They modernise terminology, align local rules with current Western Australian legislation, streamline enforcement, clarify penalties and procedures, and remove redundant provisions.\n\nThese changes affect residents, property and dog owners, businesses using public spaces, funeral attendees, and anyone using Shire facilities."},"flash_summary":{"complexity_score":7,"scope_assessment":{"changed":true,"description":"The package materially changes the scope of local regulation compared with the prior local laws. Examples: the Dogs local law removes entire Parts (Part 2 and Part 5) and reassigns confinement of dangerous dogs to the Dog Act and Regulations (Dogs cl. 3.1(3)), narrows the local law’s penalty and enforcement architecture while creating a new general penalty range (Dogs cl. 7.2A) and replacing the modified‑penalty schedule (Schedule 3). The Cemetery amendments add express CEO powers for vehicle control and expulsion and allow only assistance animals unless approved (Cemetery cls. 5.4–5.5, 8.1). The Fencing law replaces the Building Surveyor role with an ‘authorised person’, permits licences to transfer with land (Fencing cls. 4, 14), and conditions entry under the Local Government Act (Fencing cl. 16). Activities and Local Government Property amendments reframe many offences and set new modified penalties (Activities Schedule 1; Local Government Property Schedule 1). Who pays: individuals committing offences face updated modified penalties or court penalties (see Activities Schedule 1; Dogs cl. 7.2A; Local Government Property Schedule 1). Who decides: the CEO or authorised officers (expulsion, approval of animals, permit variations) and the local government (permit issuance, licence transfer) have broadened or clarified decision roles (Cemetery cls. 5.4–5.5; Fencing cls. 10, 14; Local Government Property cl. 3.6). Compliance burden and costs fall on permit‑holders, traders, dog owners and land occupiers through new/changed permit conditions, shorter or different compliance timeframes (e.g. Cemetery timing change), licence transfer consequences, and revised fines (see cited clauses and schedules)."},"complexity_factors":["Multiple separate local laws amended in one package (Cemeteries, Dogs, Activities on Thoroughfares and Public Places, Fencing, Local Government Property, plus a repeal) — cross-cutting effects across subject areas.","Frequent replacement/deletion/renumbering of clauses, schedules and forms (e.g. Dogs: Parts 2 and 5 deleted; Cemetery: Fourth Schedule deleted; multiple Schedules replaced) increasing mapping difficulty between old and new rules.","Substitution and alignment with external statutes and instruments (references to Dog Regulations 2013, Building Act 2011, Planning and Development Act 2005, Liquor Control Act 1988, National Measurement Act 1960, Disability Discrimination Act 1992) creating multi-instrument dependencies.","Changes in enforcement architecture and discretion (new CEO/authorised officer powers to expel, authorised person replacing Building Surveyor, transfer of licence with land) concentrate decision-making in local officers; see Cemetery clauses 5.4–5.5, Fencing clauses 4 and 14.","Re‑calibration of penalties and modified penalty schedules across instruments (new clause 7.2A in Dogs with $500–$5,000 range; revised Schedule 1 in Activities; new Local Government Property Schedule 1) affecting compliance costs.","Introduction of procedural references to higher‑level decision processes (application of Division 1 of Part 9 of the Act and regulation 33 to permit decisions — Activities clause 8.1; Local Government Property clause 7.1 changes).","Operational details that shift substantive duties (e.g. Dogs: confinement of dangerous dogs moved to Act/Regulations — Dogs clause 3.1(3); Cemetery: assistance-animal exception — Cemetery clause 8.1) require cross‑checking with other instruments.","Small but consequential textual edits (timing change from ‘twenty four hours’ to ‘two working days’; change in speed limit language; gender‑specific toilet entry rule) that alter rights/obligations in nuanced ways."],"plain_english_summary":"This instrument amends several Shire of Bruce Rock local laws (cemeteries, dogs, thoroughfares/public places, fencing, local government property) to update definitions, reallocate responsibilities, change permit and licence rules, and adjust offences/penalties.
