These Regulations may be cited as the Primary Producers Relief Regulations 1938.\n\nInterpretation.\n\n2. — (1.) In these Regulations, “the Act” means the States Grants (Fertilizer) Act 1937.\n\n(2.) In these Regulations, any reference to a Form shall be read as a reference to a Form contained in the Schedule to these Regulations.\n\nForm of application for certificate under s. 5 of Act.\n\n3. An application by a primary producer in a State for a certificate under section 5 of the Act shall be in accordance with Form A, and shall be supported by—\n\n(a) a declaration by the applicant in the form contained in that Form; and\n\n(b) a certificate, in the form contained in that Form, signed by the supplier of the artificial manure or by any person employed by that supplier and authorized in accordance with regulation 12 of these Regulations.\n\nForm of certificate under s. 5 of Act.\n\n4. The certificate referred to in section 5 of the Act shall be in accordance with Form B.\n\nForm of application under s. 6.\n\n5. An application by a primary producer for payment of any amount claimed under section 6 of the Act shall be in accordance with Form C, and shall be supported by—\n\n(a) a declaration by the claimant in the form contained in that Form; and\n\n(b) a certificate, in the form contained in that Form, signed by the supplier of the artificial manure or by any person employed by that supplier and authorized in accordance with regulation 12 of these Regulations.\n\n\\* Notified in the Commonwealth Gazette on , 1938.\n\n528.—6/4.3.1938.—Price 8d \n\nForm of application by State.\n\n6.— (1.) An application by a State for payment of any amount claimed under section 7 of the Act shall be in accordance with Form D.\n\n(2.) The application shall be made by the Permanent Head of the Department by which the artificial manure was used or supplied.\n\nForm of application by approved organization.\n\n7. An application by an approved organization for the prescribed certificate referred to in paragraph (iii) of the proviso to section 7 of the Act shall be made by the Chairman or Secretary of the organization in accordance with Form E and shall be supported by a declaration in the form contained in that Form.\n\nForm of certificate under s. 7 of Act.\n\n8. The certificate referred to in sub-paragraph (1.) of paragraph (iii) of the proviso to section 7 of the Act shall be in accordance with Form F.\n\nDeclarations in applications.\n\n9. A declaration in any application lodged in pursuance of these Regulations shall be made before a Commissioner for Declarations, a Justice of the Peace, Bank Manager, Postmaster (or officer in charge of a Post Office), Station Master (or other railway official in charge of a Station or Siding), or a Constable or Officer of Police.\n\nWhere applications to be lodged.\n\n10. Where two or more primary producers (such as share-farmers, partners, co-owners and the like) have jointly used artificial manure in the production of primary produce other than wheat, applications made by them under these Regulations shall be signed by each of them, and Forms A, B and C may be altered to such extent as is necessary to meet the circumstances.\n\nCertificates by employees.\n\n12. —(1.) The supplier of any artificial manure may, in accordance with Form G, authorize any person who is employed by that supplier to sign the certificate referred to in paragraph (b) of regulation 3 or paragraph (b) of regulation 5 of these Regulations, and any certificate so signed shall be deemed for all purposes to be of the same effect as if it had been signed by the supplier.\n\n(2.) A copy of every authority referred to in the last preceding sub-regulation shall be forwarded by the supplier to the Secretary of the Department of Commerce.\n\nTHE SCHEDULE.\n\nForm A. Reg. 3.\n\nCommonwealth of Australia.\n\nStates Grants (Fertilizer) Act 1937\n\nPrimary Producers Relief Regulations 1938.\n\nAPPLICATION FOR CERTIFICATE OF THE SECRETARY OF THE DEPARTMENT OF COMMERCE IN RESPECT OF ARTIFICIAL MANURE USED BY A PRIMARY PRODUCER BETWEEN 1st JULY, 1937, AND 30th JUNE, 1938.\n\nNote.—Payments may be made to primary producers at the rate of 10s. per ton of artificial manure used by primary producers during the year ending on the thirtieth day of June, 1938, in the production of primary produce other than wheat.
