(as a written agreement that complies with the requirements of this Act) for a fixed term agreed with the resident.\n\t(7)\tDespite any other provision of this section, an agreement is not required to be reviewed or reissued under this section if—\n\t(a)\tin the case of a prescribed fixed term agreement—the resident notifies the park owner, in writing, that the resident does not wish to continue to occupy the site under a fixed term agreement; or\n\t(b)\tin the case of a periodic residential park site agreement to which subsection (6) applies—the resident notifies the park owner, in writing and in compliance with any certification requirements prescribed by the regulations, that the resident waives the right to have the agreement reissued under this section; or\n\t(c)\tin any case—either party to the agreement has given the other party a notice of termination in accordance with this Act.\n\t(8)\tIf a resident notifies a park owner in accordance with subsection (7)(a), the prescribed fixed term agreement continues as a residential park agreement for a periodic tenancy (in accordance with section 17A) and this section will not apply in relation to the agreement unless—\n\t(a)\tthe resident later notifies the park owner, in writing, that the resident now wishes this section to apply to the agreement (in which case subsection (6) applies as if the resident had held a right of occupancy within the residential park for a period of 5 years or more); or\n\t(b)\tthe agreement is assigned in accordance with section 48 (in which case this section applies to the assigned agreement as if the resident under the assigned agreement had held a right of occupancy within the residential park for a period of 5 years or more).\n\t(9)\tIf a resident notifies a park owner in accordance with subsection (7)(b), the periodic residential park site agreement will continue and this section will not apply in relation to the agreement unless—\n\t(a)\tthe resident later notifies the park owner, in writing, that the resident now wishes this section to apply to the agreement (in which case subsection (6) once again applies to the agreement); or\n\t(b)\tthe agreement is assigned in accordance with section 48 (in which case this section applies to the assigned agreement as if the resident under the assigned agreement had held a right of occupancy within the residential park for a period of 5 years or more).\n\t(10)\tWithout limiting the regulations that may be made for the purposes of subsection (2)(b) or subsection (6)(a), the regulations may prescribe limitations on the terms of agreement that may be varied, or the manner in which such terms may be varied, as a result of a review under this section.\n\t(11)\tA park owner who refuses or fails to comply with a requirement of this section is guilty of an offence.\n\t(12)\tIn this section—\nprescribed fixed term agreement means a residential park site agreement for a fixed term—\n\t(a)\tof 5 years or more; charges\n18—Permissible consideration for residential park agreement\n\t(1)\tA person must not require or receive from a resident a payment, other than rent or a bond (or both), under a residential park agreement, or as a condition to entering into, renewing or extending a residential park agreement.\n\t(2)\tHowever, the park owner may lawfully require and receive a payment of a class the park owner is authorised to require under Division 10.\n\t(3)\tFor the purposes of subsection (1), a reference to a payment includes a reference to any 1 or more of the following:\n\t(a)\tan entry or exit fee;\n\t(b)\ta management fee;\n\t(c)\ta fee for amenities (or the improvement of amenities) provided at the residential park (commonly known as a \"communal contribution fee\");\n\t(d)\tany other prescribed fee,\nregardless of how the payment is described by the person purporting to require or receive the payment from the resident.\nNote—\nFor example, an entry fee that is purportedly required by a person from a resident and is described as \"deferred rent\" is a payment that the person is not permitted to require or receive under this section.\n19—Rent in advance\n\t(1)\tA person must not demand or require another person to pay more than 2 weeks’ rent under a residential park agreement before the end of the first 2 weeks of the period of occupancy under the agreement.\n\t(2)\tIf rent has been paid under a residential park agreement, a person must not require a further payment of rent until the end of the last period for which rent has been paid.\n\t(3)\tA person must not require another person to give a post-dated cheque or other post-dated negotiable instrument in payment of rent under a residential park agreement.\n20—Method of payment of rent\nA park owner must not require that rent payments under a residential park agreement be made to the park owner or the park owner's agent at the rented property unless some reasonable alternative method of payment that does not involve personal attendance at the rented property has been offered by the park owner but not accepted by the resident.\n21—Variation of rent\n\t(1)\tThe park owner may increase the rent payable under a residential park agreement by giving written notice to the resident specifying the date from which the increase takes effect.\n\t(2)\tHowever—\n\t(a)\tthe right to increase the rent may be excluded or limited by the terms of the residential park agreement; and\n\t(b)\tif the residential park agreement is for a fixed term, the agreement is taken to exclude an increase in rent during the term unless the agreement specifically allows for an increase in rent; and\n\t(c)\tthe date fixed for an increase of rent must be at least 12 months after the date of the agreement or, if there has been a previous increase of rent under this section, the last increase and, subject to subsection (3), at least 60 days after the notice is given.\n\t(3)\tIf a rent control notice that has applied in respect of the rented property ceases to be in force, the park owner may, by notice given under this section within 60 days after the rent control notice ceases to be in force, increase the rent for the rented property from a date falling at least 14 days after the notice is given.\n\t(4)\tThe rent payable under a residential park agreement may be reduced by mutual agreement between the park owner and the resident.\n\t(5)\tA reduction of rent may be made on a temporary basis so that the rent reverts to the level that would have been otherwise applicable at the end of a specified period.\n\t(6)\tIf the rent payable under a residential park agreement is increased or reduced under this section, the terms of the agreement are varied accordingly.\n\t(7)\tThis section does not affect the operation of a provision of a residential park agreement under which the rent payable under the agreement changes automatically on a basis set out in the agreement.\n\t(8)\tFor the purposes of this section, a series of residential park agreements between the same parties and relating to the same site is to be treated as a single residential park agreement unless at least 12 months have elapsed since rent for the rented property was fixed or last increased.\n22—Excessive rent\n\t(1)\tThe Tribunal may, on application made by a resident within 30 days after receipt of a notice of rent increase, declare that the proposed increased rent is excessive.\n\t(2)\tIn deciding whether the increased rent is excessive, the Tribunal must have regard to—\n\t(a)\tthe general level of rents for comparable rented properties in the same or similar localities; and\n\t(b)\tthe estimated capital value of the rented property at the date of the application; and\n\t(c)\tthe outgoings for which the park owner is liable under the agreement; and\n\t(d)\tthe estimated cost of services provided by the park owner and the resident under the agreement; and\n\t(e)\tthe nature and value of furniture, equipment and other personal property provided by the park owner for the resident's use; and\n\t(f)\tthe state of repair and general condition of the rented property; and\n\t(g)\tthe amenity and standard of the common areas of the residential park; and\n\t(h)\tother relevant matters.\n\t(3)\tIf the Tribunal finds, on an application under this section, that the increased rent is excessive, the Tribunal may, by order—\n\t(a)\tfix the rent payable for the rented property; and\n\t(b)\tfix a period (which cannot exceed 1 year) for which the order is to remain in force.\n\t(4)\tThe Tribunal may, on application by the park owner, vary or revoke an order under this section if satisfied that it is just to do so.\n\t(5)\tIf, while an order remains in force under this section, a park owner asks for or receives rent for the rented property to which the order relates exceeding the amount fixed by the order, the park owner is guilty of an offence.\nExpiation fee: $1 500.\n\t(6)\tIn this section—\nrent includes a payment that the resident is required by the park owner to make under Division 10.\n23—Park owner's duty to keep proper records of rent\n\t(1)\tA park owner under a residential park agreement must ensure that a proper record is kept of rent received under the agreement.\nMaximum penalty: $20 000.\n\t(2)\tA person must not—\n\t(a)\tmake a false entry in a record of the rent received under a residential park agreement; or\n\t(b)\tfalsify the record in any other way.\n24—Duty to give receipt for rent\n\t(1)\tA person who receives rent under a residential park agreement must, within 48 hours after receiving the rent, give the person paying the rent a receipt stating—\n\t(a)\tthe date on which the rent was received; and\n\t(b)\tthe name of the person paying the rent; and\n\t(c)\tthe amount paid; and\n\t(d)\tthe period of occupancy to which the payment relates; and\n\t(e)\tthe address of the rented property to which the payment relates.\n\t(2)\tHowever, if the resident pays the rent into an account kept by the park owner or the park owner's agent at an ADI, and the park owner, or the park owner's agent keeps a written record containing the information required by subsection (1), a receipt need not be given.\n25—Accrual and apportionment of rent\n\t(1)\tThe rent payable under a residential park agreement accrues from day to day.\n\t(2)\tIf rent is paid in advance, and the residential park agreement ends before the end of the period for which rent has been paid, the park owner must refund the appropriate proportion of the amount paid to the resident or apply it towards other liabilities of the resident to the park owner.\n26—Abolition of distress for rent\nA park owner is not entitled to distrain goods of a resident for non-payment of the rent payable under a residential park agreement.\nDivision 2—Bonds\n27—Bond\n\t(1)\tA person must not—\n\t(a)\trequire more than 1 bond for the same residential park agreement; or\n\t(b)\trequire the payment of a bond exceeding 4 weeks rent under the agreement.\n\t(2)\tThe 4 weeks rent limit on the amount of the bond is calculated by reference to the rent, or if the rent varies, the lowest rent, payable during the first 6 months of the period of occupancy under the agreement (expressed as a weekly rent).\n28—Receipt of bond and transmission to Commissioner\n\t(1)\tA person must, within 48 hours after receiving an amount paid by way of a bond, give the person who paid a receipt stating the date payment was received, the name of the person from whom the payment was received, the amount paid, and the address of the rented property to which the payment relates.\n\t(2)\tA person must, within 7 days after receiving an amount paid by way of a bond, pay the amount to the Commissioner and at the same time lodge with the Commissioner a notice in the form approved by the Commissioner.\n29—Repayment of bond\n\t(1)\tAn application may be made to the Commissioner for—\n\t(a)\tpayment of the whole amount of the bond either to the park owner or the resident; or\n\t(b)\tpayment of a specified amount of the bond to the park owner and the balance to the resident.\n\t(2)\tThe application—\n\t(a)\tmust be in a form approved by the Commissioner; and\n\t(b)\tmay be made jointly by the park owner and the resident or by either the park owner or the resident.\n\t(3)\tIf the application is undisputed, the Commissioner must pay out from the Fund the amount of the bond as specified in the application.\n\t(4)\tIf an application is liable to be disputed, the Commissioner must give the respondent written notice of the application (in a form the Commissioner considers appropriate) and inform the respondent that, if the respondent wants to dispute the application, a written notice of dispute, in a form approved by the Commissioner, must be lodged with the Commissioner within 10 days after the date the notice is given to the respondent.\n\t(5)\tIf the respondent does not give the Commissioner written notice of dispute, in a form approved by the Commissioner, within 10 days after the date the Commissioner's notice is given to the respondent, the Commissioner may pay out from the Fund the amount of the bond as proposed in the application.\n\t(5a)\tHowever, if the application is made by the park owner alone more than 12 months after the termination of the residential park agreement—\n\t(a)\tthe Commissioner must refer the application to the Tribunal for determination; and\n\t(b)\tthe Tribunal may authorise payment of the amount of the bond as proposed in the application if the Tribunal is satisfied, on the basis of information provided by the park owner, that the park owner is entitled to the payment.\n\t(6)\tIf the Commissioner receives a written notice of dispute before the amount of the bond is paid out under subsection (5), the Commissioner must refer the dispute to the Tribunal for determination.\n\t(6a)\tDespite a preceding subsection, if—\n\t(a)\tthe bond has been provided or paid on behalf of the resident by a third party prescribed by the regulations, or in circumstances prescribed by the regulations; and\n\t(b)\tthe Commissioner is given notice of the third party's interest in accordance with the regulations,\nthen—\n\t(c)\tthe third party is entitled to make application to the Commissioner for the payment of the whole, or a specified part, of the bond; and\n\t(d)\t—\n\t(i)\tif the application is made with the consent of the park owner—the Commissioner must pay out the amount of the bond as specified in the application; or\n\t(ii)\tin any other case—the Commissioner must give the park owner and, if the resident is still in possession of the premises, the resident, written notice of the application (in a form the Commissioner considers appropriate) and—\n\t(A)\tif the Commissioner does not receive a written notice of dispute from the party or parties to whom the notice of the application was given within 10 days after the date on which the original notice is given—the Commissioner may pay out the amount of the bond as proposed in the application; or\n\t(B)\tin any other case—the Commissioner must refer the matter to the Tribunal for determination.\n\t(6b)\tIf a payment is made under subsection (6a) and the resident is still in possession of the premises, the park owner may require the resident to provide a new bond in accordance with section 27.\n\t(6c)\tIf—\n\t(a)\tthe bond is provided on behalf of the resident by a third party prescribed by the regulations in circumstances prescribed by the regulations; and\n\t(b)\tthe park owner makes application to the Commissioner for the payment of the whole, or a specified part, of the amount payable under the bond,\nthen—\n\t(c)\tif the application is made with the consent of the third party—the Commissioner must pay out the amount as specified in the application; or\n\t(d)\tin any other case—the Commissioner must give the third party and, if the resident is still in possession of the premises, the resident, written notice of the application (in a form the Commissioner considers appropriate) and—\n\t(i)\tif the Commissioner does not receive a written notice of dispute from the party or parties to whom the notice of the application was given within 10 days after the date on which the original notice is given—the Commissioner may pay out the amount as proposed in the application; or\n\t(ii)\tin any other case—the Commissioner must refer the matter to the Tribunal for determination.\n\t(6d)\tIf a payment is made under subsection (6c), the third party must reimburse the Fund to the extent of the payment.\n\t(7)\tFor the purposes of this section—\n\t(a)\tan application is undisputed if it is a joint application by the park owner and the resident, or an application by the park owner that the whole of the amount of the bond be paid to the resident, or an application by the resident that the whole of the amount of the bond be paid to the park owner;\n\t(b)\tan application that does not fall into any of those categories is liable to be disputed;\n\t(c)\tif the application was made by the park owner, the resident is the respondent;\n\t(d)\tif the application was made by the resident, the park owner is the respondent.\nDivision cause or permit an interference with the reasonable peace, comfort or privacy of the resident in the resident's use of the rented property or with the reasonable use or enjoyment by the resident of common areas of the residential park; and\n\t(c)\tthe park owner must take reasonable steps to prevent other residents of the residential park from causing or permitting interference with the reasonable peace, comfort or privacy of the resident in the resident's use of the rented property or with the reasonable use or enjoyment by the resident of common areas of the residential park.\n\t(2)\tIf the park owner contravenes the term of the agreement arising under subsection (1) in circumstances that amount to harassment of the resident, the park owner is guilty of an new residential park site agreement must constitute a reasonable offer in the circumstances); or\n\t(b)\tan agreement for the purchase, by the park owner, of a dwelling owned by the resident on termination of the residential park site agreement; or\n\t(c)\tan agreement for the relocation, at the expense of the park owner, of a dwelling owned by the resident on termination of the residential park site agreement,\nand the resident has accepted that offer.\n\t(4)\tThe resident must not unreasonably refuse an offer made by a park owner in accordance with subsection (3).\n\t(5)\tIf the resident and park owner are not able to reach an agreement in relation to an offer made by the park owner in accordance with subsection (3), the park owner or the resident may apply to the Tribunal for resolution of the dispute.\n\t(6)\tSubject to any order of the Tribunal or any agreement between the park owner and the resident to the contrary, the period of notice under subsection (1) must be at least 365 days.\n\t(7)\tA park owner may, by notice in writing, agree to waive the right to terminate a residential park site under subsection (1) (and in such a case this section will not apply to the residential park site agreement).\n\t(8)\tNothing in this section affects the power of a park owner to terminate a periodic tenancy under section 71.\n71—Termination where periodic tenancy and no specified ground of termination\n\t(1)\tA park owner may, by notice of termination given to the resident, terminate a residential park site agreement for a periodic tenancy without specifying a ground of termination.\n\t(2)\tHowever, an agreement cannot be terminated under this section if—\n\t(a)\tan order is in force under section 22 in respect of the rented property or proceedings for such an order have been commenced; or\n\t(b)\tthe resident has held a right of occupancy within the residential park for a period of 5 years or more.\n\t(3)\tThe period of notice under this section must be at least 90 days.\n72—Termination at end of fixed term\n\t(1)\tA park owner may, by notice of termination given to the resident, terminate a residential park site agreement for a fixed term at the end of the fixed term without specifying a ground of termination.\n\t(3)\tThis section does not apply to a residential park site agreement for a fixed term—\n\t(a)\tof 5 years or more; or\n\t(b)\tof less than 5 years if the resident has held a right of occupancy within the residential park for a period of 5 years or more.\n73—Termination where agreement frustrated\n\t(1)\tA park owner may, by notice of termination given to the resident, terminate a residential park site agreement on the ground that, otherwise than as a result of a breach of the agreement, the rented property or a substantial portion of the rented property—\n\t(2)\tA notice given under subsection (1)(a) or (b) may terminate the agreement immediately.\n\t(3)\tA notice given under subsection (1)(c) must provide for a period of notice of at least 60 days.\n74—Termination for breach of agreement\n\t(1)\tIf the park owner breaches a residential park site agreement, the resident may give the park owner a written notice, in the form approved by the Commissioner—\n\t(b)\tinforming the park owner that if the breach is not remedied within a specified period (which must be a period of at least 14 days) from the date the notice is given, then—\n\t(ii)\tthe resident will give up vacant possession of the rented property before the end of the next day.\n\t(2)\tThe park owner may, before the time fixed in the resident's notice for termination of the agreement or the resident gives up vacant possession of the rented property (whichever is the later), apply to the Tribunal for an order—\n\t(a)\tdeclaring that the park owner is not in breach of the agreement, or has remedied the breach of the agreement, and that the agreement is not liable to be terminated under this section; or\n\t(3)\tIf the Tribunal is satisfied that a residential park site agreement has been validly terminated under this section, but that it is just and equitable to reinstate the agreement (or would be just and equitable to reinstate the agreement if the conditions of the order were complied with), the Tribunal may make an order reinstating the agreement.\n\t(4)\tAn order reinstating the agreement under this section may be made on conditions that the Tribunal considers appropriate.\n75—Termination where successive breaches of agreement\n\t(1)\tA resident may, by notice of termination given to the park owner, terminate a residential park site agreement on the ground that the park owner—\n\t(b)\thad committed breaches of the same term of the agreement on at least 2 previous occasions and been given separate notice under section 74 in respect of each of those breaches.\n\t(2)\tThe period of notice given under this section must be at least 14 days.\n76—Termination where periodic tenancy and no specified ground of termination\n\t(1)\tA resident may, by notice of termination given to the park owner, terminate a residential park site agreement for a periodic tenancy without specifying a ground of termination.\n\t(2)\tThe period of notice under this section must be at least 28 days or a period equivalent to a single period of the tenancy (whichever is longer).\n77—Termination at end of fixed term\n\t(1)\tA resident may, by notice of termination given to the park owner, terminate a residential park site agreement for a fixed term at the end of the fixed term without specifying a ground of termination.\n78—Termination where agreement frustrated\n\t(1)\tA resident may, by notice of termination given to the park owner, terminate a residential park site agreement on the ground that, otherwise than as a result of a breach of the agreement, the rented property or a substantial portion of the rented property—\n\t(a)\thas been rendered uninhabitable; or\n78A—Termination where notice given under section 70A\n\t(1)\tIf a park owner gives notice of termination to a resident under section 70A, the resident is not necessarily bound by the residential park site agreement until it terminates as a result of that notice, but may, by notice of termination given to the owner, terminate the agreement without specifying a ground of termination.\n\t(2)\tThe period of the resident's notice to the owner must be at least 28 days.\nDivision 4—Termination by Tribunal\n79—Termination on application by park owner\nThe Tribunal may, on application by a park owner, terminate a residential park agreement and make an order for possession of the rented property if satisfied that—\n\t(a)\tthe resident has committed a breach of the agreement; and\n\t(b)\tthe breach is sufficiently serious to justify termination of the agreement.\n80—Termination on application by resident\nThe Tribunal may, on application by a resident, terminate a residential park agreement and make an order for possession of the rented property if satisfied that—\n\t(a)\tthe park owner has committed a breach of the agreement; and\n\t(b)\tthe breach is sufficiently serious to justify termination of the agreement.\n81—Termination based on hardship\n\t(1)\tIf the continuation of a residential park agreement would result in undue hardship to the park owner or the resident, the Tribunal may, on application by the park owner or the resident, terminate the agreement from a date specified in the Tribunal's order and make an order for possession of the rented property as from that day.\n\t(2)\tThe Tribunal may also make an order compensating a park owner or resident for loss and inconvenience resulting, or likely to result, from the early termination of the agreement.\nDivision 5—Form of notices of termination\n82—Form of notice of termination\n\t(1)\tA notice of termination given by a park owner to a resident must—\n\t(a)\tbe in writing and in the form approved by the Commissioner; and\n\t(b)\tbe signed by the park owner or the park owner's agent; and\n\t(c)\tstate the address of the rented property subject to the residential park agreement; and\n\t(d)\tstate the day on which the resident is required to give up vacant possession of the rented property to the park owner; and\n\t(e)\tif the residential park agreement is to be terminated on a particular ground—specify and give reasonable particulars of the ground of termination; and\n\t(f)\tinclude any further information required by the Commissioner.\n\t(2)\tA notice of termination given by a resident to a park owner must—\n\t(a)\tbe in writing and in the form approved by the Commissioner; and\n\t(b)\tbe signed by the resident or an agent of the resident; and\n\t(c)\tstate the address of the rented property subject to the residential park agreement; and\n\t(d)\tstate the day on which the resident is to give up vacant possession of the rented property to the park owner; and\n\t(e)\tif the residential park agreement is to be terminated on a particular ground—specify and give reasonable particulars of the ground of termination; and\n\t(f)\tinclude any further information required by the Commissioner.\nDivision 6—Repossession of rented property\n83—Order for possession\n\t(1)\tThe Tribunal may, on application by the park owner, if satisfied that a residential park agreement has terminated, make an order for possession of the rented property.\n\t(2)\tThe order for possession will take effect on a date specified by the Tribunal in the order, being a date not more than 7 days after the date of the order.\n\t(3)\tHowever, if the Tribunal, although satisfied that the park owner is entitled to an order for possession of the rented property, is satisfied by the resident that the grant of an order for immediate possession of the rented property would cause severe hardship to the resident, the Tribunal may—\n\t(a)\tsuspend the operation of the order for possession for up to 90 days; and\n\t(b)\textend the operation of the residential park agreement until the park owner obtains vacant possession of the rented property from the resident.\n\t(4)\tIn extending the operation of the residential park agreement, the Tribunal may make modifications to the agreement that it considers appropriate (but the modifications cannot reduce the resident's financial obligations under the agreement except as may be appropriate for the recovery by the resident of any compensation payable to the resident).\n\t(5)\tIf the resident fails to comply with an order for possession, the park owner is entitled to compensation for any loss caused by that failure.\n\t(6)\tThe Tribunal may, on application by the park owner, order the resident to pay to the park owner compensation to which the park owner is entitled under subsection (5).\n84—Abandonment of rented property\n\t(1)\tThe Tribunal may, on application by a park owner—\n\t(a)\tdeclare that a resident abandoned rented property on a day stated in the declaration; and\n\t(b)\tmake an order for immediate possession of the rented property.\n\t(2)\tIn deciding whether a resident has abandoned rented property, the following matters are to be considered:\n\t(a)\twhether rent payable under the residential park agreement is unpaid;\n\t(b)\twhether the dwelling is unoccupied and neglected;\n\t(c)\twhether the resident's mail is being collected;\n\t(d)\treports from neighbours, or other persons, about the absence or whereabouts of the resident;\n\t(e)\twhether electricity or other services to the rented property have been disconnected or terminated;\n\t(f)\twhether the resident's personal effects have been removed from the rented property;\n\t(g)\tany other matters the Tribunal considers relevant.\n\t(3)\tA resident is to be taken to have abandoned the rented property on the day stated in a declaration under this section.\n\t(4)\tIf a resident has abandoned rented property, the park owner is entitled to compensation for any loss (including loss of rent) caused by the abandonment.\n\t(5)\tHowever, the park owner must take reasonable steps to mitigate any loss and is not entitled to compensation for loss that could have been avoided by those steps.\n\t(6)\tThe Tribunal may, on application by the park owner, order the resident to pay to the park owner compensation to which the park owner is entitled under this section.\n85—Repossession of rented property\nA person must not enter rented property for the purpose of taking possession of the rented property before, or after, the end of a residential park agreement unless—\n\t(a)\tthe resident abandons, or voluntarily gives up possession of, the rented property; or\n\t(ab)\tthe person is authorised to take possession of the rented property by force of a notice to vacate issued in respect of the rented property; or\n\t(b)\tthe person is authorised to take possession of the rented property under the order of a court or the Tribunal.\n86—Forfeiture of head tenancy not to automatically end agreement\n\t(1)\tA person cannot take possession of rented property so as to defeat the resident's right to possession under the residential park agreement unless an order for possession of the rented property is made by a court or the Tribunal.\n\t(2)\tIf a person is entitled to possession of rented property as against a person who granted a residential park agreement, a court before which proceedings for possession of the rented property are brought, or the Tribunal, may, on application by an interested person, vest the residential park agreement in the person who would, but for the agreement, be entitled to possession of the rented property so that the resident holds the rented property directly from that person as park owner.\n\t(3)\tAn order may be made under subsection (2) on terms and conditions the court or Tribunal considers just.\nDivision 7—Enforcement of orders for possession\n87—Enforcement of orders for possession\n\t(1)\tIf an order for possession of rented property has been made by the Tribunal but has not been complied with, the Registrar or a Deputy Registrar must, at the written or oral request of the person in whose favour the order was made (or agent of that person), direct a bailiff to enforce the order.\n\t(2)\tA bailiff must enforce an order for possession as soon as is practicable after being directed to do so under this section.\n\t(3)\tA bailiff enforcing an order for possession of rented property may enter the rented property, ask questions and take all steps as are reasonably necessary for the purpose of enforcing the order.\n\t(4)\tIn enforcing an order for possession, the bailiff is responsible for securing the removal of persons only and not property.\n\t(5)\tA police officer must, if requested by a bailiff, assist the bailiff in enforcing an order for possession.\n\t(6)\tIn the exercise of the powers conferred by this section a bailiff may use the force that is reasonable and necessary in the circumstances.\n\t(7)\tA person must not hinder or obstruct a bailiff in the exercise of the powers conferred by this section.\n\t(8)\tA person questioned under this section must not refuse or fail to answer the question to the best of his or her knowledge, information and belief.\n\t(9)\tHowever, a person is not obliged to answer a question under this section if to do so might tend to incriminate the person or to make the person liable to a penalty, or would require the disclosure of information that is privileged under the principles of legal professional privilege.\nDivision 8—Retaliatory action by park owner\n88—Retaliatory action by park owner\n\t(1)\tThis section applies to proceedings before the Tribunal—\n\t(a)\ton an application by a park owner for an order for possession of rented property or for both termination of a residential park agreement and an order for possession of the rented property; or\n\t(b)\ton an application by a resident for relief under this section following receipt of a notice of termination (whether or not the residential park agreement has terminated by force of the notice).\n\t(2)\tIf the Tribunal is satisfied that the park owner was wholly or partly motivated to make the application or give the notice of termination (as the case may be) by action of the resident to complain to a government authority or secure or enforce the resident's rights as a resident, the Tribunal may, if the Tribunal considers it appropriate to do so in the circumstances of the case, do either or both of the following:\n\t(a)\trefuse the park owner's application;\n\t(b)\tmake an order reinstating the residential park agreement on such conditions (if any) as the Tribunal considers appropriate.\n\t(3)\tIf the resident alleges retaliatory action on the part of the park owner and the Tribunal is satisfied that the resident had, within the preceding 6 months, taken action to complain to a government authority or secure or enforce the resident's rights as a resident, the burden will lie on the park owner to prove that the park owner was not wholly or partly motivated to make the application or give the notice of termination (as the case may be) by the action of the resident.\nDivision 9—Resident to give forwarding address\n89—Resident to give forwarding address\nIf—\n\t(a)\ta residential park agreement has terminated; or\n\t(b)\ta notice has been given under this Part that will terminate a residential park agreement,\nthe resident must not fail, without reasonable excuse, to comply with a request of the park owner for the resident's forwarding address and must comply with the request immediately, or, if the address is not then known, as soon as practicable after it becomes known.\nMaximum penalty: $20 000.\nExpiation fee: $750.\nDivision 10—Abandoned property\n90—Abandoned property\nThis Division applies to property (abandoned property) that is left on a site by the resident after termination of the residential park agreement.\n91—Offence to deal with abandoned property in unauthorised way\nA park owner must not deal with abandoned property otherwise than in accordance with this Division.\nMaximum penalty: $10 000.\n92—Action to deal with abandoned property other than personal documents\n\t(1)\tThis section applies to abandoned property other than personal documents.\n\t(2)\tThe park owner may, at any time after recovering possession of the site, remove from the site and destroy or dispose of abandoned property consisting of perishable foodstuffs.\n\t(3)\tThe following provisions of this section apply subject to section 94 if the abandoned property consists of or includes a dwelling installed or located on the site under a residential park site agreement or an item of property of a value or kind prescribed by regulation.\n\t(4)\tThe park owner may, at any time after recovering possession of the site, remove from the site and destroy or dispose of abandoned property, other than perishable foodstuffs, if the value of the property is less than a fair estimate of the cost of removal, storage and sale of the property.\n\t(5)\tIf there is any abandoned property (other than personal documents) on the site that may not be dealt with under subsection (2) or (4) (valuable abandoned property), the park owner must—\n\t(a)\tas soon as practicable—\n\t(i)\tgive notice, in the form approved by the Commissioner, to the resident if the park owner has a forwarding address for the resident; \n\t(ii)\tif the park owner does not have a forwarding address for the resident—publish notice, in the form approved by the Commissioner, in a newspaper circulating generally throughout the State;\n\t(iii)\tif a person other than the resident has, to the knowledge of the park owner, an interest in the property and the person's name and address are known to, or reasonably ascertainable by, the park owner—give notice, in the form approved by the Commissioner, to that other person; and\n\t(b)\ttake reasonable steps to keep the property safe until at least 28 days after the giving of such notice.\n\t(6)\tA person who is entitled to possession of valuable abandoned property may reclaim the property by paying to the park owner the reasonable costs incurred by the park owner in dealing with the property in accordance with this Division and any other reasonable costs incurred by the park owner as a result of the property being left on the site.\n\t(7)\tIf valuable abandoned property is not reclaimed within 28 days after the giving of notice under subsection (5), the park owner must, as soon as practicable after the end of that period, have the property sold by public auction.\n\t(8)\tThe park owner may use reasonable force to gain entry to the property or remove or deal with it as reasonably necessary for the park owner's use of the site or the sale of the property.\n\t(9)\tOn the sale of the property by public auction, the park owner—\n\t(a)\tmay retain out of the proceeds of sale—\n\t(i)\tthe reasonable costs incurred by the park owner in dealing with the property in accordance with this Division and any other reasonable costs incurred by the park owner as a result of the property being left on the site; and\n\t(ii)\tany amounts owed to the park owner under the residential park agreement; and\n\t(b)\tmust pay the balance (if any) to the owner of the property, or if the identity and address of the owner are not known to, or reasonably ascertainable by, the park owner, to the Commissioner for the credit of the Fund.\n\t(10)\tIf property is sold by public auction under this section, the purchaser acquires a good title to the property which defeats—\n\t(a)\tthe resident's interest in the property; and\n\t(b)\tthe interest of any other person unless the purchaser has actual notice of the interest before purchasing the property.\n\t(11)\tIf a dispute arises between a park owner and resident about the exercise of powers conferred by this section, the Tribunal may, on application by either party to the dispute, make orders resolving the matters in dispute.\n93—Action to deal with abandoned personal documents\n\t(1)\tThis section applies to abandoned property consisting of personal documents.\n\t(2)\tThis section applies subject to section 94 if the abandoned property also includes a dwelling installed or located on the site under a residential park site agreement or an item of property of a value or kind prescribed by regulation.\n\t(3)\tThe park owner must—\n\t(a)\tas soon as practicable, give notice, in the form approved by the Commissioner, to the resident if the park owner has a forwarding address for the resident; and\n\t(b)\ttake reasonable steps to keep the documents safe for at least 28 days.\n\t(4)\tIf the personal documents are not reclaimed by the resident within 28 days, the park owner may destroy or dispose of the documents.\n\t(5)\tSubsection (4) applies subject to any Act relating to the preservation of records.\n94—Action to deal with abandoned dwellings or prescribed items\n\t(1)\tThis section applies if there is abandoned property consisting of or including a dwelling installed or located on the site under a residential park site agreement or an item of property of a value or kind prescribed by regulation.\n\t(2)\tThe park owner may not take any action to deal with the property unless the Tribunal has made an order for possession of the site.\n\t(3)\tThe park owner must take reasonable steps to keep the property safe on the site pending the determination of proceedings before the Tribunal for an order for possession of the site.\n\t(4)\tIf the Tribunal has made an order for possession of the site, the provisions of sections 92 and 93 apply in relation to the abandoned property, but in the application of section 92 to the dwelling or item of property of a value or kind prescribed by regulation, the reference in that section to 28 days is to be read as a reference to 60 days.\n","sortOrder":21},{"sectionNumber":"Part 10","sectionType":"part","heading":"Serious acts of violence","content":"Part 10—Serious acts of violence\n95—Park owner may give person notice to serious act of violence by the resident has occurred in the park; or\n\t(b)\tthe safety of any person in the park is in danger from the resident.\n\t(2)\tA park owner may give a person permitted on rented property with the consent of the resident (a resident's visitor) a notice to leave the residential park immediately if the park owner has reasonable grounds to believe that—\n\t(a)\ta serious act of violence by the resident's visitor has occurred in the park; or\n\t(b)\tthe safety of any person in the park is in danger from the resident's visitor.\n\t(3)\tA notice to leave under this section must be in the form approved by the Commissioner.\n\t(4)\tA notice to leave under this section must be given as soon as it is possible for the park owner to safely do so after the serious act of violence has occurred or the safety of a person in the park has been endangered.\n\t(5)\tA park owner must not give a notice under this section, or a document that purports to be a notice to leave under this section, unless the park owner has reasonable grounds to believe that—\n\t(a)\ta serious act of violence by a resident or resident's visitor has occurred in the residential park; or\n\t(b)\tthe safety of any person in the residential park is in danger from a resident or a resident's visitor.\n\t(6)\tA person who has been given a notice to leave a residential park under this section must not remain in the park after receiving the notice.\n96—Exclusion from park for certain period\n\t(1)\tA resident who is given a notice to leave under this Part must not enter or remain in the residential park for the exclusion period.\n\t(2)\tIn this section—\nexclusion period means—\n\t(a)\tuntil the end of 2 business days after the notice is given; or\n\t(b)\tif an application is made under section 97—\n\t(i)\tuntil the end of 4 business days after the notice is given; or\n\t(ii)\tif within that period the Tribunal on the application of the park owner so orders, until the Tribunal has heard and determined the application.\n97—Park owner may make urgent application to Tribunal\n\t(1)\tIf a resident is given a notice to leave under this Part, the park owner may apply to the Tribunal for an order that the residential park agreement be terminated.\n\t(2)\tAn application under subsection (1) must be made within the exclusion period.\n\t(3)\tOn hearing an application under this section, the Tribunal may—\n\t(a)\tmake an order terminating the residential park agreement as at the date of the order and make an order for possession of the rented property; or\n\t(b)\tmake an order vesting the residential park agreement in a person who resides or resided on the rented property with the resident; or\n\t(c)\torder that the resident be allowed to resume occupation of the rented property under the residential park agreement.\n\t(4)\tThe Tribunal may make any ancillary or incidental orders that the Tribunal considers appropriate.\n\t(5)\tIf the Tribunal orders that the resident be allowed to resume occupation of the rented property under the residential park agreement and is satisfied that there was no reasonable basis for the giving of the notice under this Part, the Tribunal may make 1 or more of the following orders:\n\t(a)\tan order excusing the resident from paying rent in respect of the exclusion period;\n\t(b)\tan order for compensation to be paid to the resident by the park owner for rent paid in respect of the exclusion period;\n\t(c)\tan order for compensation to be paid to the resident by the park owner for reasonable expenses incurred by the resident relating to the exclusion period.\n98—Occupation of rented property pending application or hearing\n\t(1)\tA park owner must not, during the exclusion period, allow any third person to occupy the rented property.\n\t(2)\tIn this section—\nthird person means a person other than the resident or a person who resided on the rented property with the resident immediately before the notice to leave the residential park was given to the resident.\n","sortOrder":22},{"sectionNumber":"Part 11","sectionType":"part","heading":"South Australian Civil and exceeds $40 000 unless the parties to the proceedings consent in writing to the claim being heard and determined by the Tribunal (and if consent is given, it is irrevocable).\n\t(3)\tIf a monetary claim under this Act is above the Tribunal's jurisdictional limit, the claim and any other claims related to the same residential park agreement may be brought in a court competent to hear and determine a claim founded on contract for the amount of the claim.\n\t(4)\tA court in which proceedings are brought under subsection (3) may exercise the powers of the Tribunal under this Act and, to such extent as may be necessary and appropriate, the powers of the Tribunal under the South Australian Civil and Administrative Tribunal Act 2013.\nDivision 4—Representation of parties in mediation\n110—Representation of parties in mediation\nIf a residential park dispute is referred by the Tribunal for mediation, a party to the dispute may be represented by a person who is not a lawyer in the mediation of the dispute if—\n\t(a)\tthe party is a body corporate and the representative is an officer or employee of the body corporate; or\n\t(b)\tall parties to the proceedings agree to the representation and the mediator is satisfied that it will not unfairly disadvantage an unrepresented party; or\n\t(c)\tthe mediator is satisfied that the party is unable to present the party's residential park dispute.\n\t(2)\tIf the Commissioner intervenes in proceedings, the Commissioner becomes a party to the proceedings and has all the rights (including rights of appeal) of a party to the proceedings.\nDivision 6—Amendment of proceedings\n113—Amendment of proceedings\nThe Tribunal may amend proceedings if satisfied that the amendment will contribute to the expeditious and just resolution of the questions in issue between the parties.\nDivision 7—Judgments and orders\n116—General powers of Tribunal to resolve disputes\n\t(1)\tThe Tribunal may, on application by a party to a residential park dispute—\n\t(a)\trestrain an action in breach of this Act or a residential park agreement or collateral agreement; or\n\t(b)\trequire a person to comply with an obligation under this Act or a residential park agreement or collateral agreement; or\n\t(c)\torder a person to make a payment (which may include compensation); or\n\t(d)\tmodify a residential park agreement to enable the resident to recover compensation payable to the resident by way of a reduction in the rent otherwise payable under the agreement; or\n\t(e)\trelieve a party to a residential park agreement or orders\n\t(1)\tThe Tribunal may in proceedings under this Act make an order in the nature of an injunction (including an interim injunction) or an order for specific performance.\n\t(2)\tHowever, a member of the Tribunal who is not a legally qualified member (within the meaning of the South Australian Civil and Administrative Tribunal Act 2013) cannot make an order under subsection (1) without the approval of the President or a Deputy President of the Tribunal.\n\t(6)\tThe Tribunal may, in the exercise of its jurisdiction under this Act, make ancillary or incidental orders.\n118—Restraining order.\n\t(2)\tAn application for a restraining order may be made without notice to the persons against whom the order is sought but, if the order is made without giving them a reasonable opportunity party's case properly without assistance; or\n\t(c)\tanother party to the dispute is a lawyer, or is represented by a professional representative; or\n\t(d)\tthe Commissioner has intervened in, or is a party to, the proceedings.\n\t(3)\tA party to a residential park dispute may be represented by a person who is not a lawyer if—\n\t(a)\tthe party is a body corporate and the representative is an (SACAT) Act 2014\n157—Transitional provisions\n\t(1)\tIn this section—\nprincipal Act means the Residential Parks Act 2007;\nrelevant day means the day on which this Part comes into operation;\nResidential Tenancies Tribunal means the Tribunal established under the Residential Tenancies Act 1995;\nTribunal means the South Australian Civil and Administrative Tribunal established under the South Australian Civil and Administrative Tribunal Act 2013.\n\t(2)\tA decision (including a decision in the nature of a declaration), direction or order of the Residential Tenancies Tribunal under the principal Act in force immediately before the relevant day will, on and from the relevant day, be taken to be a decision, direction or order of the Tribunal.\n\t(3)\tA right to make any application or to seek a review under the principal Act with respect to any matter in existence before the relevant day, with the effect that the relevant proceedings would have been commenced before the Residential Tenancies Tribunal, will be exercised as if this Part had been in operation before the right arose, so that the relevant proceedings may be commenced instead before the Tribunal.\n\t(4)\tAny proceedings before the Residential Tenancies Tribunal under the principal Act immediately before the relevant day will, subject to such directions as the President of the Tribunal thinks fit, be transferred to the Tribunal where they may proceed as if they had been commenced before the Tribunal.\n\t(5)\tThe Tribunal may—\n\t(a)\treceive in evidence any transcript of evidence in proceedings before the Residential Tenancies Tribunal, and draw any conclusions of fact from that evidence that appear proper; and\n\t(b)\tadopt any findings or determinations of the Residential Tenancies Tribunal that may be relevant to proceedings before the Tribunal; and\n\t(c)\tadopt or make any decision (including a decision in the nature of a declaration), direction or order in relation to proceedings before the Residential Tenancies Tribunal before the relevant day (including so as to make a decision or declaration, or a direction or order, in relation to proceedings fully heard before the relevant day); and\n\t(d)\ttake other steps to promote or ensure the smoothest possible transition from 1 jurisdiction to another in connection with the operation of this section.\n\t(6)\tThe Tribunal may, on application under section 121 of the principal Act made after the relevant date, vary or set aside an order of the Residential Tenancies Tribunal made before the relevant date, provided that the application is made to the Tribunal within 3 months of the making of the order by the Residential Tenancies Tribunal.\n\t(7)\tNothing in this section—\n\t(a)\taffects the ability to register an order of the Residential Tenancies Tribunal made before the relevant day in an appropriate court, as provided for by section 120 of the principal Act before its repeal by this Act; or\n\t(b)\taffects a right to appeal to the Administrative and Disciplinary Division of the District Court against a decision, direction or order of the Residential Tenancies Tribunal made or given before the relevant day.\nResidential Parks (Miscellaneous) Amendment Act 2019, Sch 1—Transitional provisions etc\n1—Interpretation\nIn this Schedule—\npark owner has the same meaning as in the principal Act;\nprincipal Act means the Residential Parks Act 2007;\nresidential park agreement has the same meaning as in the principal Act.\n2—Application to existing residential park agreements\nExcept as provided in this Schedule, the amendments to the principal Act enacted by this Act apply to a residential park agreement whether the agreement was entered into before or after the commencement of this Act.\n3—Residents committees: 12 month exemption\nA park owner is exempt from the operation of section 7(1a) of the principal Act (as in force after the commencement of section 6(1) of this Act) for the period of 12 months after the commencement of section 6(1) of this Act.\n4—Form and content of agreements entered into before commencement\n\t(1)\tThe requirements of the principal Act (as in force after the commencement of section 10 of this Act) relating to the form and content of a residential park agreement do not apply to a residential park agreement entered into before the commencement of section 10 of this Act and the requirements of the principal Act (as in force before the commencement of section 10 of this Act) relating to the form and content of a residential park agreement will continue to apply instead.\n\t(2)\tIf, after the commencement of section 12 of this Act, a residential park agreement continues as a periodic agreement under section 17A of the principal Act or is reissued as a fixed term agreement under section 17B of the principal Act, the agreement as so continued or reissued will be treated, for the purposes of this clause, as if it were an agreement entered into after the commencement of this Act.\n5—Reissue of periodic agreements under section 17B\nA park owner who refuses or fails to comply with the requirements of section 17B(6) of the principal Act (as inserted by section 12 of this Act) during the period of 2 years after the commencement of section 17B(6) of the principal Act does not commit an offence against section 17B(11) in respect of that refusal or failure during that period.\n6—Periodic agreements under section 53\nThe repeal of section 53 of the principal Act does not affect a residential park agreement that continued as a periodic agreement under that section before that repeal.\nHistorical
