It introduces a new licensing system with two main types of licences: **radiation management licences** (for businesses or individuals who own, store, sell or possess radioactive materials) and **radiation user licences** (for individuals who actually use the materials). It also creates **accreditations** for specialised experts who advise on radiation safety and security.\n\nThe Act adds a new **security framework** specifically for high-risk radioactive sources (called 'security enhanced sources'). This requires owners to create detailed security plans, implement physical protection measures, and conduct identity and security checks on people who handle these materials.\n\nKey changes include:\n- **Stricter controls on who can handle radioactive material** — you now need specific licences for different activities\n- **New security requirements** — security plans must be reviewed by accredited experts and provided to the regulator\n- **Public transparency** — a public register of licences must be maintained and made available online and in person\n- **Stronger enforcement powers** — the regulator can impose conditions, suspend or cancel licences, and require financial assurances for clean-up works\n- **Ongoing obligations** — even after a licence is surrendered or cancelled, the former holder may still have to comply with conditions (such as remediation work)\n\nThis matters because it brings NSW into line with national security standards for radioactive materials, reducing the risk of theft or terrorism involving dangerous radioactive sources, while also ensuring proper safety standards for workers and the public."},"flash_summary":{"complexity_score":6,"scope_assessment":{"changed":true,"description":"This instrument replaces Part 2 of the principal Act and inserts a new Part 2A, expanding the statutory regime to require broad licensing and accreditation for those responsible for regulated material and introducing specific security, transport and personnel‑screening obligations for prescribed sealed radioactive sources.
