Useful for temporary situations (for example, someone managing your affairs while you travel).\n\n2. **Enduring powers of attorney** — Continue to work even if you later lose mental capacity. Because these involve vulnerable people, they have strict safeguards to prevent abuse.\n\n**Key requirements**\n\n- **Registration**: A power of attorney has no legal effect in Tasmania unless it is registered with the Recorder of Titles. You cannot use an unregistered power to transfer property or sign binding documents.\n- **Strict formalities**: Documents must follow specific rules about witnessing (who can watch you sign), paper size, how pages are attached, and which forms to use. Enduring powers need two independent witnesses who are not family members or the attorney.\n- **Attorney duties**: Attorneys under enduring powers must:\n - Act in your best interests\n - Keep their own money completely separate from yours (penalties apply if they don't)\n - Keep detailed records for 7 years\n - Avoid conflicts of interest (they generally cannot benefit themselves unless the document specifically allows it)\n\n**Protection against abuse**\n\n- **Tribunal oversight**: The Tasmanian Civil and Administrative Tribunal can review enduring powers, suspend attorneys who are acting improperly, appoint replacement attorneys, and order audits of financial records.\n- **Personal decisions excluded**: Attorneys under enduring powers generally cannot decide where you live, who you associate with, your health care, or whether you marry — these remain personal rights unless specifically handled under other laws.\n- **Good faith protection**: People who honestly deal with an attorney without knowing the power has been cancelled are generally protected.\n\n**Interstate and overseas powers**\n\nThe Act recognizes powers of attorney made in other Australian states or overseas, allowing them to be registered and used in Tasmania if they meet basic validity requirements.\n\n**Why it matters**\n\nThis law lets people plan for future incapacity (such as dementia) by choosing who will manage their finances, while building in safeguards to prevent financial abuse of vulnerable adults. It ensures there is a public record of who has authority to act for others and provides a process to investigate and stop misuse of that authority."},"flash_summary":{"complexity_score":7,"scope_assessment":{"changed":true,"description":"The Act's scope has expanded since the original statute through amendments that add explicit enduring power rules, Tribunal oversight and interim suspension powers (s33), express duties and record-keeping for attorneys (s32; s32AD), conflict/benefit limits (s32AB; s32AC), electronic lodgment and certified-copy pathways (s12–14; s44–45), and a prescribed fee regime (s55A & Schedule 2).
