1","sectionType":"part","heading":"Preliminary","content":"Part 1—Preliminary\n\n\t1 Purposes\n\nThe main purposes of this Act are—\n\n(a) to provide for the regulation of pharmacy businesses, pharmacy departments and pharmacy depots; and\n\n(b) to establish the Victorian Pharmacy Authority.\n\n\t2 Commencement\n\n(1) Subject to subsection (2), this Act comes into operation on a day or days to be proclaimed.\n\n(2) If a provision of this Act does not come into operation before 1 July 2011 it comes into operation on that day.\n\n\t3 Definitions\n\n(1) In this Act—\n\nS. 3(1) def. of *Australian lawyer* repealed by No. 17/2014 s. 160(Sch. 2 item 70).\n\n* * * * *\n\n***authorised person*** means a person authorised under section 65 to carry out functions and exercise powers under Part 4;\n\n***Authority*** means the Victorian Pharmacy Authority established under this Act;\n\n***Authority standard*** means a standard published by the Authority under section 86;\n\n***commencement day*** means the date of commencement of Part 3;\n\n***condition*** includes limitation or restriction;\n\n***Fund*** means the Victorian Pharmacy Authority Fund established under this Act;\n\n***licence*** means a licence granted or taken to be granted under Part 3 by the Authority to an eligible person to carry on a pharmacy business or pharmacy department;\n\n***licensee*** means a person who holds a licence to carry on a pharmacy business or pharmacy department;\n\nS. 3(1) def. of *medicine* inserted by No. 20/2016 s. 149, repealed by No. 34/2019 s. 51(a).\n\n* * * * *\n\n***operator*** means a person who is responsible for the operation and security of the premises of a pharmacy depot;\n\n***pharmacy*** means premises in or from which a registered pharmacist supplies, compounds or dispenses medicines to the public and includes the part of the premises where the registered pharmacist sells or offers to sell goods of any kind, but does not include a pharmacy department or pharmacy depot;\n\n***Pharmacy Board of Australia*** means the Pharmacy Board of Australia established by the Health Practitioner Regulation National Law;\n\n***pharmacy business*** means a business carried on at a pharmacy and includes the business of providing pharmacy services and that part of the business where goods of any kind are sold or offered to be sold but does not include a pharmacy department or pharmacy depot;\n\n***pharmacy department*** means the part of the premises of a registered funded agency, registered community health centre, private hospital or privately operated hospital within the meaning of the **Health Services Act 1988** set aside for supplying, compounding or dispensing medicines on order or prescription to patients and staff of the agency, registered community health centre or hospital;\n\n***pharmacy*** ***depot*** means premises at which—\n\n(a) written prescriptions for the supply, compounding or dispensing of medicines may be left for a pharmacist;\n\n(b) medicines supplied, compounded or dispensed by a registered pharmacist may be left for collection by or on behalf of the person to whom they are addressed;\n\n***pharmacy services*** includes—\n\n(a) the supply, compounding or dispensing of medicines; and\n\n(b) advice and counselling on the effective and safe use of medicines;\n\nS. 3(1) def. of *prescription* inserted by No. 20/2016 s. 149, substituted by Nos 61/2017 s. 141, 34/2019 s. 51(b).\n\n***prescription*** includes a voluntary assisted dying permit within the meaning of the **Voluntary Assisted Dying Act 2017**;\n\n***proprietary interest*** means a legal or beneficial interest and includes a proprietary interest as a sole proprietor, as a partner, as a director, member or shareholder of a company and as the trustee or beneficiary of a trust;\n\n***registered pharmacist*** means a person registered under the Health Practitioner Regulation National Law to practise in the pharmacy profession (other than as a student);\n\n***registrar*** means a person responsible for maintaining the register to be kept by the Authority;\n\n***registration*** means a registration granted or taken to be granted under Part 3 to a licensee to register the premises of a pharmacy business, pharmacy department or pharmacy depot;\n\n***Secretary*** means the Department Head of the Department of Health within the meaning of the **Public Administration Act 2004** and includes a person acting as the Secretary to the Department of Health under that Act.\n\n(2) For the purposes of this Act, a person is to be treated as carrying on a business (including a pharmacy business) or pharmacy department or pharmacy depot if the person owns, manages, controls, conducts or operates the business or the pharmacy department or pharmacy depot.\n\n","sortOrder":0},{"sectionNumber":"4","sectionType":"section","heading":"Act to bind the Crown","content":"\t4 Act to bind the Crown\n\nThis Act binds the Crown in right of the State of Victoria and, to the extent that the legislative power of the Parliament permits, the Crown in all its other capacities.\n\n","sortOrder":1},{"sectionNumber":"Part 2","sectionType":"part","heading":"Ownership and operation","content":"Part 2—Ownership and operation\n\nDivision 1—Requirements of ownership\n\n","sortOrder":2},{"sectionNumber":"5","sectionType":"section","heading":"Ownership of pharmacy businesses","content":"\t5 Ownership of pharmacy businesses\n\n(1) A person must not own or have a proprietary interest in a pharmacy business unless the person is—\n\n(a) a registered pharmacist; or\n\n(b) a company registered under the Corporations Act—\n\n(i) whose directors are all registered pharmacists; and\n\n(ii) in which all the shares and the beneficial and legal interest in those shares are held by registered pharmacists; or\n\n(c) a company registered under the Corporations Act—\n\n(i) that immediately before 1 July 1999 was registered or incorporated as a friendly society under a Friendly Societies Code of a State or Territory that was in force at that time; and\n\n(ii) that is a company limited by guarantee or shares or by guarantee and shares; and\n\n(iii) that has at least 100 members; and\n\n(iv) whose members have equal voting rights on a poll or at a meeting or equal voting rights to elect a representative to vote on their behalf; and\n\n(v) whose objects include the provision of health or welfare facilities or services for its members or their dependants; and\n\n(vi) whose undistributed surplus if the company were wound up is to be distributed among its members at the time of winding up or transferred to another person or body with a similar structure and objects; and\n\n(vii) that satisfies the Authority as to the matters set out in subsection (4); or\n\n(d) a company registered under the Corporations Act that is a wholly owned subsidiary of a company referred to in paragraph (c); or\n\n(e) a company registered under the Corporations Act that—\n\n(i) satisfies the requirements of paragraph (c)(ii) to (vii); and\n\n(ii) is an amalgamation of 2 or more companies that comply with paragraph (c) or, at the time of amalgamation, complied with paragraph (c); or\n\n(f) a person approved by the Authority to carry on a pharmacy business in an area that the Authority determines needs a pharmacy business but in which there is no person referred to in paragraphs (a) to (e) who is able to own and carry on the pharmacy business.\n\n1. 240 penalty units in the case of a natural person;\n\n\n1200 penalty units in the case of a body corporate.\n\n(2) A registered pharmacist and a company referred to in subsection (1)(b) must not own or have a proprietary interest in more than 5 separate pharmacy businesses.\n\n(3) A person is not to be treated as having a proprietary interest in a company referred to in subsection (1)(c), (d) or (e) in respect of an interest as a director, member or shareholder of that company.\n\n(4) For the purposes of subsection (1)(c)(vii), the Authority must be satisfied that—\n\n(a) the company is not carrying on business for the dominant purpose of securing a profit or pecuniary gain for its members; and\n\n(b) any object or intention of the company to provide a dividend to its shareholders or members is a limited and not dominant purpose of the company; and\n\n(c) the property and income of the company is applied towards the objects of the company.\n\n(5) In this section ***registered pharmacist*** does not include a registered pharmacist who holds provisional registration under the Health Practitioner Regulation National Law.\n\n","sortOrder":3},{"sectionNumber":"6","sectionType":"section","heading":"Exception for executors and administrators","content":"\t6 Exception for executors and administrators\n\n(1) Nothing in section 5 prevents a person who—\n\n(a) is the executor, administrator or trustee of the estate of a pharmacist who has died and who carried on a pharmacy business at the time of his or her death; or\n\n(b) is appointed or authorised under the laws of bankruptcy to administer the property of a pharmacist who carried on a pharmacy business and is bankrupt; or\n\n(c) assumes the administration of the property of a person under a mortgage, bill of sale or security interest of that person's pharmacy business—\n\nfrom continuing to carry on the pharmacy business for a period of 6 months or for any further period permitted by the Authority if the pharmacy services of the business are provided by a registered pharmacist in accordance with this Part.\n\n(2) Nothing in section 5(1) or (2) applies to an interest created when a person referred to in section 5(1)(a) to (f) gives a mortgage, bill of sale or security interest in respect of the person's pharmacy business if the mortgage, bill of sale or document creating the security interest does not contravene section 11.\n\n","sortOrder":4},{"sectionNumber":"7","sectionType":"section","heading":"Notice to Authority about change to company with mutual structure","content":"\t7 Notice to Authority about change to company with mutual structure\n\nA company referred to in section 5(1)(c), (d) or (e) must inform the Authority within 30 days after a notice is lodged with, or an application is made to, the Australian Securities and Investments Commission under Part 5 of Schedule 4 to the Corporations Act about—\n\n(a) the company; or\n\n(b) a company referred to in section 5(1)(d) of which it is a wholly owned subsidiary.\n\n","sortOrder":5},{"sectionNumber":"8","sectionType":"section","heading":"Provision of information to Authority","content":"\t8 Provision of information to Authority\n\nThe Authority may require a person referred to in section 5(1) to give the Authority any information or produce any documents relating to the person's ownership or proprietary interest in a pharmacy business.\n\n\t9 Offence not to comply with section 7 or 8\n\nA person must not fail or refuse to give the Authority any information required under section 7 or 8 or fail or refuse to produce any documents required under section 8 or wilfully mislead the Authority when giving the information.\n\n1. 60 penalty units in the case of a natural person;\n\n\n300 penalty units in the case of a body corporate.\n\n\t10 Pharmacy businesses at separate premises\n\nEach pharmacy business carried on at separate premises including a pharmacy business carried on by the same person or under the same name as another pharmacy business is to be treated as a separate pharmacy business for the purposes of this Act.\n\n\t11 Undue influence\n\nA provision in a bill of sale, mortgage, lease or in any other commercial arrangement in respect of a pharmacy or pharmacy business that gives to any person other than the person licensed under section 38 to carry on the pharmacy business—\n\n(a) the right to control the manner in which the pharmacy business is carried on; or\n\n(b) the right of access to books of accounts or records kept in respect of that business, otherwise than for the purpose of determining whether or not the conditions of the relevant document are being complied with; or\n\n(c) the right to receive any consideration that varies according to the profits or takings in respect of the business—\n\nis void.\n\nDivision 2—Caps on growth of pharmacy ownership\n\n","sortOrder":6},{"sectionNumber":"12","sectionType":"section","heading":"Definition","content":"\t12 Definition\n\nIn this Division, a reference to—\n\n***own***, in relation to a pharmacy business, includes a reference to having a proprietary interest in the pharmacy business.\n\n","sortOrder":7},{"sectionNumber":"13","sectionType":"section","heading":"Application","content":"\t13 Application\n\nThis Division only applies to a pharmacy business—\n\n(a) if the business is carried on at premises approved or taken to be approved by the Pharmacy Board of Victoria under the **Pharmacy Practice Act 2004** before 1 July 2007 or under the **Health Professions Registration Act 2005** before the commencement day;\n\n(b) if the business is carried on at premises registered or taken to be registered by the Authority under this Act on or after the commencement day.\n\n","sortOrder":8},{"sectionNumber":"14","sectionType":"section","heading":"Cap on growth of pharmacy ownership for friendly society type companies","content":"\t14 Cap on growth of pharmacy ownership for friendly society type companies\n\nA company referred to in section 5(1)(c), (d) or (e) must not acquire ownership of any pharmacy business except in accordance with this Division.\n\n1. 1200 penalty units.\n\n\n","sortOrder":9},{"sectionNumber":"15","sectionType":"section","heading":"Exception for existing ownership","content":"\t15 Exception for existing ownership\n\nSection 14 does not apply to a company that—\n\n(a) immediately before 16 November 2004, did not own a pharmacy business or owned less than 6 pharmacy businesses and, after that date, acquired ownership of any pharmacy business so that the total number of pharmacy businesses owned by the company at any one time does not exceed 6; or\n\n(b) immediately before 16 November 2004, owned 6 or more pharmacy businesses and on or after 17 November 2008, acquired ownership of any additional pharmacy business so that the total number of pharmacy businesses owned by the company at any one time does not exceed 30% more than the number of pharmacy businesses that the company owned immediately before 17 November 2008.\n\n\t16 Exception for amalgamations on or after 16 November 2004 and before 17 November 2008\n\nSection 14 does not apply to a company referred to in section 5(1)(e) that was formed by amalgamation on or after 16 November 2004 and before 17 November 2008 if the number of pharmacy businesses the company owns at any one time does not exceed the total of the number of pharmacy businesses referred to in paragraphs (a) and (b) that were owned individually by each of the companies that were amalgamated to form the company—\n\n(a) in the case of a company that formed part of the amalgamation and, immediately before 16 November 2004, did not own a pharmacy business or owned less than 6 pharmacy businesses—6 pharmacy businesses; and\n\n(b) in the case of any other company that formed part of the amalgamation—30% more than the number of pharmacy businesses that the company owned immediately before 16 November 2004.\n\n\t17 Exception for amalgamation on or after 17 November 2008\n\n(1) Section 14 does not apply to a company referred to in section 5(1)(e) that was formed by amalgamation on or after 17 November 2008 if the number of pharmacy businesses the amalgamated company owns at any one time does not exceed—\n\n(a) in the case of the amalgamated company being formed only by companies that, immediately before 16 November 2004, did not own a pharmacy business or owned less than 6 pharmacy businesses—6 pharmacy businesses; or\n\n(b) in the case of the amalgamated company being formed by at least one company that, immediately before 16 November 2004, owned 6 or more pharmacy businesses—30% more than the number of pharmacy businesses that the largest amalgamating company owned immediately before 17 November 2008.\n\n(2) In this section ***largest amalgamating company*** means a company that—\n\n(a) was amalgamated with other companies to form a company; and\n\n(b) owned more pharmacy businesses than any other company that was amalgamated to form the company.\n\n","sortOrder":10},{"sectionNumber":"18","sectionType":"section","heading":"Pharmacy businesses owned by a subsidiary of a company","content":"\t18 Pharmacy businesses owned by a subsidiary of a company\n\nFor the purposes of this Division, the number of pharmacy businesses owned by a company referred to in section 5(1)(c) includes any pharmacy business owned by a wholly owned subsidiary of that company if the subsidiary was acquired or incorporated on or after 16 November 2004.\n\n","sortOrder":11},{"sectionNumber":"19","sectionType":"section","heading":"Calculating number of pharmacy businesses","content":"\t19 Calculating number of pharmacy businesses\n\nFor the purposes of calculating the total number of pharmacy businesses owned by a company under section 15(b), 16 or 17, the total number of pharmacy businesses may be rounded up to the next whole number.\n\nDivision 3—Requirements of establishment and operation\n\n","sortOrder":12},{"sectionNumber":"20","sectionType":"section","heading":"Notice of intention to establish a pharmacy business","content":"\t20 Notice of intention to establish a pharmacy business\n\nIf a person intends to establish or carry on a pharmacy business, the person must notify the Authority as soon as is practicable.\n\n","sortOrder":13},{"sectionNumber":"21","sectionType":"section","heading":"Establishment of pharmacy businesses","content":"\t21 Establishment of pharmacy businesses\n\n(1) A person must not establish or carry on a pharmacy business unless—\n\n(a) the requirements of section 5(1) and (2) are satisfied; and\n\n(b) the Authority has registered the premises of the pharmacy business; and\n\n(c) the Authority has granted a licence to the person to carry on a pharmacy business at the registered premises.\n\n1. 240 penalty units in the case of a natural person;\n\n\n1200 penalty units in the case of a body corporate.\n\n(2) Nothing in this section applies to a person referred to in section 6 who is carrying on a pharmacy business in accordance with that section.\n\n","sortOrder":14},{"sectionNumber":"22","sectionType":"section","heading":"Where establishment of a pharmacy department not permitted","content":"\t22 Where establishment of a pharmacy department not permitted\n\nA person must not establish or carry on a pharmacy department unless—\n\n(a) the person is a registered funded agency, registered community health centre, private hospital or privately-operated hospital within the meaning of the **Health Services Act 1988** that is acting in accordance with the provisions of the **Health Services Act 1988**; and\n\n(b) the Authority has registered the premises of the pharmacy department; and\n\n(c) the Authority has granted a licence to the person to carry on a pharmacy department at the registered premises.\n\n1. 240 penalty units in the case of a natural person;\n\n\n1200 penalty units in the case of a body corporate.\n\n","sortOrder":15},{"sectionNumber":"23","sectionType":"section","heading":"Establishment of pharmacy depot","content":"\t23 Establishment of pharmacy depot\n\nA person must not establish or carry on a pharmacy depot unless—\n\n(a) the person is a licensee; and\n\n(b) the Authority has registered the premises","content":"\t24 Controls on business activity at registered premises\n\nA licensee must not authorise, cause or permit any other person to carry on in the registered premises of the licensee any business or activity unless the business or activity is permitted by the licence or approved by the Authority.\n\n1. 60 penalty units.\n\n\n","sortOrder":17},{"sectionNumber":"25","sectionType":"section","heading":"Notifications about pharmacy businesses","content":"\t25 Notifications about pharmacy businesses\n\nA licensee of a pharmacy business must notify the Authority as soon as practicable, and in any event at least 14 days, before the licensee ceases carrying on the pharmacy business.\n\n1. 10 penalty units.\n\n\n","sortOrder":18},{"sectionNumber":"26","sectionType":"section","heading":"Notifications for a pharmacy department that ceases operation","content":"\t26 Notifications for a pharmacy department that ceases operation\n\nIf a pharmacy department is to cease operation, the licensee carrying on the pharmacy department must notify the Authority at least 14 days before the pharmacy department is closed.\n\n1. 10 penalty units.\n\n\n","sortOrder":19},{"sectionNumber":"27","sectionType":"section","heading":"Notifications for a company licensee","content":"\t27 Notifications for a company licensee\n\nIf a licensee is a company it must notify the Authority within 14 days of a change to—\n\n(a) the shareholding of the company; and\n\n(b) the directorship of the company; and\n\n(c) the office bearers of the licensee.\n\n1. 10 penalty units.\n\n\n","sortOrder":20},{"sectionNumber":"28","sectionType":"section","heading":"Notification by pharmacists","content":"\t28 Notification by pharmacists\n\n(1) A registered pharmacist must, within 14 days after the pharmacist commences to supply, compound or dispense medicines from a pharmacy or pharmacy department, notify the Authority of the address of the pharmacy or pharmacy department.\n\n1. 10 penalty units.\n\n\n(2) Subsection (1) does not apply to a person who has agreed in writing with the Authority to notify the Authority in the circumstances agreed with the Authority.\n\n","sortOrder":21},{"sectionNumber":"29","sectionType":"section","heading":"Controls over the supply, compounding or dispensing of medicines","content":"\t29 Controls over the supply, compounding or dispensing of medicines\n\n(1) A registered pharmacist must not supply, compound or dispense medicines except—\n\n(a) from the premises of a pharmacy business or pharmacy department registered by the Authority; or\n\n(b) in any other special circumstances that are approved by the Authority in a particular case.\n\n(2) A registered pharmacist providing pharmacy services from the premises of a pharmacy business or a pharmacy department registered by the Authority must not permit any person to supply, compound or dispense medicines except when the person is doing so under the supervision of a registered pharmacist.\n\n","sortOrder":22},{"sectionNumber":"30","sectionType":"section","heading":"Personal supervision of pharmacy or pharmacy department","content":"\t30 Personal supervision of pharmacy or pharmacy department\n\n(1) A pharmacy or a pharmacy department must be personally supervised by a registered pharmacist at all times it is open for business.\n\n(2) Any of the following persons is guilty of an offence and liable to a penalty not exceeding 60 penalty units if the person knowingly or negligently allows a pharmacy service to be provided at a pharmacy or a pharmacy department unsupervised by a registered pharmacist—\n\n(a) in the case of a pharmacy, the person licensed to carry on the pharmacy business of that pharmacy;\n\n(b) in the case of a pharmacy department, the person licensed to carry on the pharmacy department;\n\n(c) the registered pharmacist who is regularly and usually in charge of the pharmacy or pharmacy department;\n\n(d) the registered pharmacist (if he or she is not the pharmacist referred to in paragraph (c)) who had in respect of that period of time been placed in charge of and had undertaken to personally supervise the pharmacy or pharmacy department.\n\n(3) In this section ***personally supervised by a registered pharmacist*** means personally supervised by a registered pharmacist who is present at the pharmacy or the pharmacy department.\n\n","sortOrder":23},{"sectionNumber":"31","sectionType":"section","heading":"Access to closed pharmacies and pharmacy departments","content":"\t31 Access to closed pharmacies and pharmacy departments\n\n(1) The registered pharmacist who is regularly and usually in charge of a pharmacy and the person licensed to carry on the pharmacy business must not allow a person to have access to that pharmacy when it is not open for business unless a registered pharmacist is present.\n\n1. 60 penalty units.\n\n\n(2) The registered pharmacist who is regularly and usually in charge of a pharmacy department and the person licensed to carry on the pharmacy department must not allow a person to have access to that pharmacy department when it is not open for providing pharmacy services unless a registered pharmacist is present.\n\n1. 60 penalty units.\n\n\n","sortOrder":24},{"sectionNumber":"32","sectionType":"section","heading":"Dispensing and recording of prescriptions","content":"\t32 Dispensing and recording of prescriptions\n\n(1) A registered pharmacist must take reasonable steps to ensure that the dispensing of a medicine in accordance with a prescription or order is consistent with the safety of the person named in that prescription or order.\n\n(2) A registered pharmacist must keep a record of every prescription supplied, compounded or dispensed by the pharmacist in accordance with subsection (3).\n\n(3) The record of a prescription must be in English and include—\n\n(a) the name and address of the person to whom the medicine is dispensed;\n\n(b) the date the medicine is dispensed;\n\n(c) the name and dose form of the medicine dispensed;\n\n(d) the strength or identifying formula;\n\n(e) the quantity or number of doses ordered;\n\n(f) the directions for the use of the medicine;\n\n(g) any other ancillary written instructions supplied on the label;\n\n(h) the name, address and telephone number of the prescriber;\n\n(i) any alteration to the original prescription;\n\n(j) any other information concerning the medicine and its use.\n\n(4) The record of the prescription must—\n\n(a) be retained in a secure place at the pharmacy or pharmacy department for at least 3 years;\n\n(b) be made at the time of dispensing or, in the case of an emergency, within 24 hours after the dispensing;\n\n(c) be certified by the registered pharmacist who dispensed the prescription with his or her handwritten signature within 24 hours after the dispensing—\n\n(i) in the prescription record; or\n\n(ii) if the prescription record is made in a manner which precludes handwritten endorsement, in a separate record kept for that purpose, that he or she dispensed the prescription and the certified record must be kept as part of the prescription record;\n\n(d) be readily retrievable by reference to the name and address of the person to whom the medicine was dispensed, the date of dispensing and from information on the label on the container.\n\n","sortOrder":25},{"sectionNumber":"33","sectionType":"section","heading":"Security at pharmacy depots","content":"\t33 Security at pharmacy depots\n\nThe operator of a pharmacy depot must keep secure—\n\n(a) medicines left for collection at the depot until they are collected by or on behalf of the persons to whom they are addressed; and\n\n(b) prescription and client records kept at the depot.\n\n1. 60 penalty units.\n\n\nDivision 4—Use of titles\n\n","sortOrder":26},{"sectionNumber":"34","sectionType":"section","heading":"Claims by persons as to licence to operate","content":"\t34 Claims by persons as to licence to operate\n\n(1) A person must not intentionally or recklessly use the title \"pharmacy\", \"pharmacy practice\" or \"pharmacy business\" except in relation to a pharmacy or pharmacy business to which a licence applies.\n\n1. 60 penalty units in the case of a natural person;\n\n\n300 penalty units in the case of a body corporate.\n\n(2) This section does not apply to the use of a name or a title by or in relation to—\n\n(a) a museum if—\n\n(i) the words are used to identify premises where items relating to the history of pharmacy are exhibited; and\n\n(ii) pharmacy services are not provided from those premises; or\n\n(b) a teaching institution providing a course of study in pharmacy practice; or\n\n(c) professional associations representing registered pharmacists; or\n\n(d) any other person or body in circumstances approved by the Authority and notified in the Government Gazette and any publication circulating generally carry on a pharmacy business, if the pharmacy services are provided by or under the supervision of a registered pharmacist.\n\n(2) A registered pharmacist who—\n\n(a) carries on a pharmacy business; and\n\n(b) does not personally provide pharmacy services from the pharmacy—\n\nis not to be treated for the purpose of the Health Practitioner Regulation National Law as practising as a pharmacist in centre; or\n\n(c) a private hospital or privately-operated hospital—\n\nwithin the meaning of the **Health Services Act 1988** that is acting in accordance with the provisions of the **Health Services Act 1988**.\n\n","sortOrder":31},{"sectionNumber":"38","sectionType":"section","heading":"Decision to grant licence","content":"\t38 Decision to grant licence\n\n(1) The Authority may grant a licence to carry on the pharmacy business or pharmacy department if the Authority is satisfied that—\n\n(a) the applicant is eligible to be granted a licence; and\n\n(b) the facilities, equipment, security, management and operation of the pharmacy business or pharmacy department at the premises at which it is to be carried on comply with—\n\n(i) good pharmacy practice; and\n\n(ii) without limiting subparagraph (i), the relevant requirements in the Schedule and any other requirements that are prescribed.\n\n(2) The Authority may also have regard to the following matters in determining whether or not to grant a licence to a person to carry on a pharmacy business or pharmacy department—\n\n(a) the applicant's compliance with this Act, the regulations and any standards issued by the Authority;\n\n(b) the commitment of the applicant to utilising quality improvement programs that promote quality and safety in the dispensing and use of medicines;\n\n(c) the applicant's participation in public health programs relevant to the provision of pharmacy services;\n\n(d) the applicant's provision of affordable pharmacy services to disadvantaged groups.\n\n(3) The Authority must not grant a licence to a registered funded agency to carry on a pharmacy department unless the Authority has first consulted with the Secretary.\n\n","sortOrder":32},{"sectionNumber":"39","sectionType":"section","heading":"Grounds for refusal of a licence","content":"\t39 Grounds for refusal of a licence\n\n(1) If the Authority is not satisfied of any matters set out in section 38, the Authority may refuse to grant the licence sought.\n\n(2) The Authority may refuse to grant a licence if the Authority is satisfied that the applicant—\n\n(a) has failed to carry on a pharmacy business or pharmacy department in accordance with this Act or the regulations or the conditions on any other licence or registration granted by the Authority; or\n\n(b) has been convicted of an offence against this Act or the regulations; or\n\n(c) has contravened an Authority standard on one or more occasions and the Authority believes that it is against the public interest for the person to be licensed to carry on the pharmacy business or pharmacy department; or\n\n(d) is found guilty of an offence that affects the suitability of the person to carry on a pharmacy business and the Authority believes it is not in the public interest that the person be licensed to carry on the pharmacy business or pharmacy department; or\n\n(e) is of a character such that it would not be in the public interest to allow the applicant to hold a licence to carry on a pharmacy business.\n\n","sortOrder":33},{"sectionNumber":"40","sectionType":"section","heading":"Conditions on licence","content":"\t40 Conditions on licence\n\n(1) The Authority may impose any condition it thinks appropriate on a licence*.*\n\n(2) The licence must set out any condition to which it is subject.\n\n  (3) The Authority may impose a condition on a licence during the period of a licence—\n\n(a) with the consent of the licensee; or\n\n(b) without the consent of the licensee if 28 days prior to imposing the condition the Authority provides to the licensee—\n\n(i) written notice of the proposed condition; and\n\n(ii) the grounds for imposing the condition.\n\n(4) The Authority may impose a condition on the renewal of a late lodgement fee for the purposes of subsection (1)(b).\n\n(3) A licence that is the subject of an application made in accordance with subsection (1)—\n\n(a) is taken to remain in force until the Authority has decided whether or not to renew the licence; and\n\n(b) if renewed, is taken to have commenced on 1 July of the year in which the application for renewal is made.\n\nDivision and\n\n(b) the premises are suitable for the provision of pharmacy services; and\n\n(c) without limiting paragraph (b), the premises comply with—\n\n(i) the requirements in the Schedule that relate to premises; and\n\n(ii) any other requirements that are prescribed.\n\n(2) The Authority must not register part of the premises of a registered funded agency as a pharmacy department, unless the for refusal of registration of premises\n\n(1) Without limiting section 45, the Authority may refuse an application for registration of premises if satisfied that the applicant—\n\n(a) has failed to carry on a pharmacy business or pharmacy department in accordance with this Act or the regulations or the conditions on any licence or registration granted by the Authority; or\n\n(b) has been convicted of an offence against this Act or the regulations; or\n\n(c) has contravened an Authority standard on one or more occasions and the Authority believes that it is against the public interest for the premises to be registered; or\n\n(d) is found guilty of an offence that affects the suitability of the person to carry on a pharmacy business and the Authority believes it is not in the public interest for the premises to be registered; or\n\n(e) is of a character such that it would not be in the public interest to register the premises.\n\n(2) Without limiting section 45, the Authority may refuse to register premises if the premises are freely accessible to persons from other premises where a business or activity other than that of providing pharmacy services is carried out.\n\n(3) The Authority must not refuse to register the premises of a pharmacy business on the ground that the Authority disapproves of the geographical location of those premises.\n\n","sortOrder":41},{"sectionNumber":"47","sectionType":"section","heading":"Application for registration of a pharmacy depot","content":"\t47 Application for registration of a pharmacy depot\n\n(1) A person who is licensed to carry on a pharmacy business or pharmacy department may apply to the Authority to register a pharmacy depot.\n\n(2) The application must—\n\n(a) be in writing; and\n\n(b) contain the information required by the Authority to determine the application; and\n\n(c) be accompanied by the fee fixed by the Authority.\n\n(3) If the period of registration applied for under subsection (1) is less than 12 months, the proportion of the fixed fee that applies may be determined on a pro rata pharmacy depot if it is satisfied that—\n\n(a) the applicant is a licensee who will provide pharmacy services in respect of those premises; and\n\n(b) the premises of the pharmacy depot provide secure storage for prescriptions and medicines; and\n\n(c) the applicant will have suitable arrangements at the pharmacy depot to ensure that—\n\n(i) client records are kept confidential and secure; and\n\n(ii) conversations at the pharmacy depot can be conducted between a registered pharmacist and the person to whom the medicines are dispensed; and\n\n(iii) the conversations are able to be conducted in confidence; and\n\n(d) the person who will operate the pharmacy depot will be at least 18 years of age.\n\n","sortOrder":43},{"sectionNumber":"49","sectionType":"section","heading":"Conditions on registration","content":"\t49 Conditions on registration\n\n(1) The Authority may impose any condition about a licensee or holder of a registration","content":"\t53 Notifications about a licensee or holder of a registration\n\n(1) A person may notify the Authority about any matter relating to a licensee if the person believes it indicates that—\n\n(a) the licensee's ability to carry on a pharmacy business may be affected because—\n\n(i) of the physical or mental health of the licensee; or\n\n(ii) the licensee has an incapacity; or\n\n(iii) the licensee is an alcoholic or drug-dependent person; or\n\n(b) the licensee is not of good character; or\n\n(c) the licensee has contravened the requirements regarding ownership of pharmacies; or\n\n(d) the licensee is no longer eligible to hold a licence; or\n\n(e) the licensee has contravened an Authority standard; or\n\n(f) the licensee has contravened this Act; or\n\n(g) the licence was or may have been improperly obtained because the Authority was provided with false or misleading information.\n\n(2) A person may notify the Authority about any matter relating to a holder of a registration if the person believes it indicates that—\n\n(a) the registered premises do not meet the requirements of this Act or of an Authority standard; or\n\n(b) the registration holder has or may have contravened a condition of a licence or a condition of the registration of the premises; or\n\n(c) the registration was or may have been improperly obtained because the Authority was provided with false or misleading information.\n\n","sortOrder":49},{"sectionNumber":"54","sectionType":"section","heading":"Investigations without notification","content":"\t54 Investigations without notification\n\n(1) The Authority may investigate a matter relating to a licence or a registration without notification if the Authority believes that there is evidence of any of the matters referred to in section 53.\n\n(2) The Authority may investigate a matter relating to a licence or registration even if a notification about the matter is withdrawn.\n\nDivision 4—Revocation of a licence or registration\n\n","sortOrder":50},{"sectionNumber":"55","sectionType":"section","heading":"Grounds on which licence may be revoked","content":"\t55 Grounds on which licence may be revoked\n\nSubject to this Division, the Authority may revoke a licence granted in respect of a pharmacy business or pharmacy department—\n\n(a) if the person carrying on the pharmacy business or pharmacy department—\n\n(i) is no longer eligible to hold a licence; or\n\n(ii) has been convicted of an offence against this Act or the regulations; or\n\n(iii) has contravened an Authority standard on one or more occasions and the Authority believes that it is against the public interest for the person to continue to carry on the pharmacy business or pharmacy department; or\n\n(iv) is found guilty of an offence that affects the suitability of the person to carry on a pharmacy business or pharmacy department and the Authority believes it is not in the public interest that the person continue to carry on a pharmacy business or pharmacy department; or\n\n(v) is of a character such that it would not be in the public interest to allow the applicant to continue to hold a licence to carry on a pharmacy business; or\n\n(b) there has been a failure of security at the pharmacy business or pharmacy department that presents a serious risk to public health or safety; or\n\n(c) the premises of the pharmacy business or pharmacy department are unhygienic or no longer suitable for use for this purpose; or\n\n(d) there has been a failure of good pharmaceutical practice at the premises of the pharmacy business or pharmacy department that presents a serious risk to public health and safety.\n\n","sortOrder":51},{"sectionNumber":"56","sectionType":"section","heading":"Grounds for revocation of registration","content":"\t56 Grounds for revocation of registration\n\nSubject to this Division, the Authority may revoke a registration of premises of a pharmacy business, pharmacy department or pharmacy depot carried on by a person—\n\n(a) if the person carrying on the pharmacy business, pharmacy department or pharmacy depot is no longer eligible to hold a licence; or\n\n(b) if the person carrying on a pharmacy business, pharmacy department or pharmacy depot has failed to carry on the pharmacy business, pharmacy department or pharmacy depot in accordance with this Act or the regulations or any conditions on the registration; or\n\n(c) on any other ground on which the person's licence could be revoked; or\n\n(d) there has been a failure of security at the pharmacy business, pharmacy department or pharmacy depot that presents a serious risk to public health and safety; or\n\n(e) if the premises of the pharmacy business, pharmacy department or pharmacy depot are unhygienic or no longer suitable for use for this purpose; or\n\n(f) there has been a failure of good pharmaceutical practice at the premises of the pharmacy business, pharmacy department or pharmacy depot that presents a serious risk to public health and safety.\n\n","sortOrder":52},{"sectionNumber":"57","sectionType":"section","heading":"Convening of a panel","content":"\t57 Convening of a panel\n\n(1) The Authority may convene a panel to hear a matter which has been the subject of an investigation under Division 3 of Part 3.\n\n(2) A panel convened under subsection (1) may be comprised of 3 members of whom—\n\n(a) at least 2 are members of the Authority; and\n\n(b) one may be a person co-opted by the Authority for the purpose of the hearing of the matter; and\n\n(c) at least 2 are registered pharmacists.\n\n(3) A person co-opted by the be conducted with as little formality and technicality as the requirements of this Act and the proper consideration of the matter permit;\n\n(b) there is no right to legal representation at the panel hearing;\n\n(c) the licensee or registration holder is entitled to be present and to make submissions and to be accompanied by another person who may be a lawyer;\n\n(d) the panel is not bound by rules of evidence but may inform itself in any way it thinks fit;\n\n(e) the panel is bound by the rules of natural justice;\n\n(f) the proceeding must not be open to the public;\n\n(g) the procedure of the panel is otherwise in its discretion.\n\nS. 58(2) inserted by No. 13/2022 s. 51.\n\n(2) A panel may decide to conduct a panel hearing by means of audio visual link.\n\nS. 58(3) inserted by No. 13/2022 s. 51.\n\n(3) A licensee or registration holder is taken to be present at a panel hearing if the licensee or registration holder is physically present at the hearing or appears before the hearing by means of audio visual link.\n\nS. 58(4) inserted by No. 13/2022 s. 51.\n\n(4) If a licensee or registration holder appears before a panel hearing by means of audio visual link, any person accompanying the licensee or registration holder may attend the panel hearing by means of audio visual link.\n\n","sortOrder":54},{"sectionNumber":"59","sectionType":"section","heading":"Decisions of a panel","content":"\t59 Decisions of a panel\n\n(1) At the end of a hearing, the panel may decide that—\n\n(a) a condition be placed on a licence; or\n\n(b) a condition be placed on a registration; or\n\n(c) a licence be revoked; or\n\n(d) a registration be revoked; or\n\n(e) the licensee or registration holder be cautioned or reprimanded; or\n\n(f) the licence or registration continue.\n\n(2) The decision of the panel under this section is the decision of the Authority.\n\n","sortOrder":55},{"sectionNumber":"60","sectionType":"section","heading":"Notice of revocation of licence or registration","content":"\t60 Notice of revocation of licence or registration\n\n(1) If the Authority decides to revoke a licence or registration without referring the matter to a panel, the Authority may give written notice to the person who holds the licence or registration.\n\n(2) The notice may—\n\n(a) revoke the licence or registration at the end of 28 days after the day on which the notice is given; or\n\n(b) state an intention to revoke the licence or registration unless within a period (not being less than 28 days) specified in the notice satisfactory arrangements are made to remedy any specified failure or circumstance.\n\n(3) In determining whether to give a notice under subsection (2), the Authority must consider—\n\n(a) the conduct of the person carrying on the pharmacy business, pharmacy department or pharmacy depot; and\n\n(b) the seriousness of any breach of this Act, the regulations or any condition of the licence or registration; and\n\n(c) whether the breaches could have been avoided by the exercise of reasonable care; and\n\n(d) any circumstances that may prevent the person from being able to continue to carry on the pharmacy business, pharmacy department or pharmacy depot in accordance with this Act, the regulations or any condition of the licence or registration.\n\n(4) The Authority may revoke a licence or registration without giving the notice if it believes it is necessary to immediately revoke the licence or registration to reduce or prevent a serious risk to public health and safety.\n\n","sortOrder":56},{"sectionNumber":"61","sectionType":"section","heading":"Other sanctions by Authority","content":"\t61 Other sanctions by Authority\n\nIf it considers it appropriate to do so, the Authority may caution or reprimand a licensee or holder of registration instead of revoking the licence or registration.\n\nDivision 5—VCAT review\n\n","sortOrder":57},{"sectionNumber":"62","sectionType":"section","heading":"Application to VCAT for review","content":"\t62 Application to VCAT for review\n\n(1) A person affected by a decision of the Authority—\n\n(a) to refuse to grant a licence; or\n\n(b) to refuse to grant a registration; or\n\n(c) to impose conditions on a licence or registration; or\n\n(d) to revoke a licence or registration—\n\nmay apply to VCAT for a review of that decision.\n\n(2) An application under subsection (1) must be made within 28 days after the date on which the person concerned received notice of the decision and the reasons for it.\n\n(3) The Authority must publish a notice of the determination of VCAT on a review under this section on the Authority's Internet site.\n\n(4) If a decision has been reviewed by VCAT, the Authority must notify any person who was notified of the original decision by the Authority, of the determination of VCAT.\n\nDivision 6—Public examine documents\n\n(1) The Authority may—\n\n(a) require a registered pharmacist or a person licensed under this Act to submit for examination at its offices any documents kept by the pharmacist or person in connection with the carrying on of a pharmacy business; and\n\n(b) direct that—\n\n(i) copies of or extracts from the documents be made and certified by the registrar as true and correct copies or extracts for the purpose of any hearing under this Act or any review of any decision of the Authority; or\n\n(ii) the documents or any part of them be held by the registrar in accordance with this Part for the purpose of any hearing under this Act or any review of any decision of the Authority.\n\n(2) Before requiring a registered pharmacist or person under subsection (1) to submit a document the Authority must—\n\n(a) warn the registered pharmacist or person that a refusal or failure to comply with the requirement, without reasonable excuse, is an offence; and\n\n(b) in the case pharmacies","content":"\t68 Special powers of entry to pharmacies\n\n(1) In order to ascertain whether provisions of this Act and the regulations are being complied with a person referred to in section 65(2)—\n\n(a) may enter into the premises of any pharmacy business, pharmacy department or pharmacy depot or other place where medicines are supplied, compounded or dispensed; and\n\n(b) may examine any room or part of the premises so entered for the purpose of inspecting stocks of medicines and other goods in the premises or any equipment, prescriptions, or other documents in the premises; and\n\n(c) may make or cause to be made copies of or extracts from documents in the premises.\n\nS. 68(1A) inserted by No. 13/2022 s. 53.\n\n(1A) A person referred to in section 65(2) may enter a premises or place referred to in subsection (1)(a) physically or by audio visual link.\n\n(2) An authorised person may only enter the premises of a pharmacy business, pharmacy department or pharmacy depot when the pharmacy business, pharmacy department or pharmacy depot is open for business or providing pharmacy services.\n\n(3) A person must not—\n\n(a) refuse or fail to admit an authorised person requiring entry into premises under this section; or\n\n(b) cause or permit the refusal or failure referred to in paragraph (a).\n\n(4) Before requiring a person to permit the activities provided for under subsection (1), the authorised person must—\n\n(a) warn the person that a refusal or failure to comply with the requirement, without reasonable excuse, is an offence; document","content":"\t69 Certified copy of examined document\n\nA copy of, or extract from, a document certified as correct by an authorised person is taken to be a true and correct copy or extract with warrant","content":"\t70 General powers of entry with warrant\n\n(1) A person appointed for that purpose by the Authority may apply to a magistrate for the issue of a search warrant in relation to particular premises if that person believes, on reasonable grounds—\n\n(a) that there is or has been a contravention of this Act or the regulations on the premises; or\n\n(b) that entry into or onto the premises is necessary for the purpose of investigating a matter in a notification made under this Act which, if substantiated, may provide grounds for the revocation by the Authority of a grounds for suspecting that there is on the premises a particular thing that may be evidence of the commission of an offence against this Act or the regulations or of grounds for the revocation by the Authority of a licence or registration, the magistrate may issue a search warrant authorising any person named in the warrant—\n\n(a) to enter the premises or the part of the premises named or described in the warrant; and\n\n(b) to search for and seize a thing named or described in the warrant; and\n\n(c) to bring the thing before the Magistrates' Court so that the matter may be dealt with according to law.\n\n(3) A search warrant must be issued in accordance with the **Magistrates' Court Act 1989** and in a form prescribed under that Act.\n\n(4) In addition to any other requirement, a search warrant issued for the purposes of this section must state—\n\n(a) the offence or grounds of revocation of a licence or registration suspected; and\n\n(b) the premises to be searched; and\n\n(c) the name or a description of the thing to be searched for; and\n\n(d) any conditions to which the warrant is subject; and\n\n(e) whether entry is authorised to be made at any time or during stated hours; and\n\n(f) a day, not later than 7 days after the issue of the warrant, on which the warrant ceases to have effect.\n\n(5) The rules to be observed with respect to search warrants mentioned in the **Magistrates' Court Act 1989** extend and apply to warrants under this section.\n\n","sortOrder":67},{"sectionNumber":"71","sectionType":"section","heading":"Announcement before or the person from whom it was seized, must give a copy of the thing or information to the occupier or person as soon as practicable after the seizure.\n\n(2) If a person seizes a thing under this Part and has not provided a copy of the thing or information under subsection (1) the person must provide a receipt for that thing as soon as practicable after the steps to return it unless—\n\n(a) proceedings for the purpose for which the document or thing was retained have commenced within that 3-month period and those proceedings (including any appeal) have not been completed; or\n\n(b) the Magistrates' Court makes an order under section 76 extending the period during which the document or thing may be this section, before the end of the period of the extension—\n\nfor an extension (not exceeding 3 months) of the period for which the authorised person may retain the document or thing but so that the total period of retention does not exceed 12 months.\n\n(2) The Magistrates' Court may order such an extension if it is satisfied that—\n\n(a) it is in the interests of justice; and\n\n(b) the total period of retention does not exceed 12 months; and\n\n(c) retention of the document or other thing is necessary—\n\n(i) for the purposes of an investigation into whether a contravention of this Act or purpose of investigating a matter in a notification made under this Act which, if substantiated, may provide grounds for the revocation of a licence or registration.\n\n(3) At least 7 days before the hearing of an application under this section, notice of the application must be sent to the owner of the document or thing described in the as practicable after the Minister approves the standard.\n\n(7) The Authority is not required to consult in accordance with subsection (2) before issuing a standard if, in the opinion of the Authority, there is an immediate need to issue the standard to address a matter of public health or safety.\n\n(8) If there is any inconsistency between any practices recommended under a standard published by the Authority and a provision of this Act or the regulations or any other Act or regulations, the provision of the Act or the regulations delivered to the Minister.\n\n(3) The Governor in Council may at any time remove a member of the Authority from office.\n\n(4) If a member of the Authority dies, resigns or is removed from office, the Minister may fill the vacant position by appointing a person who is qualified to be appointed as an acting member.\n\n(5) A member appointed under subsection (4) holds office for the rest of the term only recommend a member who is a registered pharmacist for appointment to the office of Chairperson or Deputy Chairperson, unless the Minister considers that it is necessary for the good operation of the Authority to recommend a member who is not a registered pharmacist.\n\n(3) A person appointed to an office under subsection (1) holds office for the term specified in his or her instrument of appointment and is eligible for reappointment.\n\n(4) A person appointed to an office under subsection (1) may resign that office by writing signed by the person and delivered to the Minister.\n\n(5) The Governor in Council may at any time remove a person appointed under subsection (1) from office.\n\n(6) A person appointed to an office under subsection (1) ceases to hold that office on ceasing to and conditions of appointment for an acting member are the same as for the member for whom they act.\n\n(3) The Minister may at any time terminate the appointment.\n\n(4) While the appointment of an acting member remains in force, the acting member has and may exercise all the powers and perform all the duties and functions of the at a meeting, the members present may elect a member to preside at the meeting.\n\n(3) The person presiding at a meeting has a deliberative vote and a second or casting vote.\n\n(4) A majority of the members of the Authority currently holding office constitutes a quorum.\n\n(5) Subject to this Act, the Authority may regulate its own members for the time being sign a document containing a statement that they are in favour of the resolution in the terms set out in the document—\n\na resolution in those terms is taken to have been passed at a meeting of the Authority held on the day on which the document is signed or, if the members referred to in paragraph (b) do not sign it on the same day, on the day on which the last of those members signs the document.\n\n(2) If a resolution is, under subsection (1), taken to have been passed at a meeting of the Authority, each member must as soon as practicable be advised of the matter and given a copy of the resolution.\n\n(3) For the purposes of subsection (1), 2 or more separate documents containing a statement in identical terms, each of which is signed by one or more members, are deemed to constitute one document.\n\n(4) The majority of members referred to in subsection (1)(b) must not include a member who, because of Part 5 of the **Public Administration Act the Fund.\n\n(3) The Authority must pay any other money received by it into the Fund, including income from the investments of the Fund.\n\n(4) The Authority must pay out of the Fund—\n\n(a) the expenses incurred by it in carrying out its functions and powers; and\n\n(b) any other expenses incurred in the administration of this Act; and\n\n(c) any payments to be made to members of the Authority under this Act and any payments to be made to other persons under this Act; and\n\n(d) any other payments recommended by the Authority and approved by the Minister.\n\n(5) The Authority must pay out of the Fund each financial year an amount determined by the Authority to meet the expenses of VCAT in performing functions under this Act during that year.\n\n(6) The amount in any financial year must not be less than the amount (if any) specified in relation to that year by the Attorney-General by written notice given to the that period; and\n\n(b) the Authority may fix a different fee for a different case or classes of cases and may allow for the reduction, waiver or refund, in whole or in part, of any fee; and\n\n(c) the Authority must publish any fee it has fixed in the Government Gazette and on the Authority's Internet site.\n\n(2) In fixing fees under this Act, the Authority is entitled to ensure that the amount of money collected in fees under this Act is sufficient to cover the cost to the Authority of administering this Act and the Account any amounts that the Minister administering section 14 of the **Financial Management Act 1994**, in consultation with the Treasurer, determines are required to repay advances from the Public Account for the operation of the Authority.\n\n(2) Payments under subsection (1) must be made in accordance with any other terms and conditions from time to time determined by the Minister administering section 14 of the **Financial Management Act 1994** in consultation with the Treasurer.\n\n(3) The Authority must, as and when directed to do so by the Minister administering section 14 of the **Financial Management Act 1994**, provide a plan for the repayment of advances referred to in subsection (1).\n\n(4) The Authority must at any time that the Minister administering section 14 of the **Financial Management Act 1994** directs it to do so, report to that Minister in writing on its progress in making payments under subsection (1).\n\n","sortOrder":109},{"sectionNumber":"Part Authority may only disclose information in accordance with this section for the purpose of—\n\n(a) fulfilling its functions under this Act;\n\n(b) assisting a person or body referred to in subsection (1) to fulfil their functions;\n\n(c) if the Authority is of the opinion that the information is relevant to the registration of the pharmacist under the Health Practitioner Regulation National Victorian Pharmacy Authority on the same trust, or subject to the same condition and is to be paid into the they are to be used.\n\n3 The general physical security of the premises is assured and the control of keys or other entry devices is restricted to registered pharmacists authorised by the person carrying on the pharmacy business or pharmacy department.\n\n4 There is no access to the dispensary of the pharmacy or pharmacy department except under the direct supervision of a registered pharmacist.\n\n5 A registered pharmacist must be appointed to act as the pharmacist who is regularly and usually in charge of the pharmacy or pharmacy department when the pharmacy or pharmacy department is open for business.\n\n6 When the pharmacist who is appointed as the pharmacist who is regularly and usually in charge of the pharmacy or pharmacy department is absent or not available, another registered pharmacist must be appointed to act as the pharmacist in charge of the pharmacy or pharmacy department when the pharmacy or pharmacy department is open for business.\n\n7 A registered pharmacist must oversee the area of the pharmacy or pharmacy department where pharmacy services are provided.\n\n8 A registered pharmacist appointed to act as the pharmacist in charge must oversee, supervise and monitor all registered pharmacists providing pharmacy services in the pharmacy or pharmacy department and any other staff who assist in the provision of pharmacy pharmacy department cannot be known by another person present in the pharmacy or pharmacy department who is not a person carrying on the pharmacy business or pharmacy department or a member of the
