The\nplanning control area has previously been declared to protect land over Anketell Road (between\nKwinana Freeway and Battersby Road). Planning Control Area 169 is now modified in relation to land\nrequirements affecting Lots 7 (No. 734), 89 (No. 748) and 90 (No. 758) Anketell Road, in accordance\nwith Part 7 of the\nPlanning and Development Act 2005 and as shown on WAPC plan numbered\n1.8001/2.\nNotice is hereby given that the WAPC has resolved to revoke Planning Control Area 157 pursuant to\nsection 113 of the\nPlanning and Development Act 2005, and that the Minister for Planning has granted\napproval for the revocation. The land requirements associated with this section of Anketell Road are\noutlined in and protected by the above declared Planning Control Area 182.\nPurpose of the Planning Control Areas\nPlanning Control Area 181 is intended to protect the land required for the proposed Westport port\nprecinct, including associated primary regional road and railways access. Planning Control Area 182 is\nintended to protect the land required for the Anketell Road West primary regional road corridor and\nrail access to the port precinct.\nThe WAPC considers that the planning control areas are required over the properties to ensure that no\ndevelopment occurs on the land which might prejudice this purpose until it may be reserved for Port\nInstallations, Railways and/or Primary Regional Roads (as applicable) in the Metropolitan Region\nScheme.\nDuration and Effects\nThe declaration of Planning Control Areas 181 and 182 remains in effect for a period of five years from\nthe date of publication of this notice in the\nGovernment Gazette, being 9 July 2024, or until revoked by\nthe WAPC with the approval of the Minister, whichever is the sooner.\nThe amended Planning Control Area 169 remains in effect until 17 March 2028, being a period of five\nyears from the date of its original publication in the\nGovernment Gazette or until revoked by the WAPC\nwith the approval of the Minister, whichever is sooner.\nThe revocation of Planning Control Area 157 is effective from the date of this notice in the\nGovernment\nGazette.\nA person shall not commence and carry out development in a planning control area without the prior\napproval of the WAPC. The penalty for failure to comply with this requirement is $200,000 and, in the\ncase of a continuing offence, a further fine of $25,000 for each day during which the offence continues.\nCompensation is payable in respect of land injuriously affected by this declaration, and land so affected\nmay be acquired by the WAPC in the same circumstances and in the same manner as if the land had\nbeen reserved in the Metropolitan Region Scheme for a public purpose.\nDisplay Locations\nDocuments and information regarding land acquisition and compensation can be viewed online at the\nDepartment of Planning, Lands and Heritage’s website at—\nhttps://www.wa.gov.au/government/document-collections/planning-control-areas.\nMs SAM BOUCHER, Secretary, Western Australian Planning Commission.\n\n1704 GOVERNMENT GAZETTE, WA 9 July 2024\nPUBLIC NOTICES\nZZ401\nTRUSTEES ACT 1962\nDECEASED ESTATES\nNotice to Creditors and Claimants\nMilutin Gajic, late of 4 Boronia Close, Camillo, Western Australia, deceased.\nCreditors and other persons having claims (to which Section 63 of the\nTrustees Act 1962 relates) in\nrespect of the estate of the deceased, who died on 26 April 2023, are required by the Executor Shannon\nLee Van Der Vaart, of 8 Rowley Street, Kelmscott, Western Australia to send particulars of their claims\nto her by the date one month from the publication date after which date the Executor may convey or\ndistribute the assets, having regard only to the claims of which she then has notice.\n———————————\nZZ402\nTRUSTEES ACT 1962\nDECEASED ESTATES\nNotice to Creditors and Claimants\nRaymond Michael Schuller, late of 15 Jargoon Approach, Dalyellup in the State of Western Australia,\ndeceased.\nCreditors and other persons having claims (to which Section 63 of the\nTrustees Act 1962 relates) in\nrespect of the estate of the deceased, who died 05/10/2023, are required by the trustee of the late\nRaymond Michael Schuller, c/- Mountains Lawyers, PO Box 5379, Rockingham Beach WA 6969 to send\nparticulars of their claims to the trustee within 30 days of this notice, after which date the trustee may\nconvey or distribute the assets, having regard only to the claims of which the trustee then has notice.\nMOUNTAINS LAWYERS PTY LTD, Solicitors for the Trustee.\nPh: (08) 9592 7326.\n———————————\nZZ403\nTRUSTEES ACT 1962\nDECEASED ESTATES\nNotice to Creditors and Claimants\nRhiana Elizabeth Powell, late of 2B Havenvale Crescent, Dianella, Western Australia, deceased.\nCreditors and other persons having claims (to which Section 63 of the\nTrustees Act 1962 relates) in\nrespect of the estate of the deceased, Rhiana Elizabeth Powell who died on 4 September 2023, are\nrequired by the executors Santo Lo Grande and Peter David Fraser to send particulars of their claim\nto Zafra Legal of Level 10, 105 St Georges Terrace, Perth WA 6000 and PO Box Z5250, Perth WA 6831\nby the date one (1) month from the publication date of this notice, after which date the executors may\nconvey or distribute the assets having regard only to the claims of which they then have notice.\n———————————\nZZ404\nTRUSTEES ACT 1962\nDECEASED ESTATES\nNotice to Creditors and Claimants\nCreditors and other persons having claims (to which Section 63 of the\nTrustees Act 1962 relates) in\nrespect of the estates of the undermentioned deceased persons are required by the\nExecutor/Administrator of these estates to send particulars of their claims to the\nExecutor/Administrator within one month from the date of publication of this Notice after which date\nthe Executor/Administrator may convey or distribute the assets having regard only to the claims of\nwhich the Executor/Administrator then has notice.\nPaul Lawrence Abbott late of 11 Krait Street, Exmouth, who died on 05/05/2024.\nKevin Richard Anderson late of 6 Stephen Street, Guildford, who died on or before 20/10/2023\nLee Anne Baker late of 20 Sanderson Road, Lesmurdie, who died on 21/03/2024.\nIan Bruce Douglas late of 31 Holilond Way, Morley, who died on 23/04/2024.\nGladys Noreen McInerney late of 29 Silica Road, Carine, who died on 07/12/2023.\nHAYNES LEEUWIN, Solicitors for the Executors / Administrators,\nSuite 2, 190 Main Street, Osborne Park WA 6017.
