The specific types will be set by regulation (Planning Act, new ch 3 pt 6B, esp. s 106T).\n- Requires an applicant for such development (and for most non-minor change applications affecting such development) to lodge a social impact assessment report and to enter into or provide any required community benefit agreements with affected local governments or prescribed public bodies for the areas affected (Planning Act s 51(4), s 79(3), ss 106V–106Z).\n- Creates a statutory form of “community benefit agreement” (CBA) (s 106Y) that can substitute for infrastructure agreements and some approvals to the extent of inconsistency (s 106ZD). CBAs must include matters prescribed by regulation and bind owners in prescribed ways (s 106Z(4), applied provisions).\n- Gives the chief executive broad administrative powers: to exempt an application from needing a report or a CBA (s 106ZE), to direct an assessment manager or other decision-maker to impose community-benefit conditions (s 106ZF), to nominate enforcement authorities (s 106ZG) and to publish reports of directions (s 106ZH).\n- Permits local governments to charge fees for considering social impact reports and negotiating CBAs (s 106ZM) and allows conditions on approvals to require community infrastructure, monitoring or mitigation of social impacts (s 65AA).\n- Limits third‑party appeal rights against: (a) conditions imposed under the new social-impact condition rules or under chief executive directions and (b) failures to impose such conditions (s 106ZJ). It also restricts who may bring declaratory proceedings in the Planning and Environment Court about the content of social impact reports/CBAs and related conditions (Planning & Environment Court Act, new s 12A).\n- Inserts an enforcement framework and definitions (enforcement authority rules in new s 160A), and tweaks cost-recovery and fee registers in local government/City of Brisbane Acts to reflect the new fees.\n\n- Separately, the Bill makes substantial amendments to the Brisbane Olympic & Paralympic Games Arrangements Act 2021 to facilitate delivery of venues and transport infrastructure for Brisbane 2032. These include:\n  - Re-classifying and listing authority venues, other venues and villages and describing games-related and legacy uses (new ss 5A–5D and Schedules 1–4).\n  - Declaring many games-related developments, uses and activities lawful despite non-compliance or conflict with a long list of other Acts (including environmental, heritage, coastal, vegetation, water and native-title related Acts) and stating that compliance requirements under those Acts are taken to have been met (ss 53DC–53DD). There are carve-outs for building work compliance (ss 53DE–53DF).\n  - Creating a bespoke cultural-heritage process for games projects: a proponent-led negotiation to produce a “part 3 plan” (an approved cultural heritage management plan if signed), with prescribed negotiation steps, mediation by the Land Court, and a statutory default plan if negotiations fail. If a part 3 plan or default plan takes effect, carrying out the works in accordance with it removes cultural-heritage offence exposure (ss 53DI–53DX and Schedule 5).\n  - Preventing stop orders under cultural heritage Acts and applications for injunctions to stop games projects in many circumstances (s 53DU), and declaring State immunity from prosecution for acts/omissions under the part in relation to cultural heritage (s 53DX).\n  - Enabling Ministers to require owners/operators of necessary games infrastructure to provide or maintain that infrastructure and to bear costs of complying with directions (ss 53EA–53EB).\n  - Allowing the Minister to impose a new “village infrastructure charge” on landowners for village-related infrastructure (ss 53EC–53EE).\n  - Making many decisions final and largely immune from judicial review except on jurisdictional error (s 53EG).\n\nWhat the Bill says it is for (official purpose-claims)\n\n- Chapter 2 (Planning): the Bill frames these changes as creating a system to assess, mitigate and manage the social impacts of certain developments and to secure community benefits through negotiated agreements (see Bill structure: \"Social impact and community benefit amendments\").\n- Chapter 4 (Games): the Bill’s stated purpose is to facilitate timely delivery of venues, villages and transport infrastructure for Brisbane 2032 and to protect the State's ability to meet games-related obligations and legacy outcomes (see new Planning & Games provisions, e.g. ss 53DA, 53AE).\n\nTesting those claims against practical effects, trade-offs and incentives\n\n- Who pays and who benefits:\n  - Direct costs fall mainly on developers/landowners required to prepare social impact assessment reports, negotiate CBAs, and potentially pay contributions or provide infrastructure (see s 106W, s 106Z, s 106ZL). Local governments (and prescribed public bodies) can be paid and are entitled to charge fees for negotiating and considering reports (s 106ZM).\n  - The Bill channels benefits to local communities and local governments in the form of CBAs and infrastructure contributions (s 106Y, s 65AA(3)). These benefits are concentrated and identifiable; costs are borne by applicants, landowners and possibly infrastructure owners directed to act (ss 53EB, 53EE).\n\n- Compliance burden and transaction costs:\n  - Developers face new upfront costs (preparing reports that must meet regulatory requirements and public‑consultation rules (s 106W)), negotiation time and possible mediation. Local governments will need processes to assess reports and negotiate CBAs and can recover fees (s 106ZM) but will also need capacity to negotiate and monitor agreements.\n  - The regime creates additional documentary and timing requirements for change notices and amendments (ss 52A, 106X, 106ZA), which can extend project timelines if not anticipated.\n\n- Bureaucratic discretion and centralisation of decision-making:\n  - The chief executive has powers to exempt applications from reports/CBAs (s 106ZE), to direct imposition of community benefit conditions (s 106ZF) and to nominate enforcement authorities (s 160A, s 106ZG). Those are significant discretionary interventions that can change outcomes for an application regardless of local negotiation.\n  - For games projects, Ministerial directions can compel infrastructure entities to provide/maintain infrastructure and to bear costs (s 53EB). The State can also declare developments lawful despite non-compliance with many Acts (s 53DD), which centralises approval outcomes.\n\n- Effects on legal checks, competition and judicial oversight:\n  - The Bill restricts third-party appeal rights (s 106ZJ) and narrows declaratory jurisdiction in the P&E Court for social-impact and CBA matters (new Planning & Environment Court Act s 12A). For games-related decisions it creates finality and limits judicial review except for jurisdictional error (s 53EG). Those changes reduce usual avenues for third parties, stakeholders and courts to challenge or review planning decisions.\n  - Limiting appeal and review could speed project delivery but reduces external legal checks and may concentrate decision power with the executive and administrative agencies.\n\n- Cultural heritage and legal risk allocation:\n  - The Bill creates a tailored negotiation/mediation regime for cultural heritage (part 3 plan) with a statutory default plan if negotiations fail (ss 53DI–53DS). Once a plan or default plan takes effect, carrying out works in accordance with it removes cultural heritage offence exposure (s 53DT). The Bill also bars stop orders and certain injunctions (s 53DU) and declares the State not liable to prosecution for acts/omissions under the part in relation to harm to cultural heritage (s 53DX). These are heavy legal changes transferring risk allocation away from procedural and criminal cultural heritage safeguards toward negotiated planning instruments.\n\n- Opportunity costs and substitution effects:\n  - Projects that become subject to social impact assessment may divert developer resources from other project elements, or lead to substituting community contributions for other infrastructure funding mechanisms (s 65AA(7)).\n  - For the Games, the Bill substitutes fast-tracked statutory regimes and negotiated cultural‑heritage plans for standard approvals, which may shift the nature of community engagement and dispute resolution.\n\n- Implementation risk:\n  - Much detail is deferred to regulation (s 106T, s 106ZM, ss 53ED, etc.). Success depends on timely regulations and guidance (the chief executive may make guidelines for reports (s 106W(2))).\n  - Local governments and proponents must develop new internal capabilities for assessing social impact reports and negotiating CBAs; inadequate capacity could produce delays or inconsistent outcomes.\n\nPlain statement of decision-making and behavioural effects\n\n- Who decides: the chief executive, the Minister, assessment managers, local governments and prescribed public entities—all obtain new formal roles and some expanded discretion (e.g. ss 106ZE–106ZH; ss 53EA–53EB).\n- Who pays: applicants/developers and landowners (fees, contributions, village infrastructure charges—ss 106ZM, 53EE); infrastructure entities may be directed to bear costs (s 53EB). Local governments can charge fees and receive contributions (s 106ZM, s 106ZL).\n- Behaviour changes likely: developers will incorporate social-impact analysis and negotiations into project planning; local governments may seek contributions via CBAs; proponents for games projects will use the new cultural-heritage negotiation pathway; affected infrastructure owners will face requests or directions to provide access or maintenance.\n\nKey statutory citations (representative):\n- Social impact pathway and requirements: Planning Act new ch 3 pt 6B (ss 106R–106ZM), ss 51(4)–(6), 52A, 65AA, 79(3).\n- Chief executive powers: ss 106ZE–106ZH, 106ZF.\n- Appeal and judicial limits: Planning Act s 106ZJ; Planning & Environment Court Act new s 12A.\n- Games lawfulness and override: Games Act ss 53DC–53DD, ss 53DE–53DF (building work), ss 53EA–53EB (infrastructure directions), ss 53DI–53DX (cultural heritage plans), s 53EG (finality).\n\nBottom line (practical snapshot):\n- The Bill establishes a mandatory social impact process for specified categories of development, creates a statutory vehicle (CBAs) for securing local community benefits, increases central administrative powers (chief executive and Minister), and narrows judicial and third‑party review for those matters.\n- Separately, the Bill contains comprehensive, pro‑delivery powers for Brisbane 2032 projects that can override other statutory regimes, create bespoke cultural heritage procedures with default plans and limit court intervention—while imposing new duties and potential costs on infrastructure owners and landholders.\n\n"}},"importantCases":[],"_links":{"self":"/api/acts/planning-social-impact-and-community-benefit-and-other-legislation-amendment-bill-2025","history":"/api/acts/planning-social-impact-and-community-benefit-and-other-legislation-amendment-bill-2025/history","analysis":"/api/acts/planning-social-impact-and-community-benefit-and-other-legislation-amendment-bill-2025/analysis","conflicts":"/api/acts/planning-social-impact-and-community-benefit-and-other-legislation-amendment-bill-2025/conflicts","importantCases":"/api/acts/planning-social-impact-and-community-benefit-and-other-legislation-amendment-bill-2025/important-cases","documents":"/api/acts/planning-social-impact-and-community-benefit-and-other-legislation-amendment-bill-2025/documents"}}
