It was made specifically to declare who counts as a 'full fee paying private overseas secondary student' under the enabling Act, and it does exactly that without expanding into unrelated areas."},"complexity_factors":["Extremely short instrument containing only 2 regulations total","Single operative provision with three simple cumulative conditions joined by 'and' logic","Minimal cross-referencing (only to the parent Act and the Migration Act 1958)","No defined terms, schedules, or technical machinery within the instrument","No exceptions, exemptions, or conditional branching"],"plain_english_summary":"This regulation defines who qualifies as a **'full fee paying private overseas secondary student'** under Australian school funding laws. It applies to international high school students who meet three criteria:\n\n*   **Enrollment:** They must be attending a secondary school in Australia;\n*   **Visa status:** They must hold a valid temporary entry permit (a type of visa) under the *Migration Act 1958*; and\n*   **Full fee payment:** They (or their guardian) must pay fees that cover the **full cost** of their education at that school—meaning they don't receive tuition discounts or subsidies.\n\nThis classification is important because it determines whether a school receives government grants for that student. Essentially, it ensures that wealthy international students paying commercial fees don't attract the same public funding as Australian residents or scholarship holders."}},"importantCases":[],"_links":{"self":"/api/acts/states-grants-schools-assistance-regulations","history":"/api/acts/states-grants-schools-assistance-regulations/history","analysis":"/api/acts/states-grants-schools-assistance-regulations/analysis","conflicts":"/api/acts/states-grants-schools-assistance-regulations/conflicts","importantCases":"/api/acts/states-grants-schools-assistance-regulations/important-cases","documents":"/api/acts/states-grants-schools-assistance-regulations/documents"}}
