The Commissioner can mandate specific topics (like new laws) and approve training providers.\n- **Licensing**: Specifies that new agents must pass examinations from approved training providers (Advanced Diploma of Conveyancing).\n- **Trust accounts**: Strict rules about how client money must be held in designated trust accounts, including how accounts are named, when separate accounts are required (for amounts over $20,000 or transactions taking longer than 60 days), and how interest is calculated and paid to clients.\n- **Documentation**: Lists exactly which legal documents settlement agents are allowed to prepare—such as contracts for sale, requisitions on title, and various land registration documents under the Transfer of Land Act, Strata Titles Act, and Community Titles Act.\n- **Record keeping**: Requires agents to keep detailed records of all money received and CPD activities for at least 4-6 years.\n- **Enforcement**: Allows infringement notices (on-the-spot fines) for certain offences rather than going to court.\n\n**Who it affects:**\n- Settlement agents in Western Australia (both real estate and business settlement agents)\n- People applying for settlement agent licences\n- Approved training providers who deliver CPD courses\n- The Commissioner for Consumer Protection who regulates the industry\n\n**Why it matters:**\nSettlement agents handle large sums of client money and important legal documents. These regulations protect consumers by ensuring agents are properly qualified, keep learning throughout their careers, handle money safely in trust accounts, and only perform work they're legally permitted to do. The rules help prevent fraud, incompetence, and financial loss in property transactions."}},"importantCases":[],"_links":{"self":"/api/acts/settlement-agents-regulations-1982","history":"/api/acts/settlement-agents-regulations-1982/history","analysis":"/api/acts/settlement-agents-regulations-1982/analysis","conflicts":"/api/acts/settlement-agents-regulations-1982/conflicts","importantCases":"/api/acts/settlement-agents-regulations-1982/important-cases","documents":"/api/acts/settlement-agents-regulations-1982/documents"}}
