It affects professionals in licensed occupations whose associations adopt a scheme, their clients (whose recoveries may be limited), and the associations that must raise standards to qualify.\n\nThe bill balances limiting individual liability to help affordability of practice and insurance against protecting public compensation for harm, by linking caps to genuine professional-improvement measures."},"flash_summary":{"complexity_score":7,"scope_assessment":{"changed":true,"description":"The Act's practical scope has been broadened and operationally clarified by later amendments. The 2016 amendments (No. 49 of 2016) significantly expanded scope to create a national mutual recognition framework. The Act now accommodates 'interstate schemes' that operate across multiple jurisdictions, requires coordination with 'appropriate councils' in other states, and includes complex provisions for terminating interstate scheme operation in Tasmania. It's a trade-off: professionals get protection from massive lawsuits, but in return they must maintain proper insurance, meet higher professional standards, and be subject to complaints and discipline.\n\n**Who it affects:**\n\n- **Members of occupational associations** — accountants, engineers, architects, and other professionals who join a recognised body\n- **Consumers/clients** — people who hire these professionals (they get some protection through mandatory insurance and standards, but their ability to sue for large amounts is limited)\n- **The Professional Standards Council** — an 11-member government body that supervises these schemes\n\n**How the liability cap works:**\n\nA scheme can limit damages in several ways:\n- **Insurance-based cap** — if the professional has insurance covering at least the cap amount, they can't be sued for more than that cap\n- **Asset-based cap** — if they have enough business assets to cover the cap amount\n- **Fee-multiple cap** — liability limited to a multiple of what they charged for the work (with a minimum floor of $500,000)\n\n**Important limits:**\n\nThe Act **does NOT apply** to:\n- Death or personal injury claims\n- Legal negligence in personal injury cases\n- Fraud, dishonesty, or intentional wrongdoing\n- Breach of trust\n- Contracts made before the scheme started (unless updated)\n\n**Key protections for consumers:**\n\n- Professionals must **tell clients upfront** that their liability is limited (on all documents and verbally if asked)\n- Must provide a copy of the scheme if requested\n- Must maintain proper insurance to the standards set by their association\n- Associations must have complaints and disciplinary systems\n\n**Why it matters:**\n\nThis tries to solve a real problem: professional indemnity insurance was becoming unaffordable or unavailable for some occupations. By capping liability, insurance becomes more available and affordable. But it balances this with mandatory disclosure, insurance requirements, and professional standards to protect the public."}},"importantCases":[],"_links":{"self":"/api/acts/professional-standards-act-2005","history":"/api/acts/professional-standards-act-2005/history","analysis":"/api/acts/professional-standards-act-2005/analysis","conflicts":"/api/acts/professional-standards-act-2005/conflicts","importantCases":"/api/acts/professional-standards-act-2005/important-cases","documents":"/api/acts/professional-standards-act-2005/documents"}}
