Instead, the Bill requires a photograph at the time of application/renewal in the form required by the Commission (QBCC Act s33, s37A, s37B).\n\n- Changes how contractor identity is established in contract-related recovery and enforcement provisions: references that tied liability to a licence card being imprinted on a contract are replaced by references to the contractor’s licence being included in, or attached to, the contract or to a copy of the licence being attached (QBCC Act s71, s71I, s74).\n\n- Clarifies which regulator must be notified of certain safety incidents: electrical and WHS-notifiable incidents are to be notified to the Work Health and Safety regulator (or under the Electrical Safety Act) instead of the QBCC in certain circumstances (QBCC Act s54A).\n\n- Modernises service and contact rules: documents may be served by email to the licensee’s notified email address and are treated as given on the day the email is sent (QBCC Act s109A). Licensees must notify the Commission of changes to residential address, email or phone within 14 days (new s109C) or face a penalty.\n\n- Limits investigator powers over digital devices used to store licences: investigators are not authorised, in certain circumstances, to seize a digital device when they take it only to inspect or copy a licence (QBCC Act s105L, s106, s106A).\n\n- Provides transitional arrangements so outstanding licence applications, contracts made before commencement, and certain existing matters continue under the old rules (new Schedule 1 Part 20, ss100–104).\n\n\nWho is affected\n\n- Licensed building and plumbing professionals who were issued licences as physical cards (certifiers, pool safety inspectors, plumbers, building contractors). They will need to:  \n  - provide a photograph with licence applications or renewals (QBCC Act s33, s37B);  \n  - return physical licence cards or certificates within specified timeframes when licences are suspended, cancelled, surrendered or conditions change (QBCC Act s53; Plumbing & Drainage s62, s40); and  \n  - notify the Commission of changes to contact details within 14 days (QBCC Act s109C).  \n\n- Businesses or contractors relying on historical card-imprint rules in contracts: the way a contractor’s identity is proved for recovery and enforcement now relies on inclusion/attachment of a copy of the contractor’s licence, not on a card imprint (QBCC Act s71, s71I, s74).\n\n- Investigators and the QBCC: their powers are adjusted (limits on seizing digital devices; service-by-email rules; allocation of certain safety notifications to other regulators) which changes operational procedures (QBCC Act ss105L, 106, 106A, 109A, 54A).\n\n\nWhy it matters (official purpose and practical effects)\n\n- Officially the Bill appears to tidy and modernise identification and administrative processes (photographs for identity, clearer replacement/return rules for physical licence documents, electronic service by email, and reallocation of some safety-notification responsibilities). Those are mechanical changes — they change how the system records identity, how documents move between the Commission and licensees, and which regulator receives certain notices.  \n\n- Practical trade-offs, incentives and burdens:  \n  - Compliance costs for licensees: providing required photographs, returning/insuring physical licence cards, and paying replacement fees for lost/damaged cards (see s182 and Plumbing & Drainage s42).  \n  - Administrative burden on QBCC: processing photographs, issuing/replacing cards, maintaining email service records and enforcing contact-update obligations (new s109C).  \n  - Privacy and evidence handling: limits on seizure of digital devices when they are taken only to inspect/copy licences (s105L, s106, s106A) protect devices from full seizure but require clear operational rules for inspectors.  \n  - Contract and enforcement outcomes: shifting from an imprint-on-card model to reliance on a copy of a licence attached to a contract changes what owners, contractors and courts look for when determining whether work was carried out by the licensed contractor (s71, s71I, s74). That can reduce or change the instances where a contractor is taken to have carried out work simply because a card imprint appeared on a contract.  \n  - Inter-agency coordination: certain safety notifications are directed to the WHS regulator or Electrical Safety regulator instead of the QBCC for incidents that fall within WHS/Electrical Safety definitions (s54A). That redistributes regulatory responsibilities and may reduce duplication but requires clear operational handovers.  \n\n\nImplementation and compliance risk\n\n- Transitional clauses (Schedule 1, Part 20, ss100–104) protect existing applications and pre-commencement contracts from unintended retroactive effects, reducing immediate legal uncertainty.  \n- Enforcement depends on administrative capacity: email service rules (s109A) and contact-notice penalties (s109C) are only effective if the Commission maintains accurate email records and follows the prescribed service procedures.  \n- Removing PINs and the prior photograph-request power and replacing them with mandatory photographs at application/renewal centralises identity control with the QBCC (s33, s37A, s37B), concentrating operational discretion and placing compliance costs on applicants.  \n\n\nWho pays, who decides, and what behaviour changes\n\n- Who pays: licensees bear direct costs — supplying photographs, replacement card fees, and possible penalties for failing to update contact details (QBCC Act s109C). Indirect costs include administrative time and potential delays.  \n- Who decides: the QBCC (or QBCC commissioner) retains discretion to accept replacement cards, require photographs in a particular form, and decide on service and evidence handling consistent with the new rules (see s182, s33, s109A, s105L).  \n- Behaviour changes required: maintain up-to-date contact details with the QBCC, provide photographs with applications/renewals, return physical cards/certificates when required, attach or include licence copies in contracts where relevant, and adjust to email as a primary service channel.\n\n\nKey sections to look at for specific obligations\n\n- Replacement/return of licence cards: Building Act s182; Plumbing & Drainage s42; QBCC s53.  \n- Photo requirements at application/renewal: QBCC s33, s37A, s37B.  \n- Service by email and related rules: QBCC s109A.  \n- Licensee obligation to notify contact changes: QBCC s109C (new).  \n- Restrictions on seizure of digital devices: QBCC ss105L, 106, 106A.  \n- Safety notifications allocation: QBCC s54A.  \n- Contract identification and enforcement changes: QBCC ss71, 71I, 74.  \n\n\nBottom line: This Bill focusses on administrative and evidentiary changes — clarifying and standardising how physical licence documents are handled, replacing an older PIN regime with photo-based identity evidence, enabling email service, protecting certain digital devices from seizure when only inspected for licences, and reallocating some safety-notification responsibilities. These are procedural changes that shift compliance costs to licensees and operational responsibilities to the QBCC and other safety regulators; transitional provisions preserve earlier rules for outstanding applications and pre-commencement contracts."}},"importantCases":[],"_links":{"self":"/api/acts/queensland-building-and-construction-commission-and-other-legislation-amendment-bill-2025","history":"/api/acts/queensland-building-and-construction-commission-and-other-legislation-amendment-bill-2025/history","analysis":"/api/acts/queensland-building-and-construction-commission-and-other-legislation-amendment-bill-2025/analysis","conflicts":"/api/acts/queensland-building-and-construction-commission-and-other-legislation-amendment-bill-2025/conflicts","importantCases":"/api/acts/queensland-building-and-construction-commission-and-other-legislation-amendment-bill-2025/important-cases","documents":"/api/acts/queensland-building-and-construction-commission-and-other-legislation-amendment-bill-2025/documents"}}
