{"id":"F2009L02629","name":"Social Security (Treating Health Professionals) Determination 2009","slug":"social-security-treating-health-professionals-determination-2009","collection":"legislative_instrument","jurisdiction":"commonwealth","status":"repealed","isInForce":false,"actNumber":null,"makingDate":null,"administeringDepartment":null,"currentVersion":{"id":79641,"registerId":"commonwealth-F2009L02629-current","compilationNumber":null,"startDate":"2026-04-02","status":"Repealed","reasons":null,"registeredAt":null},"sections":[{"sectionNumber":"1","sectionType":"section","heading":"Social Security (Treating Health Professionals) Determination 2009","content":"![](image.001.png)\n\nSocial Security (Treating Health Professionals) Determination 20091\n\nSocial Security Act 1991\n\nI, JEFF HARMER, Secretary of the Department of Families, Housing, Community Services and Indigenous Affairs, make this Determination under section 38F of the Social Security Act 1991.\n\nDated 26 June 2009\n\nJEFF HARMER\n\nSecretary  \nDepartment of Families, Housing, Community Services and Indigenous Affairs\n\n1 Name of Determination\n\nThis Determination is the Social Security (Treating Health Professionals) Determination 2009.\n\n2 Commencement\n\nThis Determination commences on 1 July 2009.\n\n3 Treating health professionals\n\nFor section 38F of the Social Security Act 1991, each of the following kinds of person is a treating health professional:\n\n(a) a person registered or licensed as a medical practitioner under a law of a State or Territory that provides for the registration or licensing of medical practitioners;\n\n(b) a person registered or licensed as a nurse under a law of a State or Territory that provides for the registration or licensing of nurses;\n\n(c) an occupational therapist who is eligible for membership of the Australian Association of Occupational Therapists;\n\n(d) a person registered or licensed to practise physiotherapy under a law of a State or Territory that provides for the registration or licensing of physiotherapists;\n\n(e) a person registered as a psychologist under a law of a State or Territory that provides for the registration of psychologists;\n\n(f) a person employed in a clinical role as an Aboriginal or Torres Strait Islander health worker, by a health service, in a geographically remote location.\n\n> Note\n\n> Note: 1.
