The scope aligns with the traditional purpose of the Police Offences Act 1935—regulating public order, alcohol consumption in public places, vehicle offences, and organised crime (motorcycle gangs). The addition of Regulation 8A (prescribed places) appears to be a contemporary expansion but fits within the existing framework of the Act rather than representing mission creep. The geographical specificity (naming particular Hobart parks and squares) is typical for subordinate legislation of this type."},"complexity_factors":["Multiple cross-references to the Police Offences Act 1935, Vehicle and Traffic Act 1999, Road Safety (Alcohol and Drugs) Act 1970, Public Health Act 1997, and Passenger Transport Services Act 2011","Nested conditional logic for liquor bans: different rules apply to different places with different time periods, including seasonal variations (Christmas/New Year period vs rest of year)","13 separate geographical areas defined in Schedule 1 with detailed land descriptions referencing survey plans and lot numbers","Regulation 8A contains 5 defined terms with their own sub-definitions, creating a layered definitional structure","Regulation 6 contains a 'previous conviction' trigger clause requiring police to check prior charging history before vehicle confiscation powers apply","Schedule 3 contains a detailed table of 33 offences with corresponding penalty units, requiring cross-referencing with the parent Act"],"plain_english_summary":"This is a Tasmanian regulation that sets out specific rules for enforcing the Police Offences Act 1935. It does four main things:\n\n**1. Bans drinking alcohol in certain public places**\n- **Always banned**: Franklin Square, Glenorchy Council Memorial Gardens, North Hobart Cultural Park and Skate Park, and St Davids Park. You cannot drink alcohol in these places at any time.\n- **Sometimes banned**: Places like the Hobart Regatta Grounds, Parliament House Grounds, Salamanca Lawns, and several parks have restricted hours. For most of these, you can't drink between 8pm and 8am daily. For Parliament House Grounds, Salamanca Lawns and Tasman Monument, the restrictions are tighter during the Christmas/New Year period (3pm to 10am the next day).\n\n**2. Allows police to confiscate or clamp vehicles for serious offences**\n- Police can take action against vehicles used in serious traffic offences, specifically:\n - Dangerous driving (if the driver has previous serious driving or drink/drug driving convictions)\n - Speeding by 45km/h or more over the limit\n- Police can use speed camera photos as evidence for these speeding offences.\n- The special penalty for these vehicle confiscations is set at 4 penalty units (a standard fine amount).\n\n**3. Names outlaw motorcycle clubs as \"identified organisations\"**\n- Seven specific motorcycle clubs are listed: Outlaws, Rebels, Bandidos, Black Uhlans, Devil's Henchmen, Nomads, and Finks.\n- This triggers special police powers under the Act regarding these groups.\n\n**4. Defines \"prescribed places\" where certain public order offences carry heavier penalties**\n- These include public transport areas (bus stops, airports, ferry wharves), shopping centres, schools and universities, hospitals, sports venues, licensed premises, places of worship, and their car parks.\n- Committing certain offences in these locations results in more serious consequences.\n\n**Other details:**\n- Sets the fee for certain permits at 26 fee units\n- Sets insurance requirements for permits ($10-15 million depending on event type)\n- Allows infringement notices (on-the-spot fines) for 33 different offences under the Act, with penalties ranging from 0.5 to 10 penalty units\n- Expands who can be \"prescribed persons\" with certain powers to include Biosecurity and Nature Conservation officers"},"summary":{"complexity_score":2,"scope_assessment":{"changed":false,"description":"It is not possible to assess whether the scope changed from the original intent, as the substantive content of the regulations was not included in the provided text.
