authority\n- The elected members immediately lose their positions\n- The commission can run things for up to 12 months (longer only if Parliament agrees)\n- The Governor can later restore elections and hand back control\n\n**Part III — Borrowing Rules**\n- Elected authorities that can levy rates can issue debentures (a type of loan certificate) similar to councils\n- **Critical restriction:** No authority can mortgage property or give security for loans without the Treasurer's written approval\n- Exception: Banks making ordinary business advances don't need approval\n- Exception: Loans from the Governor under other laws are exempt\n\n**Part IV — Rates Exemptions**\n- Authorities cannot charge rates or taxes on land that's exempt from council rates (like churches, hospitals, or government land)\n- However, they CAN charge for actual services provided (like water or sewerage)\n\n**Part V — Collecting Money Owed**\n- When authorities charge rates, fees, or recover costs for work done on land, these debts are automatically \"charged\" on the land (like a mortgage)\n- These charges have **equal priority** with council rates and rank **above all other mortgages or debts**\n- Authorities can use the same debt recovery procedures as local councils under the Local Government Act 1993\n\n**Part VI — Ouster of Office**\n- This section was repealed (removed) in 1995\n\n**Who it affects:**\n- Statutory authorities with elected members (water boards, drainage boards, port authorities, etc.)\n- The Auditor-General and Treasurer\n- Property owners who deal with these authorities\n- Banks and lenders to public bodies\n\n**Why it matters:**\nThis is essentially an emergency powers law. It protects the public from incompetent or corrupt management of essential services by allowing democratically elected boards to be replaced with appointed commissioners. It also ensures these bodies can't recklessly mortgage public assets without Treasury oversight."},"summary":{"complexity_score":2,"scope_assessment":{"changed":false,"description":"Insufficient legislative text has been provided to assess whether the scope of this Act has changed from its original intent.
