INTERPRETATION AND ADDITIONAL INFORMATION\n1.1. Wherever referred to in this Notice, unless the context requires otherwise—\n‘Firebreak’—the term firebreak includes a mineral earth firebreak.\n‘Mineral Earth Firebreak’ means a 3 metre wide area of the owner(s)/ occupier(s) land, cleared\nand maintained totally clear of all vegetation material (living or dead).\n‘Fire Management Plan’ means a comprehensive plan for the prevention and control of\nbushfires which may apply to individual land holdings. A notification, pursuant to the\nTransfer of Land Act 1893 (as amended) may be placed on the Certificate(s) of Title of the\n\n3250 GOVERNMENT GAZETTE, WA 13 September 2019\nland for medium to long term fire management to reduce the occurrence and minimise the\nimpact of uncontrolled bush fires, thereby reducing the threat to life, property and the\nenvironment.\n‘Hazardous and Flammable Materials’ means accumulated fuel including burn piles (living or\ndead) such as leaf litter, twigs, trash, bush, dead trees and scrub capable of carrying a\nrunning fire, but excludes standing living trees and isolated shrubs.\n‘Building protection Zone’ means a modified area of reduced fuel immediately surrounding a\nbuilding.\n‘Hazard Separation Zone’ means a modified area of reduced fuel load outside a Building\nProtection Zone to assist in reducing the fires intensity when flames are approaching\nbuildings. Both the Building Protection Zone and the Hazard Separation Zone are essential\nstrategies for the protection of buildings. A Hazard Separation Zone covers the area\n75 metres outside a Building Protection Zone.\nA Hazard Separation Zone should be modified to have a maximum fuel load of 6-8 tonne per\nhectare. This can be implemented by fuel reduction methods such as burning, mowing and\nslashing to remove the hazard and should not require the removal of living trees or shrubs.\n‘Parkland Clearing’ means all dead vegetation, dry grass (excluding approved crop or pasture\nareas and living trees/shrubs), piles of timber, disused materials and other vegetation,\nmaintained to a height of no greater than 10 centimetres\n2. BUILDING PROTECTION ZONES\n2.1. A Building Protection Zone shall be provided for buildings in bush fire prone areas. The\nsurroundings of buildings must comply with the following requirements—\n(a) The Building Protection Zone for existing buildings must be at least 20 metres from any\nexternal walls of the building unless varied under an approved Fire Management Plan.\n(b) The Building Protection Zone must be located within the boundary of the lot on which the\nbuilding is situated.\n(c) Hazardous/flammable materials must not exceed the maximum fuel load specified in\nparagraph 5, with grass areas not exceeding a height of no greater than 10 centimetres.\n(d) Fuel loads must be reduced and maintained at 2 tonne per hectare.\n(e) Isolated trees and shrubs may be retained however, the first 5 metres around all buildings\nmust be clear of all hazardous/flammable materials.\n(f) Reticulated gardens in the Building Protection Zone shall be maintained to a height no\ngreater than 500 millimetres.\n(g) Wood piles and fuel must be a minimum of 10 metres away from habitable dwellings.\n(h) Trees in the Building Protection Zone shall comply with the requirements of Section 3.\n(i) Where the land has an approved Fire Management Plan, compliance must be achieved in\naccordance with the Fire Management Plan.\n(j) A Hazard Separation Zone is recommended in the absence of a Fire Management Plan.\nNote: Building Protection Zones starve the fire by reducing the fuel levels around your house. These\nrequirements are designed to reduce the fire’s intensity and minimize the likelihood of flame contact\nwith buildings. The Building Protection Zone gives more protection to families should a fire threaten\nsuddenly and they cannot leave. It also provides extra protection for fire fighters and property owners\nwho may decide to stay with their property.\n3. TREES\n3.1. Tree branches must be removed or pruned to ensure a clear separation of at least 3 metres back\nfrom the eaves of all buildings and 5 metres above the top of the roof.\n3.2. Branches that may fall on the house must be removed.\n3.3. In a Building Protection Zone, the spacing of individual or groups of trees should be 15 metres\napart to provide for a 5 metre separation between tree crowns.\n3.4. A separation distance of at least 2.5 metres shall be maintained between trees and power lines so\nthey do not come into contact and start a fire or bring down a power line.\n3.5. Any overhanging trees and other vegetation must be pruned to a height of 5 metres above the\nground level of a mineral earth fire break.\n4. COMPLIANCE PERIOD\n4.1. Firebreaks and fuel hazard reduction on all Rural Residential, Urban and Industrial land which\nincludes Category 2, 6, 7 and 8 in Section 17, is to be completed by 16 November 2019 and must be\nmaintained compliant with this notice until 12 May 2020.\n4.2. The amendment narrows the legal duty in clause 2.2 from an absolute obligation to a reasonableness/reasonable practicability test by inserting \"Take all steps reasonably practical to\" and \"reasonably\" (clause 4). That changes who bears residual risk (shifts some enforcement judgment to the Shire) and reduces the scope of mandatory action where measures would be impracticable."},"complexity_factors":["Very narrow textual amendment (two short insertions to clause 2.2)","Introduces a “reasonable practicability” standard that is fact‑sensitive and open to interpretation","Increases enforcement discretion for the local government when assessing compliance (cl.4)","Requires cross‑reading with the principal local law (Shire of Augusta Margaret River Erosion and Sediment Control Local Law 2019) to determine practical effect","Modest compliance impact but potential for dispute over what steps are \"reasonably practical\""],"plain_english_summary":"This amendment (clause 4) inserts the words “Take all steps reasonably practical to” into clause 2.2(1)(d) and adds “reasonably” in clause 2.2(1)(e) of the Shire’s Erosion and Sediment Control Local Law. It affects landowners, builders and site operators bound by clause 2.2 by replacing an absolute duty with a “reasonable practicability” standard. Mechanically, that reduces the risk of strict liability for impossible measures, puts greater assessment discretion in the local government’s hands, and modestly changes compliance expectations (cl.4)."}},"importantCases":[],"_links":{"self":"/api/acts/shire-of-augusta-margaret-river-erosion-and-sediment-control-amendment-local-law-2019","history":"/api/acts/shire-of-augusta-margaret-river-erosion-and-sediment-control-amendment-local-law-2019/history","analysis":"/api/acts/shire-of-augusta-margaret-river-erosion-and-sediment-control-amendment-local-law-2019/analysis","conflicts":"/api/acts/shire-of-augusta-margaret-river-erosion-and-sediment-control-amendment-local-law-2019/conflicts","importantCases":"/api/acts/shire-of-augusta-margaret-river-erosion-and-sediment-control-amendment-local-law-2019/important-cases","documents":"/api/acts/shire-of-augusta-margaret-river-erosion-and-sediment-control-amendment-local-law-2019/documents"}}
