The 2009 amendments in particular broadened the scope from traditional petroleum storage to a wider energy and chemical processing hub, while the 2019 amendment updated the gas definition to reference modern safety legislation. It does four main things:\n\n- **Takes back land** from the City of Hobart and cemetery trustees (Section 2): It strips ownership of specific parcels of land (marked in red on a survey plan) from the Hobart City Council and the Hobart Public Cemetery trustees, returning them to Crown (government) ownership. The former owners get compensated for any buildings or improvements they made.\n\n- **Allows land reclamation** from the River Derwent (Section 3): The Governor can reclaim land from the river (marked green on the plan) and extinguish public rights like fishing and navigation over that area. When this happens, the City of Hobart's boundary extends to the new shoreline.\n\n- **Restricts how the land can be used** (Section 4): The land can only be used for specific industrial purposes—primarily storage, manufacturing, and packaging of fuels, gas, chemicals, and oil (including alternative fuels), plus infrastructure like roads, railways, sewers, and port facilities operated by the Tasmanian Ports Corporation.\n\n- **Provides funding and infrastructure** (Sections 6–9): It authorises borrowing money to pay for compensation, reclamation works, and preparation of the site; requires the Transport Commission to build a railway line into the area when asked; and requires the Hobart City Council to provide water and sewerage services.\n\n**Who it affects:**\n- The Tasmanian Government (which gains control of the land)\n- The City of Hobart (loses some land but gains infrastructure obligations)\n- Hobart Public Cemetery trustees (lose land)\n- Industrial operators seeking to use the site for fuel/chemical storage and processing\n- The Tasmanian Ports Corporation (which operates wharves there)\n\n**Why it matters:**\nThis Act created the legal framework for a major industrial hub on Hobart's waterfront. Originally focused on oil and fuel storage, it has been updated over time to include alternative fuels and gas infrastructure, reflecting changing energy needs. It remains significant for Tasmania's energy security and industrial land management."},"flash_summary":{"complexity_score":6,"scope_assessment":{"changed":true,"description":"The Act's operational scope has been altered by later amendments. Notably, s4(1) was expanded to permit storage, manufacture and packaging of alternative fuels, gas, industrial chemicals and oil and associated infrastructure, and s4(1)(d) added port/wharf uses (amendments cited in the text). Definitions in s4(3) were inserted/updated to cover 'alternative fuel', 'gas' and related terms.
