It starts on 1 July 2025 (s 1–2, 5).\n- Gives the academy legal personhood: it is a body corporate, may sue and be sued, and represents the State (s 6–7). It is treated as a statutory body for financial and corruption-accountability laws (s 8).\n\n**Core functions and powers (what the academy can and must do)**\n\n- Main purpose: help emerging and elite Queensland athletes succeed at the Olympic and Paralympic Games; identify and develop future elite athletes; and collaborate with other sporting bodies (s 3).\n- Detailed responsibilities include running development programs for athletes and coaches, providing scholarships, supporting athlete wellbeing (including retirement), offering or arranging access to high‑performance facilities, partnering with other institutes and sporting organisations, and doing sports‑related research (s 9).\n- The academy may carry out normal commercial activities needed to perform its functions: enter contracts, accept gifts/bequests (subject to reporting), charge fees for services or facility access, run competitions, and let athletes from other States use its resources (s 11).\n\n**Governance and oversight (who decides)**\n\n- The academy is governed by a Board (5–8 members, up to 8) appointed by the Governor in Council on the Minister’s recommendation (s 12, 15). Board members must have relevant expertise (finance, governance, high‑performance sport, law, Olympic/Paralympic experience, or other relevant skills) (s 15(3)).\n- The Board decides which sports the academy supports and how (s 13(1)(a)). It must ensure safe, fair, healthy environments consistent with Sport Integrity Australia standards and run the academy effectively (s 13(1)(b)–(c)).\n- The Minister retains direction and oversight powers: the Minister can give written directions in the public interest (after consulting the Board), issue a statement of expectations, and the academy must report these and how it complied in its annual report (s 46–48).\n\n**Executive and staff (who runs it day to day)**\n\n- A Chief Executive Officer (CEO) runs day‑to‑day administration, hires staff and engages contractors, and is accountable to the Board. The CEO is appointed by the Governor in Council on the Minister’s recommendation, after the Minister consults the Board (s 33, 41).\n- Other staff may be employed by the academy under the Public Sector Act 2022 (s 45).\n\n**Integrity, disclosure and criminal‑history checks**\n\n- The Minister may request a criminal history report on proposed or current Board members and the CEO, but only with their written consent; those appointed must agree to the check (s 49). Board members and the CEO must notify the Minister if they are convicted of an indictable offence during their term (s 50).\n- People with access to criminal history or personal information must generally keep it confidential and destroy such reports when no longer needed (s 51, 53).\n\n**Transitional arrangements**\n\n- The Bill transfers the existing Queensland Academy of Sport business unit and its staff from the Department of Sport into the new statutory academy. Transferring employees become academy staff without losing accrued entitlements but may elect to return to the Department of Sport by 30 September 2025 (s 56–61). Existing contracts for services transfer to the academy with necessary modifications (s 61).\n\n**Official purpose claims and a practical test of costs, incentives and trade‑offs**\n\n- The Bill claims the academy will maximise Queensland athletes’ success at the Olympic and Paralympic Games by concentrating specialist support, training facilities and partnerships (s 3, 9). Mechanically, this works by funding and running programs, scholarships and facilities, and by coordinating with other sporting bodies (s 9(f)).\n\n- Who pays: the academy will be a government statutory body. Its core funding will come from the State (implicit in establishment and statutory body status). It may also raise revenue through fees, sponsorship and commercial arrangements (s 11(c),(e)). Those revenue sources can reduce reliance on taxpayer funding but create incentives to prioritise revenue‑generating activities or sponsors.\n\n- Who decides: the Board (appointed on Ministerial recommendation) decides which sports to support and how (s 13(1)(a)). The Minister retains final oversight via written directions and statements of expectations (s 46–47). That structure concentrates selection and strategic choice with a small appointed Board and the Minister.\n\n- Concentrated benefits vs diffuse costs: benefits (scholarships, facilities, specialist teams) are concentrated on selected athletes, coaches and sports chosen by the Board (s 13). Costs (state funding, possible fees for facility users) are distributed across taxpayers and other users. The selection power (which sports to support) creates a potential concentration of advantage for chosen sports and athletes.\n\n- Incentives and rent‑seeking risk: because the Board chooses which sports and how to support them (s 13(1)(a)), sporting organisations are incentivised to lobby for selection. The Bill builds in governance checks (required expertise for Board members, conflict‑of‑interest rules, disclosure obligations (s 15, 30–31)), but the mechanism for sport selection remains discretionary.\n\n- Effects on private providers and competition: the academy can enter commercial arrangements, accept sponsorship, charge for services, run competitions and provide access to facilities to non‑Queenslanders (s 11). Those powers allow it to operate like a commercial provider and potentially compete with private high‑performance coaches, facilities and sport‑service businesses. Whether competition increases or crowds out private providers depends on pricing and the academy’s use of public funding.\n\n- Compliance and administrative burden: appointment and ongoing checks for Board members and the CEO include criminal history consent, ongoing disclosure of convictions and insolvency, confidentiality obligations, and penalties for failure to disclose (s 19, 20, 49–51). The academy must report Ministerial directions and statements of expectations in its annual report (s 48). These create modest compliance tasks for Board, executive and departmental staff.\n\n- Implementation risks and opportunity costs: setting up a new statutory body requires governance, recruitment, transferring employees and contracts, and aligning records (transition Part 8, s 56–62). Those tasks consume time and administrative resources that the department and the academy must devote to establishment rather than to service delivery. The Bill requires destruction of criminal‑history reports as soon as practicable when no longer needed (s 51(4)), a requirement that may conflict with public records management norms and will need careful operational design.\n\n**Trade‑offs in one paragraph**\n\nThe Bill centralises selection and support for Olympic/Paralympic high‑performance activity in a new, publicly accountable statutory body with board governance and ministerial oversight. That creates a concentrated decision‑maker able to deliver specialist teams, scholarships and facilities (which supports focused elite development) but imposes recurring public cost, gives rise to selection incentives for sporting bodies, and may compete with private providers where the academy charges fees or runs events (s 9, 11, 13, 46–48). The practical outcomes will depend on the Board’s choices about which sports to back, fee and sponsorship strategies, and how the academy uses its statutory powers.\n\n**Key operational points to watch during implementation**\n\n- How the Board chooses sports and distributes support (s 13(1)(a)).\n- Details of fees and commercial arrangements and whether those displace or complement private providers (s 11(c),(e)).\n- Practical handling of criminal‑history material and the intersection with record‑keeping law (s 49–51, cf Public Records Act 2023).\n- Transition of staff and contracts from the Department of Sport and employee choices to return (s 59–61).\n\n(References in parentheses are to the section numbers in the Bill.)"}},"importantCases":[],"_links":{"self":"/api/acts/queensland-academy-of-sport-bill-2025","history":"/api/acts/queensland-academy-of-sport-bill-2025/history","analysis":"/api/acts/queensland-academy-of-sport-bill-2025/analysis","conflicts":"/api/acts/queensland-academy-of-sport-bill-2025/conflicts","importantCases":"/api/acts/queensland-academy-of-sport-bill-2025/important-cases","documents":"/api/acts/queensland-academy-of-sport-bill-2025/documents"}}
