Provision numbers include regulation numbers, rule numbers, subregulation numbers, subrule numbers, paragraphs and subparagraphs. See section 36(3C).\n\n• Location of \"legislative items\"\n\nA \"legislative item\" is a penalty, an example or a note. As from 13 October 2004, a legislative item relating to a provision of a Statutory Rule is taken to be at the foot of that provision even if it is preceded or followed by another legislative item that relates to that provision. For example, if a penalty at the foot of a provision is followed by a note, both of these legislative items will be regarded as being at the foot of that provision. See section 36B.\n\n• Other material\n\nAny explanatory memorandum, table of provisions, endnotes, index and other material printed after the Endnotes does not form part of a Statutory Rule. See section 36(3)(3D)(3E).\n\n2 Table of Amendments\n\nThis publication incorporates amendments made to the Road Safety (General) Regulations 2019 by statutory rules, subordinate instruments and Acts.\n\nRoad Safety (General) Amendment Regulations 2019, S.R. Key provisions include device lists, calibration and sealing rules, and the required form and contents of certificates, notices and infringement documents (see regs 10–30, 31–54, 59–64, schs 2–5).\n\n- Prescribes which camera and detector systems are “prescribed” for automated enforcement, how average‑speed processing must be performed by a computer, and how digital files are verified before printing (regs 32–33, 47).\n\n- Regulates temporary/relocatable camera systems and no‑truck‑zone (NTZ) cameras, including how images are stored and destroyed when no offence is found and limited retention for testing/contractor monitoring (regs 40A–40D, 40E–40F).\n\n- Lists specific traffic and parking offences that can be enforced by infringement notices and sets the default infringement penalties and notice content (Part 6–7, Schedules 6–7). It also adds and defines offences related to electric scooters and portable/wearable devices (reg 69A, reg 31 and sch 7 entries).\n\n- Prescribes procedures for taking and handling biological samples (breath, blood, oral fluid, urine), including device models authorised, sampling safeguards, labels, chain‑of‑custody steps, and the content of analyst/medical certificates (regs 10–30).\n\n- Sets out rules for vehicle impoundment/immobilisation notices, evidentiary forms for search warrants and execution reports, and what evidence is accepted to recover an impounded vehicle (Part 4, regs 55–58, schs 4–5).\n\n- Identifies who may prosecute or utilise Act powers on public land and where fines are to be appropriated (Part 9, regs 77–80, sch 8). It also prescribes certain fees to be paid into the Roads Fund (reg 81).\n\n**Who it affects**\n\n- Individual road users (drivers, riders, pedestrians, electric scooter users) who may receive traffic or parking infringement notices (Part 7, schs 6–7).\n\n- Heavy vehicle operators and drivers: specific heavy‑vehicle speed, mass and no‑truck‑zone rules and penalties (sch 7 heavy vehicle items, regs 51A–51B, sch 7 item 16A).\n\n- Police and authorised officers who collect samples, operate devices, issue notices, seal and test equipment, execute warrants and make decisions about impoundment (multiple procedural regs across Parts 2–5).\n\n- Testing officers, approved analysts and approved experts (defined at reg 5 and referred to in regs 35–39, 20–25, 28–30), plus private testing facilities accredited by NATA if used (reg 5 definitions).\n\n- Manufacturers, suppliers and contractors of camera and speed detection systems (prescribed device lists in reg 32 and reg 41) and contractors providing administrative services under the Fines Reform Act (reg 40C(1)(b)).\n\n- Public authorities and municipal councils that may prosecute parking offences or receive appropriated fines (Part 9, sch 8).\n\n**Why it matters (practical consequences and mechanisms)**\n\n- Evidentiary standardisation: The Regulations make the pathway from device capture to admissible printed evidence explicit (digital file checksum verification, reg 47), which affects how automated enforcement results are relied on in courts or in operator‑onus proceedings (reg 31, s.66 of the Act).\n\n- Compliance and operational costs: Operators and contractors must test, calibrate and seal devices at prescribed intervals (regs 35–43, 60–64) and keep records for long retention periods (7 years for many test records, reg 50). That imposes ongoing administrative and technical costs on agencies and any third‑party service providers.\n\n- Data handling and privacy trade‑offs: Relocatable cameras are required to destroy images where no offence is detected within tight timeframes (24 hours for non‑offending images; longer limited retention periods for testing/contractor monitoring—regs 40B–40C). The rules balance short retention against specified operational exceptions (testing and contractor monitoring), and set explicit retention/destruction triggers rather than leaving them to general policy.\n\n- Shifts in enforcement scope: The instrument expressly adds new camera/detector types and offence categories (e.g., seatbelt, portable device offences as camera‑detected operator‑onus offences at reg 31(e)–(h); electric scooter offences at reg 69A). That expands automated enforcement into behaviours not previously covered by camera detection and affects who receives operator‑onus notices.\n\n- Incentives and allocation of proceeds: Schedule 8 prescribes which funds or authorities receive appropriated fines. This determines who benefits from penalties (reg 79, sch 8) and the practical incentives for different public authorities to enforce on their land (reg 79(2)).\n\n**Implementation risks, compliance burdens and decision points**\n\n- Technical dependency: The regime relies on specific device models and software procedures being correctly configured, tested and sealed (regs 32, 41, 35–39, 52–54). Failure in calibration or sealing procedures can affect prosecutions because the Regulations create strict procedural preconditions for admissibility (regs 35–37, 42–46, 51).\n\n- Administrative burden: Officers must follow detailed chain‑of‑custody, labelling and storage requirements for biological samples and digital evidence (regs 14, 18, 27, 50). Record retention periods (generally 7 years) and labelled containers create both workload and cost for police and laboratories.\n\n- Contractor oversight and monitoring: The Regulations permit storing images up to 6 months for testing or to monitor contractor performance under an administrative services agreement (reg 40C). The mechanism allows outsourced camera operations but requires supervisory data handling controls and creates a point of operational concentration (contractors handling image data).\n\n- Behavioural effects and substitution: Adding camera‑detectable operator‑onus offences (seatbelt, portable device, wearable device) and electric‑scooter offence lists (regs 31, 69A, sch 7) shifts enforcement toward automated detection. This may change the mix of enforcement activity (more camera use, fewer on‑road stops) and could lead to substitution of enforcement resources.\n\n**Who pays, who decides, what changes in behaviour are expected**\n\n- Who pays: Individuals who commit infringement offences face penalty units set out in Schedules 6 and 7; municipal councils and prescribed public authorities bear the operational costs of enforcement on their land unless otherwise resourced; contractors and testing providers bear compliance costs to meet calibration, sealing and record‑keeping obligations (regs 50, 60–64, schs 6–7, sch 8).\n\n- Who decides: Testing officers and authorised persons make technical certification decisions (regs 35–39, 51), senior police officers may issue suspension or disqualification notices under prescribed criteria (regs 9–9A), and the Secretary/Regulator may authorise testing of portable weighing devices (reg 60(5)).\n\n- Behaviour change: The combination of automated detection rules, specified devices, and clear notice and objection timelines (reg 71, regs 75–76) changes enforcement from discretionary, on‑the‑spot policing to rules that enable operator‑onus and computer‑processed evidence to produce notices and convictions unless disputed.\n\n**Source‑grounded purpose statements and trade‑offs**\n\n- The stated objectives (reg 1) are to prescribe devices, processes and evidentiary particulars for detecting alcohol/drugs, speed, mass and other traffic offences and to fix penalties and notice requirements. Mechanically, the Regulations do that by naming device models, setting calibration/sealing procedures, and defining notice content and retention rules.\n\n- Trade‑offs visible in the text: tighter technical and documentary standards improve the defensibility of automated evidence in court (reg 47, regs 35–39), but increase operational, procurement and compliance costs for enforcement agencies and contractors (regs 50, 60, schs 2–3). The rules also permit some contractor access to images for monitoring/testing (reg 40C) but time‑limit that access to contain privacy exposure (regs 40B–40C).\n\nPrimary references: regs 1, 5, 10–30, 31–54, 59–64, 71, 75–76, 40A–40D, 51A–51B, schs 2–5, 6–8."},"kimi_summary":{"_metrics":{"completionTokens":730},"content_quality":"ok","complexity_score":8,"scope_assessment":{"changed":true,"description":"The regulations have expanded significantly beyond their original 2019 scope.
