The Regulation sets the fees ($1,100 for new applications and renewals, with higher fees for late renewals), requires criminal record checks for applicants, and sets conditions like displaying the licence at the point of sale and notifying authorities of certain offences.\n\n- **How products can be displayed**: Tobacco products generally cannot be displayed where customers can see them. However, \"authorised products\" (like vaping products that meet certain criteria) can be displayed. Wholesalers are exempt from some retail display rules.\n\n- **Price display rules**: If retailers want to show prices, they must follow strict rules—using only black and white, specific sizes (no bigger than a small price ticket or a single board), and plain fonts. No flashy colours or lighting allowed.\n\n- **Packaging restrictions**: Tobacco packages cannot have images of people, cartoons, or claims about success, sex, or business. They must include health warnings covering at least one-quarter of any advertising space.\n\n- **Signage requirements**: Shops must display health warnings and notices stating that selling to minors is illegal. These must be specific sizes and colours (white background, black text).\n\n- **Seizure and disposal of illegal goods**: Sets out procedures for when authorities seize illegal tobacco or vaping products, including who can issue certificates and requirements for notifying owners before disposal.\n\n- **Penalties**: Lists offences that can be dealt with by penalty notices (on-the-spot fines) rather than going to court, with fines ranging from $250 to $22,000 depending on the offence and whether the offender is an individual or corporation.\n\n**Who it affects:** Tobacco retailers, wholesalers, registered clubs, and anyone involved in the supply chain of tobacco and smoking products in NSW."},"flash_summary":{"complexity_score":7,"scope_assessment":{"changed":true,"description":"This Regulation replaces the 2016 Regulation and expands administrative and enforcement detail.
