That Act then permanently\nreserved for municipal purposes the 1886 land and\nvested the remainder of the 1881 land and the 1886\nland, being the land described in items 1 and 2 in\nthe Schedule to this Act, in the Crown.\nIn 1888, the land described in items 1 and 2 in the\nSchedule to this Act was vested in the City of\nNorth Melbourne (now the City of Melbourne) by\nvirtue of Act No. 973.\nTo facilitate the sale of the land which is no longer\nrequired for the purposes for which it was\nreserved, it is desirable to revoke the permanent\nreservations and to repeal Act No. 973.\nThe Parliament of Victoria therefore enacts as follows:\n1. Purposes\nThe purposes of this Act are—\n(a) to revoke the permanent reservations in\nrespect of certain land at North Melbourne;\nand\n\nVictorian Legislation and Parliamentary DocumentsAct No. 50/1996\nNorth Melbourne Lands Act 1996\n2\n(b) to repeal Act No. 973; and\n(c) to make provision for related matters.\n2. Commencement\nThis Act comes into operation on the day on\nwhich it receives the Royal Assent.\n3. Revocation of permanent reservations\n(1) The Order in Council specified in item 1 of the\nSchedule is revoked.\n(2) The land specified in item 2 of the Schedule being\nthe land described in the Second Schedule to Act\nNo. 906 ceases to be subject to the reservation\nimposed by section 4 of that Act.\n(3) This section has effect despite anything to the\ncontrary in any Act, law or instrument.\n4. Repeal of Act\nAct No. 973 is repealed.\n5. Consequences of revoking reservations and repeal of\nAct No. 973\nOn the commencement of this Act—\n(a) the land specified in items 1 and 2 of the\nSchedule is divested from the City of\nMelbourne; and\n(b) the land specified in items 1 and 2 of the\nSchedule is deemed to be unalienated land of\nthe Crown, freed and discharged from all\ntrusts, limitations, reservations, restrictions,\nencumbrances, estates and interests; and\n(c) the appointment of any committee of\nmanagement of the land specified in items 1\nand 2 of the Schedule is revoked to the\nextent that it relates to that land; and\ns. 2\n\nVictorian Legislation and Parliamentary DocumentsAct No. 50/1996\nNorth Melbourne Lands Act 1996\n3\n(d) any regulations under section 13 of the\nCrown Land (Reserves) Act 1978 are\nrevoked to the extent that they apply to the\nland specified in items 1 and 2 of the\nSchedule.\n6. Registrar-General and Registrar of Titles to make\nnecessary amendments\n(1) The Registrar-General must make all entries on\nthe records of enrolment of any Crown grant and\non any memorial relating to land that are\nnecessary because of the operation of any\nprovision of this Act.\n(2) The Registrar of Titles must make any\namendments to the Register under the Transfer of\nLand Act 1958 that are necessary because of the\noperation of any provision of this Act.\n__________________\ns. 6\n\nVictorian Legislation and Parliamentary DocumentsAct No. 50/1996\nNorth Melbourne Lands Act 1996\n4\nSCHEDULE\nItem 1\nSituation and area of\nland:\nParish of Jika Jika at North Melbourne, County\nof Bourke, 1.627 hectares less authorised\nexcisions, being Crown Allotment 1, Section\n75B.\nInstrument and date of\nreservation:\nOrder in Council dated 17 October 1881\nDescription of land by\nreference to Government\nGazette:\nGovernment Gazettes dated 23 September 1881,\npage 2669 and 21 October 1881, page 2901\nParticulars of\nregistration of Crown\ngrant:\nNo Crown grant\nPurpose of reservation: Site for Municipal Purposes\nExtent of revocation: The entire reserve\nItem 2\nSituation and area of\nland:\nParish of Jika Jika at North Melbourne, County\nof Bourke, 5668 square metres, being Crown\nAllotment 2, Section 75B.\nInstrument and date of\nreservation:\nBy virtue of Act No. 906, section 4\nDescription of land by\nreference to Government\nGazette:\nNot applicable\nParticulars of\nregistration of Crown\ngrant:\nNo Crown grant\nPurpose of reservation: Site for municipal purposes\nExtent of revocation: The entire reserve\n═══════════════\nSch.\n\nVictorian Legislation and Parliamentary DocumentsAct No. 50/1996\nNorth Melbourne Lands Act 1996\n5\nENDNOTES\n1.
