It requires signing and witnessing, lets interstate powers be recognised, makes registration necessary for valid land dealings, prescribes fees and approved forms, and gives the Local Court oversight (including audit, variation and substitution) of enduring powers. It matters to donors, donees, third parties, the Registrar‑General and the Court because registration, witnessing and record‑keeping create legal effect, compliance obligations and administrative fees."},"flash_summary_failed":{"failed":true,"reason":"A positive credit balance is required for all requests, including BYOK, so fallback providers remain available. Originally designed to create and regulate all enduring powers of attorney, it now functions primarily as a transitional framework. Since the commencement of the Advance Personal Planning Act 2013, new enduring powers cannot be created under this Act — it only governs enduring powers made before February 2014 and recognises interstate powers. The Act has effectively been superseded for its core enduring power function by the advance personal planning regime, transforming it from a comprehensive powers-of-attorney statute into a historical maintenance and recognition statute."},"complexity_factors":["Moderate cross-referencing with at least 5 other Acts (Advance Personal Planning Act 2013, Guardianship of Adults Act 2016, Public Trustee Act 1979, Registration Act 1927, Aged and Infirm Persons' Property Act 1979)","Transitional complexity: The Act is in a 'sunset' phase for enduring powers — it no longer allows creation of new enduring powers but maintains complex rules for pre-2014 powers and interstate powers","Nested conditional logic in revocation provisions (sections 16-19) with multiple exceptions (e.g., irrevocable powers securing proprietary interests)","Dual registration systems — different rules apply for land dealings vs other transactions (30-day waiting periods vs immediate effect)","Approximately 15 defined terms in section 5, some referring to definitions in other legislation","Multiple amendment layers (16 amending Acts since 1980) creating fragmented historical context in the endnotes"],"plain_english_summary":"**What this law does:**\n\nThis is the Northern Territory's law about **powers of attorney** — legal documents that let one person (the \"donor\") give another person (the \"donee\" or attorney) the power to make decisions or sign documents on their behalf.\n\n**Key things it covers:**\n\n*   **Creating a power:** Sets out how to properly sign and witness these documents (including who can be a witness — lawyers, police officers, Justices of the Peace, etc.).\n*   **Registration:** Allows powers of attorney to be registered with the government, which is required for dealing with land (except short-term leases).\n*   **Enduring powers:** Special rules for \"enduring\" powers that continue even if the donor loses mental capacity. **Important:** New enduring powers can no longer be created under this Act — the NT now uses \"advance personal plans\" under a different law (the *Advance Personal Planning Act 2013*). This Act only manages enduring powers made before 2014 and interstate enduring powers.\n*   **Interstate recognition:** Recognises powers of attorney made in other Australian states and territories as if they were made in the NT.\n*   **Revocation:** Explains when powers automatically end (death, bankruptcy, mental incapacity) and how to revoke them.\n*   **Protections:** Protects attorneys and third parties (like banks or buyers) who act in good faith without knowing a power has been cancelled.\n*   **Court oversight:** Gives the Local Court power to review enduring powers, order accounts to be produced or audited, and appoint substitute attorneys if needed.\n\n**Who it affects:**\n\nAnyone in the NT who wants to give someone else authority to handle their affairs, attorneys acting under these documents, people buying property from attorneys, and the courts overseeing these arrangements.\n\n**Why it matters:**\n\nIt provides the legal framework for managing other people's money and property — which is essential for elderly care, disability support, and property transactions — while building in safeguards against abuse."}},"importantCases":[],"_links":{"self":"/api/acts/powers-of-attorney-act-1980","history":"/api/acts/powers-of-attorney-act-1980/history","analysis":"/api/acts/powers-of-attorney-act-1980/analysis","conflicts":"/api/acts/powers-of-attorney-act-1980/conflicts","importantCases":"/api/acts/powers-of-attorney-act-1980/important-cases","documents":"/api/acts/powers-of-attorney-act-1980/documents"}}
