and\n\n (b) any other Act amended by this Act, as in force on the day that the inquiry began, continues in force despite the amendments made by this Act.\n\nNote: This means, for example, that a person who was given a notice under section 18 of the Inspector‑General of Intelligence and Security Act 1986 before commencement in relation to an inquiry is still required to comply with the notice after that date if the person has not done so.\n\n8  Transitional rules\n\n(1) The Prime Minister may, by legislative instrument, make rules prescribing matters of a transitional nature (including prescribing any saving or application provisions) relating to:\n\n (a) the amendments or repeals made by this Act; or\n\n (b) the enactment of this Act or the new law.\n\n(2) To avoid doubt, the rules may not do the following:\n\n (a) create an offence or civil penalty;\n\n (b) provide powers of:\n\n (i) arrest or detention; or\n\n (ii) entry, search or seizure;\n\n (c) impose a tax;\n\n (d) set an amount to be appropriated from the Consolidated Revenue Fund under an appropriation in this Act;\n\n (e) directly amend the text of this Act.\n\n(3) This Act (other than subitem (2)) does not limit the rules that may be made for the purposes of subitem (1).\n\n[Minister’s second reading speech made in—\n\nHouse of Representatives on 28 June 2018\n\nSenate on 29 November 2018]\n\n(132/18)\n\n \n","sortOrder":0}],"analysis":{"flash_summary":{"complexity_score":7,"scope_assessment":{"changed":false,"description":"This Act is narrowly focused on implementing the Office of National Intelligence Act 2018 by repealing the Office of National Assessments Act 1977, updating references across Commonwealth law, preserving existing authorisations and appointments, and providing transitional rule‑making powers. It does not broaden the substantive scope of intelligence powers beyond what the ONI Act establishes; the Act’s changes are consequential and transitional rather than an expansion of subject‑matter scope. The only potential incremental scope element is the Prime Minister’s delegated transitional rule‑making power, but that power is tightly constrained by express prohibitions (Schedule 4, item 8(2)), so it does not amount to a substantive change beyond the original implementation purpose."},"complexity_factors":["4 schedules (Repeal, Consequential amendments, Contingent amendments, Transitional provisions)","Extensive cross‑referencing: Schedule 2 amends roughly 20+ separate Acts across Commonwealth law (Privacy Act, FOI Act, ASIO Act, Criminal Code, Defence Act, AUSTRAC, ACC, IGIS Act, etc.)","Many name/definition substitutions (ONA -> ONI, Director‑General of ONA -> Director‑General of National Intelligence) across multiple provisions","Transitional continuity rules with prime ministerial discretion (Schedule 4, Part 3 items 2–4) and a separate power for transitional legislative instruments (Schedule 4, item 8)","Contingent commencement: Schedule 3 only takes effect if another Act commences (conditional logic across Acts)","Numbered items and saving provisions preserving existing authorisations and instruments (e.g. AUSTRAC authorisations) requiring careful mapping","Definitions and interpretation linkages: Schedule 4 includes definitions that import meaning from the new ONI Act so readers must consult both Acts","Nested exceptions and prohibitions on transitional rules (the rules may be broad but expressly may not create offences, detention/search powers, taxes or amend the Act text)"],"plain_english_summary":"The Act replaces the Office of National Assessments with the Office of National Intelligence, carrying over the incumbent Director‑General and preserving existing authorisations so functions, information‑sharing and oversight continue without operational gaps. \n\nIt retargets dozens of statutory references to ONI, affects Commonwealth agencies, oversight bodies and regulated reporters (e.g. AUSTRAC), and grants the Prime Minister limited transitional rule‑making powers to manage implementation, while imposing explicit prohibitions on those rules."},"flash_summary_failed":{"failed":true,"reason":"Unauthenticated. It abolishes the old **Office of National Assessments (ONA)** and replaces it with the new **Office of National Intelligence (ONI)**.\n\n**What it does:**\n\n*   **Repeals the old law:** It scraps the *Office of National Assessments Act 1977* entirely.\n*   **Updates 20+ other laws:** It goes through a long list of other Acts (covering everything from anti-money laundering to privacy, archives, and freedom of information) and swaps every mention of 'ONA' for 'ONI' and 'Director-General of ONA' for 'Director-General of National Intelligence'.\n*   **Keeps the boss in place:** The person who was running ONA automatically becomes the head of ONI, keeping their job, salary, and remaining term.\n*   **Preserves existing work:** Any reports, requests, or decisions made under the old system remain valid under the new one. Ongoing investigations by the intelligence watchdog continue as if nothing changed.\n*   **Adds new powers:** It allows the new ONI to receive sensitive information from AUSTRAC (the financial intelligence agency) and the Australian Crime Commission, and ensures ONI is covered by the same secrecy and oversight rules as other spy agencies.\n\n**Who it affects:**\n\n*   Intelligence officers and analysts who used to work for ONA now work for ONI.\n*   Other government agencies that share information with, or receive assessments from, the national intelligence coordinator.\n*   The Inspector-General of Intelligence and Security (the watchdog), who now oversees ONI instead of ONA.\n\n**Why it matters:**\n\nThis is purely mechanical but crucial. Without it, the new ONI wouldn't legally exist in the eyes of other laws. It ensures continuity—so that classified assessments don't vanish, ongoing investigations don't collapse, and the new agency can legally receive intelligence from partner agencies from day one. It's the legal plumbing that makes the intelligence restructure work."}},"importantCases":[],"_links":{"self":"/api/acts/office-of-national-intelligence-consequential-and-transitional-provisions-act-2018","history":"/api/acts/office-of-national-intelligence-consequential-and-transitional-provisions-act-2018/history","analysis":"/api/acts/office-of-national-intelligence-consequential-and-transitional-provisions-act-2018/analysis","conflicts":"/api/acts/office-of-national-intelligence-consequential-and-transitional-provisions-act-2018/conflicts","importantCases":"/api/acts/office-of-national-intelligence-consequential-and-transitional-provisions-act-2018/important-cases","documents":"/api/acts/office-of-national-intelligence-consequential-and-transitional-provisions-act-2018/documents"}}
