Any heading inserted in an Act which was passed before 1 January 2001, by an Act passed on or after 1 January 2001, forms part of that Act. This includes headings to Parts, Divisions or Subdivisions in a Schedule; sections; clauses; items; tables; columns; examples; diagrams; notes or forms. See section 36(3A).\n\n• Punctuation\n\nAll punctuation included in an Act which is passed on or after 1 January 2001 forms part of that Act. Any punctuation inserted in an Act which was passed before 1 January 2001, by an Act passed on or after 1 January 2001, forms part of that Act. See section 36(3B).\n\n• Provision numbers\n\nAll provision numbers included in an Act form part of that Act, whether inserted in the Act before, on or after 1 January 2001. Provision numbers include section numbers, subsection numbers, paragraphs and subparagraphs. See section 36(3C).\n\n• Location of \"legislative items\"\n\nA \"legislative item\" is a penalty, an example or a note. As from 13 October 2004, a legislative item relating to a provision of an Act is taken to be at the foot of that provision even if it is preceded or followed by another legislative item that relates to that provision. For example, if a penalty at the foot of a provision is followed by a note, both of these legislative items will be regarded as being at the foot of that provision. See section 36B.\n\n• Other material\n\nAny explanatory memorandum, table of provisions, endnotes, index and other material printed after the Endnotes does not form part of an Act. \nSee section 36(3)(3D)(3E).\n\n2 Table of Amendments\n\nThis publication incorporates amendments made to the **Sale of Land Act 1962** by Acts and subordinate instruments.\n\n–––––––––––––––––––––––––––––––––––––––––––––––––––––––––––––\n\n**Sale of Land (Amendment) Act 1963, No. 7052/1963**\n\n| Assent Date: | 26.11.63 |\n| Commencement Date: | 26.11.63 |\n\n**Public Lands and Works Act 1964, No. 7228/1964**\n\n| Assent Date: | 15.12.64 |\n| Commencement Date: | 15.3.65: Government Gazette 11.3.65 p. 557 |\n\n**Sale of Land Act 1965, No. 7272/1965**\n\n| Assent Date: | 1.6.65 |\n| Commencement Date: | 1.9.65: Government Gazette 21.7.65 p. 2314 |\n\n**Statute Law Revision Act 1965, No. 7332/1965**\n\n| Assent Date: | 14.12.65 |\n| Commencement Date: | 14.12.65 |\n\n**Sale of Land (Amendment) Act 1969, No. 7898/1969**\n\n| Assent Date: | 9.12.69 |\n| Commencement Date: | 1.3.70: Government Gazette 19.12.69 p. 4134 |\n\n**Local Government (Further Amendment) Act 1971, No. 8149/1971**\n\n| Assent Date: | 4.5.71 |\n| Commencement Date: | S. 25(1) on 1.10.72: Government Gazette 27.9.72<br>p. 3198 |\n\n**Cluster Titles Act 1974, No. 8661/1974**\n\n| Assent Date: | 20.12.74 |\n| Commencement Date: | Ss 40, 41 on 15.8.75: Government Gazette 13.8.75<br>p. 2926; It sets out rules to make property transactions fairer and more transparent.\n\n**Key protections for buyers:**\n\n- **Cooling-off period**: Buyers can cancel most residential land contracts within 3 business days of signing, losing only a small fee ($100 or 0.2% of price)\n- **Section 32 statement**: Sellers must provide detailed information about the property *before* the buyer signs — including mortgages, rates, planning restrictions, building permits, insurance, and whether services like water and electricity are connected\n- **Due diligence checklist**: Sellers must make available a checklist to help buyers research the property\n- **Insurance protection**: If a house is destroyed before settlement, buyers can cancel the contract and get their money back\n\n**Rules for \"off-the-plan\" sales** (buying property not yet built):\n\n- Deposits capped at 10% and must be held in trust until the plan is registered\n- Sellers cannot automatically cancel contracts using \"sunset clauses\" — they need buyer consent or a court order\n- Buyers must be warned that property values may change before settlement\n\n**Bans on risky arrangements:**\n\n- **Terms contracts** (where buyers pay in instalments before getting title) are heavily restricted for residential properties under a price threshold\n- **Rent-to-buy schemes** are prohibited for residential land\n- **Land banking schemes** (options to buy into developments) must hold money in trust and expire after 5 years if the development doesn't proceed\n\n**Auction rules:**\n\n- Fake bids (\"dummy bidding\") by sellers are illegal\n- Auctioneers must identify \"vendor bids\" clearly\n- Auction conditions must be available before bidding starts\n\n**Deposit protections:**\n\n- Deposits must be held by lawyers, conveyancers, or licensed estate agents as \"stakeholders\" (neutral holders) until settlement\n- Special rules apply if the seller still owes money on a mortgage\n\n**Who it affects:**\n\nAnyone buying or selling land in Victoria — residential, commercial, or rural. The law particularly protects everyday homebuyers from unfair practices by developers and sellers.\n\n**Why it matters:**\n\nThis law prevents sellers from exploiting information advantages, stops developers from taking deposits on projects that may never be completed, and gives buyers time to reconsider purchases without losing significant money."},"summary":{"complexity_score":1,"scope_assessment":{"changed":false,"description":"Scope cannot be assessed as the substantive content of the legislation was not provided.
