These Regulations may be cited as the Ozone Protection (Licence Fees—Imports) Regulations.\n\nCommencement\n\n2. These Regulations commence on 1 January 1996.\n\n> Note: \\[NOTE: The Ozone Protection (Licence Fees—Imports) Act 1989 was repealed on 1 January 1996. A consequence of the repeal is that the Regulations made under that Act no longer have force on and from that date.\\]\n\nInterpretation\n\n3. In these Regulations:\n\n> “Act” means the Ozone Protection (Licence Fees—Imports) Act 1995;\n\n> “ODP tonne” has the meaning it is given in section 10 of the Ozone Protection Act 1989.\n\nLicence fees—rate for calculation\n\n4. (1) For the purpose of subsection 4 (1) of the Act, the following rates are fixed:\n\n(a) in the case of HCFCs—$2.00 for each kilogram imported;\n\n(b) in the case of methyl bromide—0.09 for each kilogram imported.\n\n(2) In paragraph (1) (a), “kilogram” means a kilogram unit of an ODP tonne.\n\n\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\\_\n\nNOTE\n\n> Note: 1. This is a scientific weighting system that measures how much damage a chemical does to the ozone layer. The heavier the environmental impact, the higher the weighted amount—and therefore the higher the fee.\n\n**Why it matters:** These fees are part of Australia's commitment to phase out ozone-depleting substances under international environmental agreements (the Montreal Protocol). By charging for imports, the regulation discourages use of these harmful chemicals while funding their management and phase-out."}},"importantCases":[],"_links":{"self":"/api/acts/ozone-protection-licence-fees-imports-regulations","history":"/api/acts/ozone-protection-licence-fees-imports-regulations/history","analysis":"/api/acts/ozone-protection-licence-fees-imports-regulations/analysis","conflicts":"/api/acts/ozone-protection-licence-fees-imports-regulations/conflicts","importantCases":"/api/acts/ozone-protection-licence-fees-imports-regulations/important-cases","documents":"/api/acts/ozone-protection-licence-fees-imports-regulations/documents"}}
