The scope has also expanded technically: originally concerned with basic fees and forms, it now includes complex geodetic datum specifications (added 2000, updated 2025) and detailed tax exclusions for federal duty (added 1994). The fee structure has grown from simple flat fees to a detailed schedule referencing numerous new sections of the Act added over decades."},"complexity_factors":["Multiple fee schedules with cross-references to specific Act sections (Schedule 1 references 19 different sections)","Technical geodetic definitions requiring specialist knowledge (ellipsoid parameters, reference frames, coordinate transformations)","Transitional provisions for datums with overlapping validity periods (GDA 1994, GDA 2020, and AGD all have different application rules)","Nested definitions in Regulation 5 for 'related dealings' involving multiple sub-conditions and historical references to repealed legislation","Deleted regulations (6, 7, and 3A) creating gaps in numbering that require cross-referencing to understand legislative history","Multiple amendment histories requiring reconciliation (regulations amended 20+ times since 1987, with some provisions deleted and others inserted)"],"plain_english_summary":"This is Western Australian law that sets out the administrative rules for the **Petroleum and Geothermal Energy Resources Act 1967**.\n\n**What it does:**\n- **Sets fees** for applications and dealings related to petroleum and geothermal exploration permits, production licences, and other titles (Schedule 1 lists specific fees ranging from $142 to $8,950)\n- **Sets time limits** (3 months) for resolving disputes between resource companies and private landowners about damage to property from drilling or exploration operations\n- **Specifies what information** must be provided when registering transfers or dealings with petroleum titles (such as names, addresses, values, and details of the transaction)\n- **Provides a standard form** for transferring ownership of petroleum titles (like selling an exploration permit)\n- **Defines which taxes count as \"federal duty\"** that companies must pay (and importantly, excludes common taxes like GST, income tax, fringe benefits tax, and customs duty from this definition)\n- **Sets technical standards** for mapping and surveying, specifying which geodetic datums (coordinate systems) must be used when defining land boundaries for petroleum operations — currently the Geocentric Datum of Australia 2020, with transitional arrangements for older surveys using the 1994 datum or the old Australian Geodetic Datum\n\n**Who it affects:**\n- Oil and gas companies holding exploration permits or production licences in WA\n- Geothermal energy operators\n- Private landowners whose property is affected by petroleum operations\n- The WA Department of Mines (now Department of Energy, Mines, Industry Regulation and Safety) which administers the system\n\n**Why it matters:**\nThis is the \"machinery\" that makes the main Act work. Without these regulations, companies wouldn't know what fees to pay, how long they have to negotiate with landowners, or what paperwork to file when buying or selling oil and gas rights. The geodetic datum rules ensure everyone uses the same coordinate system when defining where underground resources are located — critical for avoiding boundary disputes worth millions of dollars."},"flash_summary_failed":{"failed":true,"reason":"A positive credit balance is required for all requests, including BYOK, so fallback providers remain available.
