Other subtypes include malignant stromal and germ cell tumours.\n\n(3) While malignant neoplasm of the ovary attracts ICD‑10‑AM code C56 or D39.1, in applying this Statement of Principles the meaning of malignant neoplasm of the ovary is that given in subsection (2).\n\n(4) For subsection (3), a reference to an ICD-10-AM code is a reference to the code assigned to a particular kind of injury or disease in The International Statistical Classification of Diseases and Related Health Problems, Tenth Revision, Australian Modification (ICD-10-AM), Tenth Edition, effective date of 1 July 2017, copyrighted by the Independent Hospital Pricing Authority, ISBN 978-1-76007-296-4.\n\nDeath from malignant neoplasm of the ovary\n\n(5) For the purposes of this Statement of Principles, malignant neoplasm of the ovary, in relation to a person, includes death from a terminal event or condition that was contributed to by the person's malignant neoplasm of the ovary.\n\n> Note: terminal event is defined in the Schedule 1 – Dictionary.\n\n8 Basis for determining the factors\n\nOn the sound medical‑scientific evidence available, the Repatriation Medical Authority is of the view that it is more probable than not that malignant neoplasm of the ovary and death from malignant neoplasm of the ovary can be related to relevant service rendered by veterans or members of the Forces under the VEA, or members under the MRCA.\n\n> Note: MRCA, relevant service and VEA are defined in the Schedule 1 – Dictionary.\n\n9 Factors that must exist\n\nAt least one of the following factors must exist before it can be said that, on the balance of probabilities, malignant neoplasm of the ovary or death from malignant neoplasm of the ovary is connected with the circumstances of a person's relevant service:\n\n(1) having endometriosis for at least five years before the clinical onset of malignant neoplasm of the ovary;\n\n(2) having received a cumulative equivalent dose of at least 0.5 sievert of ionising radiation to the ovary at least ten years before the clinical onset of malignant neoplasm of the ovary;\n\nNote: cumulative equivalent dose is defined in the Schedule 1 - Dictionary.\n\n(3) being obese for at least five years within the 20 years before the clinical onset of malignant neoplasm of the ovary;\n\nNote: being obese is defined in the Schedule 1 - Dictionary.\n\n(4) inhaling respirable asbestos fibres in an enclosed space:\n\n(a) for a cumulative period of at least 2 000 hours before the clinical onset of malignant neoplasm of the ovary; and\n\n(b) at the time material containing respirable asbestos fibres was being applied, removed, dislodged, cut or drilled; and\n\n(c) where the first inhalation of respirable asbestos fibres occurred at least ten years before the clinical onset of malignant neoplasm of the ovary;\n\n(5) inhaling respirable asbestos fibres in an open environment:\n\n(a) for a cumulative period of at least 6 000 hours before the clinical onset of malignant neoplasm of the ovary; and\n\n(b) at the time material containing respirable asbestos fibres was being applied, removed, dislodged, cut or drilled; and\n\n(c) where the first inhalation of respirable asbestos fibres occurred at least ten years before the clinical onset of malignant neoplasm of the ovary;\n\n(6) for parous women only, an inability to breast feed for a cumulative period of at least six months before the clinical onset of malignant neoplasm of the ovary;\n\n> Note: The period of breastfeeding could be cumulative over a number of pregnancies.\n\n(7) for epithelial ovarian cancer only:\n\n(a) being nulliparous at the time of the clinical onset of malignant neoplasm of the ovary; or\n\n> Note: nulliparous is defined in the Schedule 1 - Dictionary.\n\n(b) having hormone replacement therapy for at least five consecutive years before the clinical onset of malignant neoplasm of the ovary, and where the use of hormone replacement therapy has ceased, the clinical onset of malignant neoplasm of the ovary has occurred within ten years of that period;\n\n> Note: hormone replacement therapy is defined in the Schedule 1 - Dictionary.\n\n(8) for mucinous ovarian tumours only, smoking at least ten pack-years of cigarettes, or the equivalent thereof in other tobacco products, before the clinical onset of malignant neoplasm of the ovary, and:\n\n(a) smoking commenced at least ten years before the clinical onset of malignant neoplasm of the ovary; and\n\n(b) where smoking has ceased, the clinical onset of malignant neoplasm of the ovary, has occurred within 20 years of cessation;\n\n> Note: pack-years of cigarettes, or the equivalent thereof in other tobacco products is defined in the Schedule 1 - Dictionary.\n\n(9) inability to obtain appropriate clinical management for malignant neoplasm of the ovary.\n\n10 Relationship to service\n\n(1) The existence in a person of any factor referred to in section 9, must be related to the relevant service rendered by the person.\n\n(2) The factor set out in subsection 9(9) applies only to material contribution to, or aggravation of, malignant neoplasm of the ovary where the person's malignant neoplasm of the ovary was suffered or contracted before or during (but did not arise out of) the person's relevant service.\n\n11 Factors referring to an injury or disease covered by another Statement of Principles\n\nIn this Statement of Principles:\n\n(1) if a factor referred to in section 9 applies in relation to a person; and\n\n(2) that factor refers to an injury or disease in respect of which a Statement of Principles has been determined under subsection 196B(3) of the VEA;\n\nthen the factors in that Statement of Principles apply in accordance with the terms of that Statement of Principles as in force from time to time.\n\nSchedule 1 \\- Dictionary\n\nNote: See Section 6\n\n1 Definitions\n\nIn this instrument:\n\nbeing obese means having a Body Mass Index (BMI) of 30 or greater.\n\n> Note: BMI is also defined in the Schedule 1 - Dictionary.\n\nBMI means W/H2 where:\n\nW is the person's weight in kilograms; and\n\nH is the person's height in metres.\n\ncumulative equivalent dose means the total dose of ionising radiation received by the particular organ or tissue from external exposure, internal exposure or both, apart from normal background radiation exposure in Australia, calculated in accordance with the methodology set out in Guide to calculation of 'cumulative equivalent dose' for the purpose of applying ionising radiation factors contained in Statements of Principles determined under Part XIA of the Veterans' Entitlements Act 1986 (Cth), Australian Radiation Protection and Nuclear Safety Agency, as in force on 2 August 2017.\n\n> Note 1: Examples of circumstances that might lead to exposure to ionising radiation include being present during or subsequent to the testing or use of nuclear weapons, undergoing diagnostic or therapeutic medical procedures involving ionising radiation, and being a member of an aircrew, leading to increased levels of exposure to cosmic radiation.\n\nNote 2: For the purpose of dose reconstruction, dose is calculated as an average over the mass of a specific tissue or organ. If a tissue is exposed to multiple sources of ionising radiation, the various dose estimates for each type of radiation must be combined.\n\nhormone replacement therapy means administration of estrogen preparations often in combination with progesterone to offset a hormone deficiency following surgically induced or naturally occurring menopause.\n\nmalignant neoplasm of the ovary—see subsection 7(2).\n\nMRCA means the Military Rehabilitation and Compensation Act 2004.\n\nnulliparous means never having experienced a gestation period of at least 20 weeks.\n\npack-years of cigarettes, or the equivalent thereof in other tobacco products means a calculation of consumption where one pack-year of cigarettes equals 20 tailor-made cigarettes per day for a period of one calendar year, or 7 300 cigarettes. One tailor-made cigarette approximates one gram of tobacco or one gram of cigar or pipe tobacco by weight. One pack-year of tailor-made cigarettes equates to 7.3 kilograms of smoking tobacco by weight. Tobacco products mean cigarettes, pipe tobacco or cigars, smoked alone or in any combination.\n\nrelevant service means:\n\n(a) eligible war service (other than operational service) under the VEA;\n\n(b) defence service (other than hazardous service and British nuclear test defence service) under the VEA; or\n\n(c) peacetime service under the MRCA.\n\n> Note: MRCA and VEA are also defined in the Schedule 1 - Dictionary.\n\nterminal event means the proximate or ultimate cause of death and includes the following:\n\n(a) pneumonia;\n\n(b) respiratory failure;\n\n(c) cardiac arrest;\n\n(d) circulatory failure; or\n\n(e) cessation of brain function.\n\nVEA means the Veterans' Entitlements Act 1986.\n\n> Note: Endnotes\n\n> Note: Endnote 1—About the endnotes\n\nThe endnotes provide information about this compilation and the compiled law.\n\nThe following endnotes are included in every compilation:\n\nEndnote 1—About the endnotes\n\nEndnote 2—Abbreviation key\n\nEndnote 3—Legislation history\n\nEndnote 4—Amendment history\n\nAbbreviation key—Endnote 2\n\nThe abbreviation key sets out abbreviations that may be used in the endnotes.\n\nLegislation history and amendment history—Endnotes 3 and 4\n\nAmending laws are annotated in the legislation history and amendment history.\n\nThe legislation history in endnote 3 provides information about each law that has amended (or will amend) the compiled law. The information includes commencement details for amending laws and details of any application, saving or transitional provisions that are not included in this compilation.\n\nThe amendment history in endnote 4 provides information about amendments at the provision (generally section or equivalent) level. It also includes information about any provision of the compiled law that has been repealed in accordance with a provision of the law.\n\nMisdescribed amendments\n\nA misdescribed amendment is an amendment that does not accurately describe the amendment to be made. If, despite the misdescription, the amendment can be given effect as intended, the amendment is incorporated into the compiled law and the abbreviation “(md)” added to the details of the amendment included in the amendment history.\n\nIf a misdescribed amendment cannot be given effect as intended, the abbreviation “(md not incorp)” is added to the details of the amendment included in the amendment history.\n\n> Note: Endnote 2—Abbreviation key\n\n| | o = order(s) |\n| ---------------------------------------------- | ----------------------------------- |\n| ad = added or inserted | Ord = Ordinance |\n| am = amended | orig = original |\n| amdt = amendment | par = paragraph(s)/subparagraph(s) |\n| c = clause(s) | /sub‑subparagraph(s) |\n| C[x] = Compilation No. x | pres = present |\n| Ch = Chapter(s) | prev = previous |\n| def = definition(s) | (prev…) = previously |\n| Dict = Dictionary | Pt = Part(s) |\n| disallowed = disallowed by Parliament | r = regulation(s)/rule(s) |\n| Div = Division(s) | |\n| exp = expires/expired or ceases/ceased to have | reloc = relocated |\n| effect | renum = renumbered |\n| F = Federal Register of Legislation | rep = repealed |\n| gaz = gazette | rs = repealed and substituted |\n| LA = Legislation Act 2003 | s = section(s)/subsection(s) |\n| LIA = Legislative Instruments Act 2003 | Sch = Schedule(s) |\n| (md) = misdescribed amendment can be given | Sdiv = Subdivision(s) |\n| effect | SLI = Select Legislative Instrument |\n| (md not incorp) = misdescribed amendment | SR = Statutory Rules |\n| cannot be given effect | Sub‑Ch = Sub‑Chapter(s) |\n| mod = modified/modification | SubPt = Subpart(s) |\n| No. = Number(s) | underlining = whole or part not |\n| | commenced or to be commenced |\n\n> Note: Endnote 3—Legislation history\n\n| Name | Registration | Commencement | Application, saving and transitional provisions |\n| ------------------------------------------------------------------------------------------- | ------------------------- | --------------- | ----------------------------------------------- |\n| Statement of Principles concerning malignant neoplasm of the ovary No. 10 of 2018 | 2 January 2018F2018L00011 | 29 January 2018 | |\n| Amendment Statement of Principles concerning malignant neoplasm of the ovary No. 36 of 2018 | 5 March 2018F2018L00184 | 2 April 2018 | |\n\n> Note: Endnote 4—Amendment history\n\n| Provision affected | How affected |\n| ---------------------- | ---------------------------- |\n| Subsection 10(2)..…….. | rs Instrument No. 36 of 2018 |","sortOrder":0}],"analysis":{"flash_summary":{"complexity_score":4,"scope_assessment":{"changed":false,"description":"This instrument updates and replaces the 2009 Statement of Principles for malignant neoplasm of the ovary (section 4). The update clarifies and enumerates specific, measurable factors (e.g. radiation dose threshold, asbestos exposure hour thresholds, obesity criteria, breastfeeding, parity and HRT criteria) and cross‑references technical guidance for dose calculation. These additions refine how service‑connection is assessed but operate within the original statutory purpose: to set medical‑scientific criteria linking ovarian cancer to relevant service for VEA/MRCA claims (sections 3, 7–9). The Statement lists specific, measurable factors; if at least one applies and is linked to the person's relevant service, the disease is treated as connected to service (sections 9–10).\n\nWho this affects\n\n- Veterans, former members of the Australian Defence Force or serving members who lodge a claim for treatment, pension, or compensation under the VEA or MRCA for ovarian cancer (section 5).\n- Medical assessors, DVA case officers, and the Repatriation Medical Authority who apply these criteria when determining service connection (sections 3, 8–11).\n\nWhat the Statement treats as \"malignant neoplasm of the ovary\"\n\n- It defines ovarian malignant neoplasm as a primary cancer arising in ovarian cells, includes tumours of borderline malignant potential, and expressly excludes a small set of non‑ovarian tumour types (section 7(2)–(4)). ICD codes are noted but the statutory definition in 7(2) controls.\n\nWhich specific factors count (at least one must exist and be related to relevant service) — summary of section 9\n\n- Endometriosis present for at least 5 years before clinical onset (9(1)).\n- Cumulative dose of ionising radiation to the ovary of at least 0.5 sievert, with first exposure at least 10 years before onset (9(2); Schedule definition of \"cumulative equivalent dose\").\n- Obesity (BMI 30+) for at least 5 years within the 20 years before clinical onset (9(3); Schedule defines BMI and \"being obese\").\n- Significant occupational/environmental asbestos inhalation, with separate thresholds for enclosed space (2,000 cumulative hours) and open environment (6,000 hours), and first inhalation at least 10 years before onset; exposures must have occurred while asbestos‑containing material was being disturbed (9(4)–(5)).\n- For women who have given birth (parous), inability to breastfeed for at least 6 cumulative months before clinical onset (9(6)).\n- For epithelial ovarian cancer specifically: nulliparity (never a 20+ week gestation) at time of onset, or hormone replacement therapy (HRT) for at least 5 consecutive years before onset (HRT‑related onset must occur within 10 years of stopping therapy) (9(7); Schedule defines HRT and nulliparous).\n- For mucinous ovarian tumours only: smoking the equivalent of at least 10 pack‑years, starting at least 10 years before onset; if smoking ceased, onset must be within 20 years of cessation (9(8); Schedule defines pack‑years).\n- Inability to obtain appropriate clinical management for the ovarian cancer (9(9)). Section 10(2) limits how this particular factor applies as a service connection ground.\n\nOther operational points\n\n- Any factor that is itself an injury/disease covered by another Statement of Principles brings that other Statement into play (cross‑reference, section 11).\n- The Schedule contains key definitions and the accepted method for calculating radiation dose (important for dose reconstruction) (Schedule 1).\n\nWhy this matters (claimed purpose, then tested against practical effects)\n\n- The Repatriation Medical Authority states (section 8) that this instrument is based on the available medical‑scientific evidence and is intended to give clear, objective thresholds that link ovarian cancer to military/relevant service on the balance of probabilities. Practically, that means claimants who meet the listed criteria will have a simplified pathway to a finding of service connection for the disease.\n\nPractical effects, incentives and implementation trade‑offs\n\n- Who pays: The instrument itself does not pay benefits; it affects entitlement decisions administered by DVA (so costs flow to the Government/taxpayers if more claims meet the criteria). The Statement changes the evidentiary thresholds that DVA uses to accept claims (sections 5, 8–10).\n\n- Who benefits: Individuals who meet one of the listed, objectively measurable factors and can show it is related to their relevant service receive the practical benefit of a presumptive link to service when adjudicating claims (section 9). Those benefits are concentrated among claimants who can document exposures/medical history; costs are diffuse across the public budget.\n\n- Administrative and compliance costs: Applying the Statement requires medical records, service records, radiation dose reconstruction (Schedule definition and referenced Guide), exposure histories (asbestos hours), and proof of reproductive history or HRT use. These evidentiary requirements create record‑gathering and assessment work for claimants, clinicians and DVA. The need for dose reconstruction and detailed exposure histories may increase use of expert reports.\n\n- Bureaucratic discretion and legal predictability: The Statement supplies objective thresholds (e.g. 0.5 sievert, 2,000/6,000 hours, BMI 30, 10 pack‑years) which reduce purely discretionary decision‑making, but adjudicators still must determine whether the factor is \"related to relevant service\" (section 10(1)), a factual assessment that retains some administrative discretion.\n\n- Effects on private parties and markets: The instrument primarily governs entitlement decisions about past exposures and medical states; it does not directly regulate current businesses, prices, competition, or contract freedoms. Indirectly, veterans or former employees might seek employer records to prove asbestos exposure, which could surface historical employer liability information, but the Statement does not create new civil liability or regulatory obligations on private firms.\n\n- Implementation risks and complexity points: estimating cumulative equivalent radiation dose (requires following the referenced ARPANSA guide), proving precise asbestos inhalation hours decades after exposure, or proving cumulative breastfeeding duration introduce evidentiary uncertainty and may increase expert reliance. Those implementation challenges can delay claim resolution or raise costs for both claimants and the department.\n\n- Interaction with other Statements: where a listed factor is itself covered by another Statement of Principles, that other Statement applies (section 11). This reduces inconsistency but requires cross‑checking multiple instruments when assessing complex claims.\n\nNet mechanics in one sentence\n\n- If a claimant for VEA/MRCA entitlements shows that at least one of the objectively defined factors in section 9 existed, and that factor is related to their defined \"relevant service\" (section 10), then, on the balance of probabilities, the Repatriation Medical Authority treats their ovarian cancer (or death from it) as connected with service for the purposes of entitlement decisions (sections 8–10)."},"flash_summary_failed":{"failed":true,"reason":"A positive credit balance is required for all requests, including BYOK, so fallback providers remain available.
