If approved the contributor pays an extra levy from their account; the benefit increases death/invalidity entitlements before age 55 (s 13). \n\n- Sets complex technical rules for calculating contributions and benefits. Contributions are calculated by formulae that use a contributor’s elected rate, an attributed salary and a salary-ratio (s 16). Benefits (retirement, death, invalidity, resignation, retrenchment, preserved benefits) are calculated using accrued and prospective “benefit points”, final salary and other statutory formulas (Part 5, esp. s 25, 27, 28–34). \n\n- Allows preservation and transfer options: a contributor who leaves employment may elect a preserved benefit, and there are rules for transferring credits between employers and for contributors transferred as a result of Government initiatives (s 34, sch 7, s 22A). \n\n- Gives the Board a range of administrative powers and discretions: to adjust account balances (s 10), to require medical evidence and other information (ss 13, 52–53), to defer or refuse payments where necessary information is missing (s 52), to recover money with interest (s 58), and to make discretionary decisions about timing and interest on payments (ss 35A, 58). The Governor may make orders affecting secondments and amend employer lists and exclusions (ss 6(6)–(7), 24, 51). Regulations fill many detailed matters (s 61). \n\n- Requires periodic actuarial valuation (every three years) and reporting to the Minister (s 11).\n\n**Who this affects**\n\n- Employees of the State and named public authorities listed in Schedule 3 who were eligible to elect to contribute (definition of “employee” and “employer”, s 5; Schedule 3). \n\n- Current contributors (people whose election took effect), their employers (who share costs), the Board (who administers the Fund) and beneficiaries (contributors, personal representatives or persons named by succession rules). \n\n- Certain categories are excluded from coverage (Schedule 4), and the Governor can add or remove employers from Schedule 3 (s 51). \n\n**Why it matters (claimed purpose and operational effects)**\n\n- The stated purpose is to provide a statutory superannuation scheme for qualifying State public service employees (Part 2, s 7; Part 5 benefit rules). That purpose is delivered by: (a) collecting member and employer contributions, (b) investing and managing balances, and (c) converting those contributions into retirement, death and invalidity benefits according to statutory formulas (ss 7, 16, Part 5). \n\n- Practical incentives and costs created by the Act: \n - Employees bear a direct, ongoing cost through 2–9% salary contributions (s 12, s 16). \n - Employers bear half of employee contribution flow and may be required to make lump payments when benefits fall due (s 22). \n - Contributors face administrative and evidence burdens (employer certificates to join, medical exams to get supplementary cover, continuing reporting requirements) (ss 12, 13, 52–53). \n - Contributors who leave and later re-enter must repay benefits with interest in some cases to resume contributions without penalty (s 18). \n\n- Trade-offs and implementation risks to note: \n - Complexity of the rules (many definitions, formulas and cross-references in Part 5) increases the administrative cost for the Board and compliance costs for employers and contributors (s 25–27, s 16). \n - The Board has broad discretion in a number of places (rates for account adjustments, refusal of applications where information is missing, timing of payments and interest) — this centralises decision-making and creates operational reliance on Board systems and judgment (ss 10, 11, 13, 35A, 52–54). \n - Closing the scheme to new entrants (s 3A) alters incentives and future liabilities: it limits new member inflows, which affects the funded profile and shifts the cash‑flow and demographic mix of members to the existing cohort. \n - The formulas tie benefits to concepts like “salary ratio”, “accrued/prospective benefit points”, and inflation indices, which can produce non-intuitive results for members unless administration and communication are clear (s 25, s 27). \n\n**Who pays, who decides, and what behaviour changes**\n\n- Who pays: contributors (salary deductions) and employers (contributions equal to half employees’ contributions; possibly extra employer-financed amounts when benefits are paid) (ss 16, 20, 22). The Board can recover arrears and charge interest (s 58). \n\n- Who decides: the Board runs the Fund, sets adjustment rates for accounts and many operational details, and can exercise discretion on applications, timing and interest (ss 7, 10, 11, 13, 35A). The Governor has specific powers to declare secondments and amend employer and exclusion schedules (ss 6(6)–(7), 24, 51). Regulations fill further detail (s 61). \n\n- Behaviour changes required: eligible employees must elect and provide employer certification to join (s 12); contributors must pay dues and can elect supplementary cover (s 13); employers must report salary/certificates and withhold/pay contributions (ss 12, 20, 52). Members leaving service must choose between an immediate preserved benefit or other statutory exit benefits (s 34). \n\n**Key implementation and compliance burdens**\n\n- Employers must certify employee information for elections and report salary changes; failure risks refusal or delay of applications/benefits (ss 12, 20, 52). \n\n- Contributors seeking supplementary benefit face medical examinations and the risk of refusal or later revocation for untrue statements; the Board may keep supplementary levies already paid if approval is revoked (s 13, s 53). \n\n- The Board must run periodic actuarial valuations, track many separate accounts, calculate multiple statutory formulas and maintain compliance against cross-referenced rules and schedules (ss 9, 10, 11, Part 5). \n\n**Bottom line (mechanical effect)**\n\nThis Act sets up and runs a closed-defined (for new entrants) statutory superannuation fund for specified public service employees. It prescribes contribution rates and collection mechanisms, detailed benefit calculation rules based on contributory history and salary measures, optional supplementary cover with extra levies, transfer and preserved-benefit rules for leavers, and significant administrative discretion and compliance obligations concentrated in the Board and supported by Governor-made orders and regulations (see ss 3A, 7, 9, 12–13, 16, Part 5, ss 51, 61)."},"kimi_summary":{"_metrics":{"completionTokens":1029},"content_quality":"ok","complexity_score":8,"scope_assessment":{"changed":true,"description":"The legislation has grown significantly beyond its original 1985 framework.
