The new entity is the Resources Safety and Health Queensland Board (the board). (See Part 8: new Part 4, sections 48–63; transitional sections 72–83.)\n\n- Recasts who gives and receives safety-advice: the coal and mining safety advisory committees are required to give advice to the Minister and/or the RSHQ board (amendments to the Coal Mining Safety and Health Act 1999 and the Mining and Quarrying Safety and Health Act 1999—see amendments to s 76 and s 67 respectively). The chairpersons of those committees must be a member of the RSHQ board (new chair appointment rules—Coal s 78(2); Mining s 69(2)).\n\n- Changes the appointment, reporting lines and powers of the CEO (chief executive officer) of RSHQ: the CEO is appointed by Governor in Council on the Minister’s recommendation (new s 14(1A)), but the board may nominate a suitable candidate for the Minister’s consideration (new s 27A). The CEO must implement board policy when performing functions, report regularly to the board, and retain independence on certain disclosure decisions (new ss 24A, 27A, and related provisions).\n\n- Transfers numerous formal functions, records, assets, contracts and ongoing legal matters from the abolished Commissioner to the board and provides transitional arrangements to preserve continuity. (See Part 8 transitional provisions, ss 74–83.)\n\n- Integrates and adjusts the Land Access Ombudsman and Coexistence Queensland arrangements: the land access ombudsman is the CEO of Coexistence Queensland; an Advisory Council is created (made up of Coexistence Queensland members) to monitor the ombudsman’s independence, advise on budgets, procedures and funding, and assist the Minister on funding matters. Delegation, secrecy and liability rules are updated to allow use of officers and contractors with limited delegation for giving formal reasons. (See Part 4: Land Access Ombudsman Act amendments, new ss 9–12 and new Part 2A, ss 31A–31G, and delegation/ liability ss 61–62.)\n\n- Modernises administrative processes in the Mineral Resources Act 1989: replaces several \"continuation while renewal pending\" sections (so resource titles continue in force while renewal applications are decided), sets specific renewal-application windows (e.g. 6 months for exploration permits, 1 year for mineral development licences and mining leases), and replaces multiple references to \"maps\" with \"spatial data\" to reflect digital land information. (See replacements of ss 93A, 147C, 197C, 286C and multiple amendments replacing \"map\" with \"spatial data\".)\n\n- Makes corresponding technical changes across related legislation (e.g. evidentiary aids, proof of appointment/signature references changed from \"commissioner\" to the RSHQ board; removal and appointment provisions updated; amendments to the Mineral and Energy Resources and Other Legislation Amendment Act 2024). (See multiple cross‑references in Parts 2, 5, 6 and 7.)\n\n**Who is affected**\n\n- The regulator: the Office of the Commissioner is abolished and replaced by a board plus a CEO-led employing office (Part 8 transitional provisions, ss 74–76).\n\n- The board and CEO: the board gains strategy, policy, oversight and nomination powers (new ss 49–50); the CEO gains a statutory relationship to the board (new s 24A) and is appointed/removed under the new process (ss 14, 19).\n\n- Advisory committees: coal and mining safety advisory committees now report to Minister and/or the board; their chairpersons are to be members of the RSHQ board (Coal s 76; Mining s 67).\n\n- Resource title holders (miners, explorers, leaseholders): renewal application timing and continuation protections are changed (Mineral Resources Act replacements at ss 93A, 147C, 197C, 286C). That changes when title‑holders must lodge renewals and reduces the risk of an unintended lapse while a renewal is pending.\n\n- Landholders, resource companies and users of the land access dispute process: the land access ombudsman role is clarified (CEO of Coexistence Queensland), an advisory council will monitor independence and advise on budgets and procedures, delegation to contractors is expanded (but giving formal reasons cannot be delegated). (Land Access Ombudsman Act, new Part 2A and ss 61–62.)\n\n- Government agencies and local government: notice, publication and mapping requirements are shifted to use spatial data, and organisations holding planning scheme spatial data must tag it with mining‑tenement notes (Mineral Resources Act amendments, s 4B and multiple spatial-data replacements).\n\n**Why it matters (official purpose-claims and an operational test)**\n\n- The stated/obvious purpose-claims: the Bill restructures governance of resource safety regulation (moving from a single statutory Commissioner to a board model), clarifies CEO and board relationships, integrates and strengthens the land access ombudsman arrangements with Coexistence Queensland and its advisory council, modernises administrative processes around tenure renewals, and replaces paper maps with digital spatial data. (See Part 8 long title and new board provisions, Part 4 Land Access Ombudsman changes, Part 6 Mineral Resources changes.)\n\n- Testing those claims against costs and trade-offs:\n  - Concentrated beneficiaries: resource title-holders get clearer protection against unintended lapses (continuation while renewal pending) and predictable renewal windows (ss 93A, 147C, 197C, 286C). That reduces legal and commercial disruption for applicants.\n  - Diffuse costs and implementation burden: converting from a Commissioner model to a board model requires transferring assets, liabilities, records and contracts (transitional ss 75–81), updating corporate governance, and likely IT work to produce and link spatial data. Departments and agencies must implement new appointment, reporting and record-keeping workflows.\n  - Incentives and decision‑rights: the Minister retains strong influence—recommendations to Governor in Council for appointments and removals (new ss 14(1A), 19, 39), while the board gains policy and oversight powers and can nominate CEO candidates (s 27A). That shifts some selection influence to the board but leaves ultimate appointment and removal in the Minister/Governor‑in‑Council sphere. Concrete effect: who decides is split—Minister recommends and may remove; board sets strategy and nominates; CEO runs operations and must implement board policy (new ss 49; 24A; 27A; 14(1A); 19).\n  - Delegation and outsourcing: the Land Access Ombudsman may delegate to officers and contractors (new s 61) but cannot delegate giving of advice, recommendations or reasons under s 51(6)(b). This permits using external contractors for operational tasks but preserves an in‑house decision and reasoning core—reducing cost but raising contractor‑management risks.\n  - Risk of politicisation versus collective oversight: replacing a single Commissioner with a board spreads governance across multiple members with defined skills (s 51(2)), which can increase expertise and oversight. At the same time, appointment and removal powers in Minister/Governor hands create a mechanism for political influence over appointments and removals (s 51, s 19, s 39). The Bill addresses continuity by explicit transitional clauses (ss 72–83) to reduce legal uncertainty during the changeover.\n  - Data and operational modernisation: swapping \"map\" for \"spatial data\" across multiple statutes standardises digital land information and obliges certain bodies to tag spatial data (s 4B), improving interoperability but imposing digitisation and metadata maintenance costs.\n\n**Who pays, who decides, what behaviour is likely to change**\n\n- Who pays: the State (through the Minister’s budget process) funds RSHQ and Coexistence Queensland. The advisory council explicitly advises the Minister on funding of the land access ombudsman’s functions (Land Access Ombudsman Act new s 31B(c)); RSHQ must publish statements of expectations and report actions (new s 28 amendments and s 63). Title-holders pay transaction/renewal costs earlier because renewal windows are specified (Mineral Resources Act amendments).\n\n- Who decides: the Minister recommends appointments and removals to Governor in Council (new ss 14(1A), 19, 39). The board sets strategy and policies (new ss 49–50), nominates CEO candidates (s 27A), and oversees committees. The CEO administers RSHQ and must implement board policy but keeps statutory independence for specific disclosure decisions (s 24A(2)). The land access ombudsman is the Coexistence Queensland CEO and operates subject to advisory council oversight in areas of independence and procedure.\n\n- Likely behaviour changes:\n  - RSHQ will shift to board-led decision-making, publish governance documents and meet at least quarterly (new s 60 requires at least 4 meetings a year).\n  - Resource companies and permit/lease holders will need to lodge renewal applications according to the new windows (e.g. 6 months or 1 year before expiry) and will benefit from continuation protections while applications are decided.\n  - Agencies will move from maps to spatial data in notices and public records, requiring data system changes.\n  - The land access ombudsman may use Coexistence Queensland staff and contractors more flexibly, subject to limits on delegating formal reasons.\n\n**Implementation risks and admin trade-offs**\n\n- Transitional complexity: multiple transitional divisions (for Coal, Mining, RSHQ and Land Access Ombudsman Acts) show a deliberate attempt to preserve continuity, but practical transfer of contracts, IT systems, assets and ongoing proceedings will require coordinated administrative effort (see transitional sections inserted in Parts 2, 7, 8, and Part 4 for Land Access Ombudsman).\n\n- Concentrated vs diffuse interest effects: immediate benefits to licence/lease holders (continuation and clearer renewal windows) may be clear and concentrated; costs of implementing board governance, digital spatial data conversion and staff/contractor arrangements are spread across agencies and taxpayers.\n\n- Delegation and contractor use: the ability to delegate operational functions to contractors increases flexibility and potential cost savings but requires procurement and contract oversight to avoid loss of institutional knowledge or inconsistent decision-making.\n\n**Key statutory references (examples)**\n\n- RSHQ Board establishment and functions: Resources Safety and Health Queensland Act 2020, new Part 4 (ss 48–63), transitional ss 72–83.\n- CEO appointment and board nomination: RSHQ Act ss 14(1A), 27A, 24A.\n- Committee reporting and chair appointment (coal/mining): Coal Mining Safety and Health Act 1999 s 76 (amended); Mining and Quarrying Safety and Health Act 1999 s 67 (amended); chair appointment rules in Coal s 78 and Mining s 69.\n- Land Access Ombudsman and Advisory Council: Land Access Ombudsman Act 2017 new ss 9–12, new Part 2A (ss 31A–31G), delegation and protection ss 61–62.\n- Continuation on renewal and renewal windows: Mineral Resources Act 1989 replacements of ss 93A, 147C, 197C, 286C.\n\nIf you want, I can extract the exact clauses that change CEO appointment/removal language, the precise renewal-application timing wording for each title type, or draft a one‑page checklist for agencies or industry stakeholders to prepare for the transition."}},"importantCases":[],"_links":{"self":"/api/acts/resources-safety-and-health-queensland-and-other-legislation-amendment-bill-2026","history":"/api/acts/resources-safety-and-health-queensland-and-other-legislation-amendment-bill-2026/history","analysis":"/api/acts/resources-safety-and-health-queensland-and-other-legislation-amendment-bill-2026/analysis","conflicts":"/api/acts/resources-safety-and-health-queensland-and-other-legislation-amendment-bill-2026/conflicts","importantCases":"/api/acts/resources-safety-and-health-queensland-and-other-legislation-amendment-bill-2026/important-cases","documents":"/api/acts/resources-safety-and-health-queensland-and-other-legislation-amendment-bill-2026/documents"}}
