While it has been heavily amended over 35 years (particularly regarding fee amounts and geodetic standards), these changes reflect updates to technical standards and inflation adjustments rather than scope creep. The core functions—setting fees, prescribing forms, defining royalty calculations, and establishing mapping standards—remain consistent with the original 1990 intent."},"complexity_factors":["Multiple fee schedules with specific dollar amounts requiring annual updates (Schedule 1 shows 20 separate fee items)","Technical geodetic definitions involving reference ellipsoids, semi-major axes, and coordinate transformation methods (Regulations 9-11)","Cross-references to multiple Commonwealth tax acts for royalty calculations (Regulation 8 references Income Tax Assessment Act 1936 and Higher Education Funding Act 1988)","Transitional provisions dealing with datum changes over time (Regulations 9, 10, and 11 create a layered system where old and new coordinate systems operate in parallel for different purposes)","Deleted provisions (regulations 3A, 6, 7) indicating legislative evolution that requires reading the compilation table to understand current state","Specific form requirements with numbered annotations explaining how to complete legal instruments (Schedule 2)"],"plain_english_summary":"**What this legislation does:**\n\nThese regulations set the administrative rules for Western Australia's offshore petroleum industry. They operate under the *Petroleum (Submerged Lands) Act 1982*, which governs oil and gas exploration and production in state waters (typically up to 3 nautical miles from the coast).\n\n**Key things covered:**\n\n* **Fees:** Sets out the specific dollar amounts companies must pay for various permits, licences, and applications (Schedule 1). For example, applying for an exploration permit costs $8,740, while registering a transfer of title costs $167.\n* **Paperwork:** Provides the official form for transferring ownership of petroleum titles (Schedule 2), and specifies what details must be included when registering dealings (transactions) involving petroleum interests.\n* **Royalties:** Defines which taxes and charges **cannot** be deducted when calculating royalty payments to the government. This prevents companies from reducing their royalty obligations by claiming certain taxes (like fringe benefits tax or import duties) as deductions.\n* **Mapping standards:** Specifies which geographic coordinate systems must be used to define the boundaries of exploration areas and production licences. It has been updated over time from the old Australian Geodetic Datum (AGD) to newer systems (GDA 1994, and now GDA 2020), ensuring maps are accurate and consistent with modern GPS technology.\n\n**Who it affects:**\n\n* Oil and gas companies operating in Western Australian state waters\n* The WA Department of Mines, Industry Regulation and Safety (which administers the regime)\n* Anyone buying, selling, or transferring interests in petroleum titles\n\n**Why it matters:**\n\nThese regulations ensure the petroleum industry operates on a clear, consistent administrative footing. They establish the \"cost of doing business\" through fee schedules, prevent royalty avoidance through specific tax exclusions, and ensure legal certainty about where boundaries lie by mandating precise geodetic standards. Without these rules, there would be confusion about fees, forms, and physical boundaries of exploration areas."},"flash_summary_failed":{"failed":true,"reason":"A positive credit balance is required for all requests, including BYOK, so fallback providers remain available. They matter to permittees, licence and title holders and prospective transferees because they determine what must be paid, what information must be lodged for Ministerial approval, and which coordinate standards must be used for legal descriptions."},"summary":{"complexity_score":2,"scope_assessment":{"changed":false,"description":"Scope cannot be assessed as no legislative content was available for analysis.
