The [Firearms Act 1996](/view/html/inforce/current/act-1996-046), section 4D requires the holding of a permit to authorise the possession or use of an imitation firearm. This may mean a person is required to hold a paintball marker permit under this Act and an imitation firearm permit.\n> > \n> > paintball venue means a place at which the sport known as paintball is played or at which paintball markers are used.\n> > \n> > permit means a paintball venue permit, a paintball marker permit or an international paintball competitor permit granted under Part 3.\n> > \n> > possession of a paintball marker includes any case in which a person knowingly—\n> > \n> > > (a) has custody of the paintball marker, or\n> > \n> > > (b) has the paintball marker in the custody of another person, or\n> > \n> > > (c) has the paintball marker in or on any premises whether or not belonging to or occupied by the person.\n> > \n> > premises includes—\n> > \n> > > (a) a building or structure, or\n> > \n> > > (b) land or a place (whether enclosed or built on or not), or\n> > \n> > > (c) a mobile plant, vehicle, vessel or aircraft.\n> > \n> > Register means the Register of paintball markers compiled and maintained under Part 7.\n> > \n> > relevant offence means an offence against any of the following Acts or provisions of Acts or the regulations under those Acts or provisions—\n> > \n> > > (a) this Act,\n> > \n> > > (b) the [Firearms Act 1996](/view/html/inforce/current/act-1996-046),\n> > \n> > > (c) the [Crimes Act 1900](/view/html/inforce/current/act-1900-040) but only in respect of an offence involving a firearm or offensive weapon or instrument or an offence prescribed by the regulations,\n> > \n> > > (d) the [Weapons Prohibition Act 1998](/view/html/inforce/current/act-1998-127),\n> > \n> > > (e) any other Act, or provision of an Act, prescribed by the regulations.\n> > \n> > Secretary means—\n> > \n> > > (a) the Commissioner for Fair Trading, Department of Customer Service, or\n> > \n> > > (b) if there is no person employed as Commissioner for Fair Trading—the Secretary of the Department.\n> > \n> > supply means transfer ownership of, whether by sale, gift, barter, exchange or otherwise, and includes the following—\n> > \n> > > (a) offer for supply, receive for supply, have in possession for supply or expose or exhibit for supply,\n> > \n> > > (b) conduct negotiations for supply,\n> > \n> > > (c) consign or deliver for supply,\n> > \n> > > (d) cause or allow supply.\n> > \n> > Tribunal means the Civil and Administrative Tribunal.\n> > \n> > Note.\n> > \n> > The [Interpretation Act 1987](/view/html/inforce/current/act-1987-015) contains definitions and other provisions that affect the interpretation and application of this Act.\n> \n> > (2) Notes included in this Act do not form part of this Act.\n> \n> **s 3:** Am 2022 No 59, Sch 3.48\\[1\\] \\[2\\]; 2023 No 31, Sch 1\\[1\\].","sortOrder":3},{"sectionNumber":"4","sectionType":"section","heading":"Meaning of “close associate”","content":"#### 4 Meaning of “close associate”\n\n4 Meaning of “close associate”\n\n> > (1) For the purposes of this Act, a person is a close associate of an applicant for a permit or the holder of a permit if the person—\n> > \n> > > (a) holds or will hold any relevant financial interest, or is or will be entitled to exercise any relevant power (whether in the person’s own right or on behalf of any other person), in the business of the applicant or holder that is or will be carried on under the authority of the permit, and by virtue of that interest or power is or will be able (in the opinion of the Secretary) to exercise a significant influence over or with respect to the management or operation of that business, or\n> > \n> > > (b) holds or will hold any relevant position, whether in the person’s own right or on behalf of any other person, in the business of the applicant or holder that is or will be carried on under the authority of the permit, or\n> > \n> > > (c) is or will be engaged as a contractor or employed in the business of the applicant or holder that is or will be carried on under the authority of the permit.\n> \n> > (2) For the purposes of this section, a financial institution is not a close associate by reason only of having a relevant financial interest in relation to a business.\n> \n> > (3) The provisions of this section extend to relevant financial interests and relevant powers even if those interests and powers are not payable, exercisable or otherwise enforceable as a matter of law or equity, but are nevertheless payable, exercisable or otherwise enforceable as a matter of fact.\n> \n> > (4) In this section—\n> > \n> > relevant financial interest, in relation to a business, means—\n> > \n> > > (a) any share in the capital of the business, or\n> > \n> > > (b) any entitlement to receive any income derived from the business, or to receive any other financial benefit or financial advantage from the carrying on of the business, whether the entitlement arises at law or in equity or otherwise, or\n> > \n> > > (c) any entitlement to receive any rent, profit or other income in connection with the use or occupation of premises on which the business is or is to be carried on (such as, for example, an entitlement of the owner of the premises at which the business is carried on to receive rent as lessor of the premises).\n> > \n> > relevant position means—\n> > \n> > > (a) the position of director, manager or secretary, or\n> > \n> > > (b) any other position, however designated, if it is an executive position.\n> > \n> > relevant power means any power, whether exercisable by voting or otherwise and whether exercisable alone or in association with others—\n> > \n> > > (a) to participate in any directorial, managerial or executive decision, or\n> > \n> > > (b) to elect or appoint any person to any relevant position.","sortOrder":4},{"sectionNumber":"Part 2","sectionType":"part","heading":"Key offences","content":"# Part 2 Key offences\n\nPart 2 Key offences","sortOrder":5},{"sectionNumber":"5","sectionType":"section","heading":"Using paintball marker other than at authorised paintball venue","content":"#### 5 Using paintball marker other than at authorised paintball venue\n\n5 Using paintball marker other than at authorised paintball venue\n\n> > (1) A person must not use a paintball marker other than at an authorised paintball venue.\n> > \n> > Maximum penalty—imprisonment for 2 years or 500 penalty units (or both).\n> \n> > (2) A person does not commit an offence against this section if—\n> > \n> > > (a) the person is authorised by the Secretary to use the paintball marker at a place other than an authorised paintball venue, and\n> > \n> > > (b) the person uses the paintball marker in accordance with the authorisation.\n> \n> > (3) The regulations may prescribe matters in relation to applications for authorisations including—\n> > \n> > > (a) the process for making an application, and\n> > \n> > > (b) application forms approved by the Secretary, and\n> > \n> > > (c) application fees, including the reduction, postponement, waiver or refund of fees, and\n> > \n> > > (d) considerations the Secretary must take into account when deciding whether to approve an application, and\n> > \n> > > (e) the process for applications to the Civil and Administrative Tribunal for an administrative review under the [Administrative Decisions Review Act 1997](/view/html/inforce/current/act-1997-076) of a decision under this Act in relation to an application.\n> \n> Note—\n> \n> For the [Crimes Act 1900](/view/html/inforce/current/act-1900-040), a reference to a firearm means a firearm within the meaning of the [Firearms Act 1996](/view/html/inforce/current/act-1996-046), and is taken to include a paintball marker within the meaning of this Act. Consequently, being authorised under the [Firearms Act 1996](/view/html/inforce/current/act-1996-046) to possess a paintball marker satisfies a requirement in the [Crimes Act 1900](/view/html/inforce/current/act-1900-040) that possession of the paintball marker is authorised under the [Firearms Act 1996](/view/html/inforce/current/act-1996-046). See the [Crimes Act 1900](/view/html/inforce/current/act-1900-040), section 4(7A).\n> \n> **s 5:** Am 2023 No 31, Sch paintball marker other than at an authorised paintball venue unless the person is authorised to do so by a permit.\n> \n> Maximum penalty—imprisonment for 12 months or 200 penalty units (or person is an authorised supplier and the supply of the paintball marker is to another authorised supplier or to the holder of a permit under this Act that authorises the holder to purchase the paintball marker, or\n> > \n> > > (b) the person is the holder of a permit under this Act that authorises the holder to possess the paintball marker and the supply of the paintball marker is to an authorised supplier, or\n> > \n> > > (c) the person is the holder of an authorisation issued under the law of another Australian jurisdiction equivalent to a firearms dealer licence under the [Firearms Act 1996](/view/html/inforce/current/act-1996-046) or a weapons dealer permit under the [Weapons Prohibition Act 1998](/view/html/inforce/current/act-1998-127) and the supply of the paintball marker is to an authorised supplier.\n> > \n> > Maximum penalty—imprisonment for 6 months or 200 penalty units (or both).\n> \n> > (2) This section does not apply to the supply of a > > (b) purchase and possess paintball markers for the purposes of operating that venue,\n> > \n> > > (c) supply paintball markers to persons at that venue solely for the temporary use of the paintball markers at that venue,\n> > \n> > > (d) supply paintball markers to another holder of a paintball venue permit under a paintball marker sharing arrangement that complies with the regulations,\n> > \n> > > (e) anything else prescribed by the regulations.\n> \n> > (2) Each paintball venue requires a separate paintball venue permit.\n> \n> > (3) A paintball venue permit is \n> > (2) An international paintball competitor permit is subject to any conditions of the permit.\n> \n> > (3) A person is disqualified from holding an international paintball competitor permit unless the person resides in a country other than Australia and requires the permit to compete in a paintball competition in this State.\n> \n> **s 13:** Am 2023 No 31, Sch suitable to hold a permit\n\n14 Grounds for finding a person not suitable to hold a permit\n\n> > (1) A person is not a suitable person to hold a permit if—\n> > \n> > > (a) the person is disqualified under this Act from holding the permit, or\n> > \n> > > (b) the person (including, if the person is a body corporate, a director of the body corporate) is a natural person who is under 18 years of age, or\n> > \n> > > (c) the person (including, if the person is a body corporate, a director of the body corporate) is not a fit and proper person to hold the permit, or\n> > \n> > > (d) the person is a mentally incapacitated person, or\n> > \n> > > (e) the person has not completed any course of training that may be prescribed by the regulations in respect of the particular permit, or\n> > \n> > > (f) the Secretary is of the opinion that the person is not a suitable person to hold the permit.\n> \n> > (2) The Secretary may form an opinion that a person is not a suitable person to hold a permit in any one or more of the following circumstances—\n> > \n> > > (a) the person (including, if the person is a body corporate, a director of the body corporate) has, within the previous 10 years, been convicted of a relevant offence,\n> > \n> > > (b) the person (including, if the person is a body corporate, a director of the body corporate) is an undischarged bankrupt,\n> > \n> > > (c) the person is a body corporate that is being wound up,\n> > \n> > > (d) the person has contravened a requirement imposed by or under this Act or any other Act or law prescribed by the regulations,\n> > \n> > > (e) an equivalent authorisation of the person has been suspended or cancelled (other than at the person’s request) under the law of another Australian jurisdiction,\n> > \n> > > (f) the person is disqualified (other than on the grounds of not residing in that jurisdiction or on the grounds that the person is a body corporate) from holding an equivalent authorisation under the law of another Australian jurisdiction,\n> > \n> > > (g) a close associate of the person who would not be a fit and proper person to hold the permit exercises a significant influence over the person or the apply to the Secretary for the grant of a permit.\n> > \n> > Note.\n> > \n> > The definition of grant a permit in section 3 (1) includes grant a renewal or restoration of a permit.\n> \n> > (2) An application must—\n> > \n> > > (a) be in an approved form, and\n> > \n> > > (b) include or be accompanied by any information or evidence that the Secretary reasonably requires to assess the application.\n> > \n> > Note.\n> > \n> > Part 5A of the [Crimes Act 1900](/view/html/inforce/current/act-1900-040) contains offences relating to the making of false or misleading applications or providing false or misleading information or documents. Those offences have a maximum penalty of imprisonment for 2 years or a fine of $22,000 (or both).\n> \n> > (3) The regulations may provide for a fee to be paid for an application for the grant of a permit.\n> \n> > (4) The Secretary may require the fee to accompany the application.\n> \n> > (5) If the Secretary considers it necessary to do so, the Secretary may require further documents or information to be provided by the applicant.\n> \n> > (6) If an application for the grant of a renewal of a permit is duly made to the Secretary before the expiry of a permit, the permit is taken to furnish to the Secretary such authorities and consents as the Secretary directs for the purpose of enabling the Secretary to obtain information (including financial and other confidential information) from other persons concerning the person or close associate.\n> \n> > (2) If a requirement made under this section is not complied with, the Secretary may refuse to consider the application concerned while the non-compliance continues.\n> \n> > (3) A person who complies with a requirement of a notice under this section does not on that account incur a liability to another a decision to grant or refuse the permit within the period prescribed by the regulations, the Secretary is taken to have refused to grant the
