They replace previous versions from 2022/2023 and set out the rules for:\n\n1. **Cemeteries** – how burials, funerals, and memorials are managed in the Shire's cemeteries\n2. **Cats** – how many cats you can keep, where they are banned, and when you need a permit\n3. **Dogs** – rules about confining dogs, limits on numbers, and licensing for commercial kennels\n\n**Who it affects:**\n\n- **Residents of Esperance** who own pets, want to bury loved ones, or operate pet businesses\n- **Funeral directors and monumental masons** (people who make headstones) who need licences to work in cemeteries\n- **Kennel operators** who need approval to run boarding facilities\n\n**Key things to know:**\n\n**For Cemeteries:**\n- You need a 25-year \"grant\" (a right) to be buried in a specific grave, which can be renewed\n- Funerals can only happen on weekdays between 10am–3pm (not public holidays) unless the Council approves otherwise\n- Funeral directors and stone masons need annual licences from the Council\n- There are strict rules about coffin construction, grave depth (at least 600mm), and what memorials you can erect\n- Ashes can only be placed in designated areas with permission\n\n**For Cats:**\n- You can keep up to 2 cats without a permit; more than that requires a permit (max 6 for houses, 3 for apartments)\n- Cats are banned entirely from specific places like beaches, parks, and the cemetery (listed in Schedule 1)\n- \"Cat nuisance\" is defined broadly and can result in a notice to stop the behaviour\n- Permits for extra cats require neighbour consultation and Council approval\n\n**For Dogs:**\n- Dogs must be properly confined behind fences that suit their size and breed\n- You can keep 2 dogs (or 4 on properties over 4 hectares) without a permit; more requires a kennel licence\n- Commercial kennels need a licence with strict conditions about facilities, noise, odour control, and proximity to neighbours\n- Owners must clean up after their dogs in public places\n\n**Why it matters:**\n\nThese laws give the Council power to manage public health, safety, and amenity. They balance individual rights (burying loved ones, keeping pets) with community concerns (noise, smell, hygiene, respectful treatment of cemeteries). The infringement notice system means minor breaches can be dealt with by fines rather than court, but serious breaches can still result in penalties up to $5,000."},"flash_summary":{"complexity_score":6,"scope_assessment":{"changed":false,"description":"Each local law repeals its prior version (see Cemeteries cl.1.4; Cat cl.1.4; Dog cl.1.4).
