millimetres above or below any other point on that surface; and\n\t(iv)\tmust operate within the appropriate limits of error for that type of weighbridge that may be tolerated under the National Measurement Act 1960 of the Commonwealth; and\n\t(b)\tin order to determine the mass of a vehicle with or without its load and the mass carried on any 2 or more axles of a vehicle on a weighbridge, it is not necessary to measure the mass carried on all the relevant axles simultaneously, but the mass may be determined by aggregating the measurements of mass taken separately in relation to the axles in question, provided that in determining the mass carried on a vehicle having an axle group or axle groups, the axles within each group must be measured as a whole; and\n\t(c)\twhen an approved instrument for determining mass is used in order to determine the mass of a vehicle with or without its load and the mass carried on any 2 or more axles of a vehicle, the mass may be determined by aggregating the measurements of mass taken simultaneously or separately in relation to the axles in question, provided that, in determining the mass carried on individual axles of an axle group, all Act)\n\nForm 3—Prescribed oral advice\n(Section 47EAA(10)(b) of Act)\n\nForm 4—Prescribed oral advice and written notice\n(Section 47K(2a)(a) of Act)\nPart A—Oral advice for the purposes of section 47K(2a)(a) of Road Traffic Act 1961\nThe breathalyser reading just taken shows that you had a prohibited level of alcohol in your blood.\nTherefore, it appears that you have committed an offence against section 47B(1) or (1a) of the Road Traffic Act 1961.\nIn any court proceedings for an offence against section 47B(1) or (1a), or for an offence against section 47 of the Road Traffic Act (driving under the influence of liquor), it will be presumed that the breathalyser accurately indicated your blood alcohol level at the time of the reading and for the preceding 3 hours. However, the Road Traffic Act allows for contrary evidence based on the results of a blood test.\nIf you want to have such a blood test you will have to make your own arrangements and follow certain procedures, using a special blood test kit. This blood test kit will be supplied to you on your signing a written request.\nIf you obtain a blood test kit and want to have your blood tested, you should take the kit promptly to a hospital, medical practitioner or registered nurse in order to have a sample of your blood taken.\nYou must not consume any more alcohol before having a sample of your blood taken and must not open the blood test kit before delivering it to a medical practitioner or registered nurse.\nUnder the blood test procedure, the sample of blood is divided and sealed in two containers. You will have to sign a form that will be given to you by the medical practitioner or registered nurse.\nOne of the sealed containers will be given to you and you may make your own arrangements to have the blood in that container analysed.\nIn any event, the blood in the other container will be analysed by Forensic Science SA and you will be given written notice of the results of the analysis.\nFurther information as to these matters is contained in the written notice which will be delivered to you shortly.\nPart B—Written notice for the purposes of section 47K(2a)(a) of Road Traffic Act 1961\nOperation of Road Traffic Act in relation to results of breath analysis\n1 Offence\nSection 47B(1) of the Road Traffic Act 1961 provides that a person commits an offence if the person drives a motor vehicle, or attempts to put a motor vehicle in motion, while there is present in the person's blood the prescribed concentration of alcohol (as defined in section 47A of the Act). Section 47B(1a) provides that if a person engages in conduct involving a motor vehicle that constitutes an offence against section 47B(1) (other than a category 1 offence) while a child under the age of 16 years is present in or on that motor vehicle, the person commits an offence against section 47B(1a) and is liable to the same penalty as is prescribed for an offence against section 47B(1).\n2 Breath analysis\nYour breath has just been analysed by means of a breath analysing instrument which indicated that the prescribed concentration of alcohol was present in your blood. Accordingly, it appears that you have committed an offence described above.\n3 Legal effect of breath analysis result\nIn proceedings for an offence described above or an offence against section 47(1) of the Road Traffic Act 1961 (driving under the influence of liquor), the result of the breath analysis will be presumed to accurately record the concentration of alcohol in your blood at the time of the analysis and throughout the preceding 3 hours (section 47K(1), (1ab)).\nIn any proceedings against you for such an offence, you will be able to challenge the accuracy of the breath analysis reading if—\n\t•\tyou have a sample of your blood taken and analysed as described below; AND\n\t•\tthe result of analysis of the blood sample shows that the breath analysing instrument gave an exaggerated reading of the concentration of alcohol present in your blood (section 47K(1a)).\nProcedures for optional blood test\n\nYou may have a sample of your blood taken and analysed if you wish.\nFor that purpose, you must request the breath analysis operator to supply you with an approved blood test kit (you must sign a written request form for the kit and should retain a copy of the signed request form).\nYou should then proceed promptly to a hospital, medical practitioner or registered nurse of your choice and request that a sample of your blood be taken (using the blood test kit).\nDo not consume any further alcohol before the sample is taken.\nDo not open the blood test kit.\nThe medical practitioner or registered nurse taking the sample of your blood will divide it and place it into two containers and seal the containers. One container will be delivered to you—do not break the seal on this container.\nSign the form presented to you by the medical practitioner or registered nurse—the original of the form will be given to you which you should retain.\nYou may, if you wish, have the blood sample (in the container delivered to you) analysed at a laboratory to determine the concentration of alcohol present in the blood.\nThe other blood sample container will, in any event, be sent to Forensic Science SA where the blood will be analysed. The results of this analysis will be sent to you at your address (as indicated on the form presented to you by the medical practitioner or registered nurse who took the blood sample).\nForm 5—Request\n(Section 47K(2a)(b) of Act)\n\nForm 6—Certificate\n(Section 47K(1a) of Act and regulation 22)\nPart A—Blood test for alcohol (Certificate of medical practitioner or registered nurse)\nThe certificate signed by the medical practitioner or registered nurse that accompanies a sample of blood pursuant to section 47K of the Act must include the following information:\n\t(a)\tthe name of the medical practitioner or registered nurse who took the sample;\n\t(b)\tthe place at which the sample was taken (the name of the hospital/surgery/medical institution);\n\t(c)\tthe time at which the sample was taken;\n\t(d)\tthe date on which the sample was taken;\n\t(e)\tthe name and address of the patient from whom the sample was taken;\n\t(f)\tthe identifying number for the sample;\n\t(g)\tthe signature of the medical practitioner or registered nurse who took the sample.\nThe following statement must be included on the certificate immediately above the signature block of the medical practitioner or registered nurse:\nI placed the sample of blood, in approximately equal portions, in 2 containers (being the containers provided as part of the blood test kit that was delivered to me by the patient) and secured the caps. I then sealed each container by application of adhesive seal (bearing the identifying number specified below) provided as part of the blood test kit. I delivered 1 of the sealed containers containing part of the blood sample by giving the container to the patient. I witnessed the patient's signature.\nPart B—Patient's container \nPatient's container\nOn receipt of the sealed container of blood (being 1 of the 2 containers provided as part of the blood test kit that was delivered to a medical practitioner or registered nurse who takes the patient's blood sample) the patient must mark their signature to acknowledge receipt of the sealed container containing part of the blood sample.\nPart C—Police container \nPolice container\nThe medical practitioner or registered nurse who took a sample of blood pursuant to section 47K of the Act must—\n\t(a)\tindicate that they delivered 1 of the sealed containers containing part of the blood sample to a police officer or an approved courier by—\n\t(i)\tplacing the container in a secured blood box (include blood box number); or\n\t(ii)\tgiving the container to a police officer or an approved courier; and\n\t(b)\tmark their signature to acknowledge that they have provided the sealed container containing part of the blood sample to a police officer or an approved courier.\nThis form may be combined with a form required for the purposes of section 73(2) of the Harbors and Navigation Act 1993 and section 20(2) of the Rail Safety National Law (South Australia) Act 2012.\nForm 7—Notice\nRoad Traffic Act 1961, Notice under section 79B(5) & (6)\nEntitlement to view photographic evidence\nYou are entitled to see the photographic evidence.\nA copy of the photographic evidence on which the allegation is based:\n\t•\twill, on written application to the Commissioner of Police at the Expiation Notice Branch [insert address], be sent by post to you at the address nominated by you in the written application or, in the absence of such a nomination, to your last known address; and\n\t•\tmay be viewed—\n\t•\tonline by following the instructions available at [insert website]; or\n\t•\tby telephoning the Expiation Notice Branch on [insert phone number] and making an appointment.\nStatutory Declarations\nThe Commissioner of Police will, in relation to the question of withdrawal of the expiation notice, reminder notice or information, give due consideration to any exculpatory evidence (ie evidence indicating that you have a defence under the relevant legislation or are otherwise not liable for the offence) that is verified by statutory declaration. A statutory declaration must be furnished to the Commissioner before the due date for payment specified in the enclosed expiation notice or expiation reminder notice or, if the enclosed document is a summons, within 28 days after the date of issue of the summons.\nYou must provide the following information in the statutory declaration:\n\t•\tyour full name and address; and\n\t•\texpiation notice number (where relevant); and\n\t•\tmotor vehicle registration number; and\n\t•\tdetails of the defence or other exculpatory circumstances (in keeping with the requirements of the relevant legislation).\nIf the allegation of an offence against section 79B of the Act, or an allegation of a speeding or reckless or dangerous driving offence, is based on evidence of the average speed of the vehicle between 2 locations you would need to provide this information in relation to each person who drove the vehicle during that time (if there was more than 1) and in the case of an offence against section 79B of the Act state whether or not you were 1 of those persons.\nIf, for example, you sold the vehicle before the commission of the alleged offence you would need to provide details of that sale including the date on which it occurred and the name and address of the purchaser. \nThe statutory declaration must be witnessed by one of the following:\n\t•\tJustice of the Peace (including ID No.)\n\t•\tProclaimed Police Officer\n\t•\tCommissioner for taking affidavits\n\t•\tany other person before whom a statutory declaration may be made under the Oaths Act 1936.\nNOTE: It is an offence to make a statutory declaration that you know to be untrue in a material particular. It likely bundles varied technical and administrative road-traffic matters—such as vehicle standards, licensing conditions, fees or specific road‑use rules—affecting drivers, vehicle owners, and road authorities across SA.\n\nIt matters because it fills gaps left by primary legislation, setting day‑to‑day regulatory requirements and enforcement details that directly influence compliance and road safety."},"kimi_summary":{"_metrics":{"completionTokens":868},"content_quality":"ok","complexity_score":9,"scope_assessment":{"changed":true,"description":"The legislation has expanded significantly beyond its original 'miscellaneous' scope. While initially supplementary to the Road Traffic Act, it now encompasses: (1) comprehensive technical regulation of enforcement technology (speed cameras, phone detection cameras, average speed systems); (2) detailed vehicle modification and safety standards that overlap with other regulatory schemes; (3) heavy vehicle fatigue management integration with national law; (4) personal mobility device regulation (e-scooters); and (5) extensive fee-setting and expiation frameworks. They cover a vast range of practical driving and vehicle matters:\n\n**What this legislation does:**\n\n- **Traffic control and roadworks** — Sets rules for temporary speed limits at work sites, permits for roadworks, and how emergency services can manage traffic during incidents.\n\n- **Drink and drug driving enforcement** — Specifies exactly how breath tests and drug tests must be conducted, which devices are approved (like specific breathalysers and drug testing kits), and the procedures for blood tests if drivers want to challenge results.\n\n- **Speed cameras and detection devices** — In extraordinary detail, prescribes how speed cameras, red light cameras, average speed cameras, heavy vehicle monitoring cameras (Safe-T-Cam), and mobile phone detection cameras must be installed, tested, and operated to produce valid evidence.\n\n- **Vehicle safety standards** — Covers seat belts, child restraints, helmets for motorbikes and bicycles, and rules against unsafe vehicle modifications (like engine swaps that overpower brakes, or dodgy wheel and tyre setups).\n\n- **Heavy vehicle monitoring** — Special rules for trucks and buses, including the Central Inspection Authority for bus safety, and average speed enforcement between camera points.\n\n- **Administrative processes** — Forms for licence disqualification notices, warrants for enforcement officers, and detailed fee schedules for vehicle inspections and permits.\n\n- **Expiation (on-the-spot fines)** — Comprehensive tables of fines for hundreds of offences, from speeding to parking violations to unsafe bicycle riding.\n\n**Who it affects:**\nEvery road user in South Australia — drivers, motorcyclists, cyclists, pedestrians, vehicle owners, mechanics, roadwork contractors, event organisers, and transport operators. Also affects businesses like courier companies and heavy vehicle operators.\n\n**Why it matters:**\nThese regulations translate broad legal principles from the Road Traffic Act into specific, enforceable rules. They ensure consistency in how traffic laws are applied, guarantee that enforcement technology produces reliable evidence, set vehicle safety baselines, and create a transparent penalty structure so people know the consequences of violations."},"flash_summary_failed":{"failed":true,"reason":"A positive credit balance is required for all requests, including BYOK, so fallback providers remain available.
