The Authority may also own, buy and sell property (s 7).\n\n- Provides governance arrangements: a Board made up of named categories of members (industry/economic development, three private forest growers (one industrial, two non‑industrial), a science expert, and the CEO), appointment and meeting rules, duties for directors and penalties for wrongdoing, and protections from personal liability for directors acting in good faith (ss 8–15, Schs 2–4, ss 34–37).\n\n- Creates management and planning rules: the Minister issues a written ministerial charter setting broad policy expectations (ss 19A–19C). The Board must prepare a corporate plan (covering at least 3 years) and a statement of corporate intent; the Board must consult and obtain Minister/Treasurer approval in specified ways (ss 19D–19F, 19E). The Authority must produce annual and financial reports and provide them to the Minister and Auditor‑General (ss 32A–32E, 32F).\n\n- Establishes financial arrangements: the Authority can hold funds, open bank accounts, invest temporarily, establish reserves, borrow from the Treasurer or others (subject to Treasurer limits), provide loans, grants and guarantees for private commercial forestry and sustainable land management (ss 20–29, 26–31). Limits and procedural approvals apply (e.g. Treasurer approval for assistance, borrowing caps and conditions) (ss 24–29).\n\n- Creates a targeted levy on owners of certified forest practices plans for private commercial harvesting (a \"private forest service levy\"). The levy is calculated as a levy rate (set annually by the Minister after consultation) multiplied by the nett hectares shown on a prescribed certified forest practices plan; it is payable within six months of certification; penalties and recovery mechanisms apply for late payment (ss 25B–25J, 25I). The Authority may waive levies in circumstances it determines (s 25K).\n\n- Allows the Authority to enter joint ventures, take covenants limiting land use for forestry purposes, and to impose charges for advice provided (ss 30, 33, 31).\n\n\nWho is affected and who pays, decides or enforces\n\n- Who pays: Owners of private land where a certified forest practices plan identifies a nett area of forest operation must pay the private forest service levy when the plan is a \"prescribed certified\" plan; levy amount = levy rate × nett hectares (ss 25C–25D). The levy can be reclaimed or waived in particular cases (ss 25J, 25K).\n\n- Who decides: The Minister appoints most directors (after consulting forest owners organisations), issues the ministerial charter and may give written directions on corporate plans and financial objectives; the Minister also determines the annual levy rate after consulting forest owners organisations (ss 8(2), 19A–19C, 19E, 25I). The Treasurer has control over borrowing limits, may lend to the Authority and must approve financial assistance under certain sections (ss 24, 26, 25). The Board runs the Authority in accordance with sound commercial practice and must comply with the ministerial charter and approved corporate plan (ss 9, 19C, 19D).\n\n- Who enforces: The Authority notifies owners of levy amounts and may recover unpaid levies and penalties as a debt in court; it administers grants/loans and enforces covenants and contractual terms (ss 25E–25G, 26–28, 33).\n\n\nWhy it matters (stated purposes and practical implications)\n\n- Stated purpose: to facilitate and expand development of private forest resources consistent with sound forest land management (Sch 1 cl 1). The Act implements structures and tools (advice, planning, finance, levies) to pursue that objective.\n\n- Costs and incentives: The levy shifts a predictable share of the cost of certain private‑forest services onto owners who lodge certified plans (ss 25B–25D). Financial assistance (grants, loans, guarantees) lowers the up‑front cost for participating growers but is subject to Treasurer approval and aggregate caps (ss 26–29). The Authority can contract, take security and enter joint ventures, creating opportunities for private capital or state‑backed finance but also concentrated benefit to recipients of assistance (ss 26–30).\n\n- Ministerial and Treasury discretion: The Minister and Treasurer have several control levers — appointment of directors, ministerial charter, directions on corporate plans and financial objectives, levy rate setting, and approval of loans — meaning policy and financial priorities are centrally influenced (ss 8(2), 19A–19E, 25I, 24, 26). That concentrates decision authority in executive hands while requiring formal consultation with forest owners organisations for appointments and levy setting (ss 8(2), 25I).\n\n- Compliance and administration burdens: Private forest owners seeking to harvest under a certified plan must factor the levy (levy = hectares × rate), payment timing (within 6 months), and penalties for late payment (20% p.a.) into project economics; they may also face conditions attached to financial assistance and covenants limiting alternative land uses (ss 25D, 25F–25G, 26–27, 33).\n\n- Market effects and trade‑offs: The Act aims to expand private forestry and foster competitive markets (Sch 1). Mechanically, it does this by (a) providing targeted services and funding, (b) levying those who benefit from certification, and (c) promoting infrastructure and market development. These measures lower some barriers to entry or expansion (via advice and finance) but impose an additional per‑hectare charge on landowners with certified harvest plans. Who benefits (recipients of grants/loans, industry participants, forest owners organisations that are consulted) and who bears the costs (owners of certified areas) are clearly defined in the statute (ss 26, 25C–25D, Sch 1).\n\n\nTrade‑offs, risks and implementation points to watch (mechanisms, not judgments)\n\n- Concentrated benefits vs diffuse costs: Financial assistance and grants deliver concentrated support to particular owners or projects; the levy spreads cost among owners who certify their harvesting plans. The net incidence depends on how levy proceeds are used (s 20 sets funds usage) and what financial assistance is offered (ss 26–27).\n\n- Political/administrative discretion: Ministerial directions, charter powers and Minister/Treasurer approvals embed significant discretion (ss 19A–19C, 19E, 24, 26). Those discretionary powers create implementation risk (policy shifts when ministers change) and impose compliance obligations on the Board.\n\n- Compliance and enforcement friction: The Authority enforces the levy by court recovery and applies a high statutory interest/penalty rate for late payment (20% p.a.), which can materially affect an owner's cash flow if payment dates are missed (ss 25F–25G).\n\n- Cross‑law interactions: The levy and other duties sit alongside the Forest Practices Act and Forest Management Act (multiple cross references throughout the levy Division and functions) and depend on certified forest practices plans and definitions in those Acts (s 25B and cross‑refs). That produces operational complexity for landowners and for the Authority when plans, variations or revocations occur (ss 25B, 25C, 25H, 25J).\n\n- Administrative overheads: The Act requires detailed planning, reporting and audit compliance (corporate plan, statement of corporate intent, annual report, Auditor‑General reporting) and alignment with Treasurer directions and Australian Accounting Standards (ss 19D–19F, 32A–32E). Those duties raise administrative costs for a small agency.\n\n\nKey sections to look at quickly if you need the detail: establishment and objects (ss 4–6, Sch 1), board composition and duties (ss 8–15, Schs 2–4), ministerial charter and corporate planning (ss 19A–19H, 19D–19F), levy mechanics (ss 25B–25J, 25I), financial assistance and limits (ss 26–29), reporting and audit (ss 32A–32E)."},"summary":{"complexity_score":5,"scope_assessment":{"changed":true,"description":"Originally enacted in 1994 to establish a framework for private forestry in Tasmania, the Act has been amended multiple times over 30 years (as indicated by the Table of Amendments reference).
