or\n (b) subsection (2) does not apply to the person or anyone else, but subsection (3) applies to the person; or\n (c) subsections (2) and (3) do not apply to the person or anyone else, but subsection (4) applies to the person.\n (2) This subsection applies to a person who, with the person’s authority, is named or otherwise identified in transport documentation as the consignor of the goods.\n (3) This subsection applies to a person who:\n (a) engages a prime contractor or rail operator, either directly or through an agent or other intermediary, to transport the goods; or\n (b) if paragraph (a) does not apply, has possession of, or control over, the goods immediately before the goods are transported; or\n (c) if neither paragraph (a) nor (b) applies, loads a vehicle with the goods, for transport, at a place:\n (i) where dangerous goods are awaiting collection; and\n (ii) that is unattended (except by the driver) during loading.\n (4) This subsection applies to a person if:\n (a) the goods are imported into Australia; and\n (b) the person is the importer of the goods.\n\n","sortOrder":0},{"sectionNumber":"4C","sectionType":"section","heading":"Meaning of pack and packer","content":"4C Meaning of pack and packer\n\n A person packs dangerous or other goods for transport, and is a packer of the goods, if the person:\n (a) puts the goods in a packaging (even if that packaging is already on a vehicle); or\n (b) assembles, places or secures packages in packaging designed to hold, enclose or otherwise contain more than one package (even if that packaging is already on a vehicle); or\n (c) supervises an activity mentioned in paragraph (a) or (b); or\n (d) manages or controls an activity mentioned in paragraph (a), (b) or (c).\n\n> Note: Example: A person who uses a hose to fill the tank of a tank vehicle with petrol packs the petrol for transport for the purposes of this Act.\n\n","sortOrder":1},{"sectionNumber":"4D","sectionType":"section","heading":"Meaning of load and loader","content":"4D Meaning of load and loader\n\n (1) A person loads dangerous or other goods for transport, and is a loader of the goods, if the person:\n (a) loads one or more packages of the goods in or on a vehicle; or\n (b) places or secures one or more packages of the goods on a vehicle; or\n (c) supervises an activity mentioned in paragraph (a) or (b); or\n (d) manages or controls an activity mentioned in paragraph (a), (b) or (c).\n (2) Subsection (1) does not apply to the loading of goods into packaging that is already on a vehicle, nor to the placing or securing of packages in or on a further packaging that is already on a vehicle.\n\n","sortOrder":2},{"sectionNumber":"4E","sectionType":"section","heading":"Meaning of operator","content":"4E Meaning of operator\n\n (1) A person is an operator of a vehicle if:\n (a) in the case of a vehicle (including a vehicle in a group of vehicles that are physically connected)—the person is responsible for controlling or directing the operations of the vehicle; or\n (b) in the case of a group of vehicles that are physically connected—the person is responsible for controlling or directing the operations of the towing vehicle in the group.\n (2) A person is not an operator merely because the person owns a vehicle or does any or all of the following:\n (a) drives a vehicle;\n (b) maintains or arranges for the maintenance of a vehicle;\n (c) arranges for the registration of a vehicle.\n\n","sortOrder":3},{"sectionNumber":"4F","sectionType":"section","heading":"References to rolling stock","content":"4F References to rolling stock\n\n For purposes of this Act, rolling stock that is designed to operate or be used on the road or on a railway track is rolling stock only while it is being operated or used on a railway track.\n\n","sortOrder":4},{"sectionNumber":"4G","sectionType":"section","heading":"Meaning of qualified, fit or authorised to drive or to run an engine","content":"4G Meaning of qualified, fit or authorised to drive or to run an engine\n\n (1) For the purposes of this Act, a person is qualified to drive a vehicle (or to run its engine) if he or she:\n (a) holds a driver licence of the appropriate class to drive the vehicle, and the driver licence is not suspended; and\n (b) is not prevented by or under a law (including, for example, by the conditions of the licence) from driving the vehicle at the relevant time.\n (2) For the purposes of this Act, a person is fit to drive a vehicle (or to run its engine) if he or she:\n (a) is apparently physically and mentally fit to drive the vehicle; and\n (b) (without limiting the above) is not apparently affected by either or both:\n (i) alcohol; or\n (ii) any drug that affects his or her fitness to drive; and\n (c) is not at the time found to have a concentration of alcohol in his or her blood that exceeds the amount permitted by a law of {this jurisdiction}; and\n (d) is not at the time found to have a concentration of a drug that affects his or her fitness to drive in his or her blood or oral fluid that exceeds the amount permitted by a law of {this jurisdiction}.\n (3) For the purposes of this Act, a person is authorised:\n (a) to drive a vehicle if he or she is its operator or has the authority of the operator to drive it; or\n (b) to run the engine of a vehicle if he or she is its operator or has the authority of the operator to drive the vehicle or to run the engine;\n regardless of whether or not he or she is qualified to drive the vehicle (or to run its engine).\n\n","sortOrder":5},{"sectionNumber":"4H","sectionType":"section","heading":"Meaning of unattended vehicle and driver of disconnected trailer","content":"4H Meaning of unattended vehicle and driver of disconnected trailer\n\n (1) For the purposes of this Act, a vehicle is unattended if:\n (a) where the authorised officer concerned:\n (i) is present at the scene—there is, after inspection and enquiry by the officer that is reasonable in the circumstances, apparently no person in, on, or in the vicinity of, the vehicle who appears to be a driver of the vehicle; or\n (ii) is not present at the scene but is able to inspect the scene by means of a camera or other remote surveillance system—there is, after inspection by the officer that is reasonable in the circumstances, apparently no person in, on, or in the vicinity of, the vehicle who appears to be a driver of the vehicle; or\n (b) where there is apparently such a person in, on, or in the vicinity of, the vehicle—the officer believes on reasonable grounds that:\n (i) the person is not qualified, not fit or not authorised to drive it; or\n (ii) the person is or appears to be unwilling to drive it; or\n (iii) the person is subject to a direction under section 24 (Direction to leave vehicle) in relation to the vehicle.\n (2) A reference in this Part to the driver of a vehicle is, in a case where the vehicle is a trailer and is not connected (either directly or by one or more other trailers) to a towing vehicle, a reference to the driver of the towing vehicle of the combination to which the trailer was, or apparently was, last connected.\n\n","sortOrder":6},{"sectionNumber":"4I","sectionType":"section","heading":"Meaning of broken down, in relation to vehicles","content":"4I Meaning of broken down, in relation to vehicles\n\n For the purposes of this Act:\n (a) a motor vehicle is broken down if it is not possible to drive the vehicle because it is disabled through damage, mechanical failure, lack of fuel or any similar reason;\n (b) a trailer is broken down if it is not connected (either directly or by one or more other trailers) to a towing vehicle, whether or not the trailer is also disabled through damage, mechanical failure or any similar reason.\n\n","sortOrder":7},{"sectionNumber":"4J","sectionType":"section","heading":"Roads and road‑related areas","content":"4J Roads and road‑related areas\n\n (1) Each reference in this Act to a road includes a reference to a road‑related area.\n (2) Road and road‑related area have the same meanings as they have in the Australian Road Rules.\n\n> Note: \\[Drafting note 1: Jurisdictions may modify these definitions to the extent that they are inconsistent with their requirements for the application of authorised officer powers.\n\n> Note: Drafting note 2: While the definition of road reflects usage of this term in the national road transport laws, it was not specifically defined in the Road Transport Reform (Dangerous Goods) Act 1995 (Cwlth) or the Road Transport Reform (Dangerous Goods) Regulations 1997 (Cwlth). Changes to subordinate law‑making powers\n\n (1) For sections 8(2)(a) – (c) substitute –\n “(a) identifying and classifying goods as dangerous goods, and the identification and classification of dangerous goods;\n (b) identifying, classifying and regulating goods that are too dangerous to be transported (including prohibiting the transport of such goods);\n (c) the making of determinations by the Competent Authority for the purposes of the {subordinate law} in relation to:\n (i) the identification and classification of goods as dangerous goods;\n (ii) the identification and classification of dangerous goods;\n (iii) the specification of what is, and what is not, compatible with dangerous goods for transport purposes;\n (iv) prohibiting or regulating the transport of dangerous goods by road or rail;\n (v) regulating the containment of dangerous goods that are being, or that are to be, transported by road or rail;”.\n (2) In section 8(2)(f) –\n (a) omit “and overpacks”;\n (b) for “containers and vehicles in or on” substitute “vehicles and packaging on or in”.\n (3) In section 8(2)(m)(ii), for “responsible for” substitute “involved in”.\n (4) For section 8(2)(p) substitute –\n “(p) the approval by the Competent Authority of:\n (i) vehicles, packaging, equipment and other items used in relation to the transport of dangerous goods; and\n (ii) facilities for, and methods of, testing or using vehicles, packaging, equipment and other items used in relation to the transport of dangerous goods; and\n (iii) processes carried out in relation to the transport of dangerous goods;”.\n (5) For section 8(2)(w) substitute –\n “(w) the recognition of a body, consisting of the Competent Authority and other equivalent bodies in other jurisdictions, that is to make decisions, and to provide oversight on decisions made, under this Act or the regulations for the purposes of national uniformity, and other matters in relation to such a body, including the recognition of decisions made by such a body;”.\n (6) After section 8(2)(y) insert –\n “(z) requiring a person involved in the transport of dangerous goods to hold insurance, or some other form of indemnity, in relation to that transport.”.\n\n## 11. Additional power in relation to making subordinate laws\n\n After section 8(4) insert –\n “(4A) The {subordinate law}:\n (a) may require a matter affected by the {subordinate law} to be approved by or to the satisfaction of a specified person or body, or a specified class of person or body;\n (b) may confer a discretionary authority, or impose a duty, on a specified person or body, or a specified class of person or body.”.\n\n## 12. Insertion of section 52A\n\n After section 52 insert –\n\n“52A Sample‑taking procedure\n\n (1) In this section person from whom the sample was taken means:\n (a) in the case of an inspection or search under section 26, 27, 37 or 38, the driver of the vehicle, or the person apparently in charge of the vehicle;\n (b) in the case of an inspection or search under section 43 or 44, the occupier, or apparent occupier for the time being, of the premises.\n (2) Despite anything in this Part to the contrary, an authorised officer may only take a sample if it is safe to do so, and if the taking of the sample will not result in a dangerous situation arising.\n (3) Unless it is not safe to do so, the officer must, immediately after taking any sample of a substance, divide the sample into the following parts:\n (a) one part that is to be retained for future comparison;\n (b) one part that is to be given to the person from whom the sample was taken;\n (c) if the officer intends to have the sample tested or analysed, one part for the purposes of that testing or analysis.\n (4) The officer must then enclose each part of a sample in a packaging in a way that prevents the contamination of the part, and must mark or label the packaging in a way that enables the part to be identified.\n (5) If an authorised officer intends to take a sample of any packaging under this Part, before removing the packaging from the vehicle or premises, as the case may be, he or she must give a written receipt that identifies the sample to the person from whom the sample was taken.\n (6) If an authorised officer finds numerous packages during an inspection or search, and the packages appear to be identical, the officer may take one or more of the packages as samples.\n (7) If subsection (6) applies, the officer must, immediately after taking the sample packages:\n (a) enclose each package taken in a packaging in a way that prevents the contamination of the package, and must mark or label the packaging in a way that enables the sample to be identified; and\n (b) must give one of the samples to the person from whom the sample was taken.\n (8) If a person who is offered a sample, or a part of a sample, under subsection (3)(b) or (7)(b) refuses to accept the sample or part, the officer must retain the sample or part.\n (9) The officer must give a sample, or a part of a sample, retained under subsection (8) to the person to whom it was offered if he or she is subsequently asked to do so by the person.”.\n\n## 17. (4.24, amd)\n\n4.2.4 Approval of packaging designs\n\n (1) The Competent Authority may, on application in accordance with {clause} 4.2.3, approve a design for a packaging for use in the transport of dangerous goods if it is satisfied that a packaging of that design:\n (a) will comply with, or is permitted by, Part 6 of the ADG Code; and\n (b) satisfies all the relevant testing and inspection requirements set out in that Part.\n (2) In determining whether packaging of a particular design satisfies any particular testing requirement, the Competent Authority may rely on any test certificate issued by a recognised testing facility (as defined by {clause 4.2.5}) that complies with {clause 4.2.6}.\n (3) In giving its approval, the Competent Authority may impose in relation to the approval any condition about the construction, packing, use or maintenance of a packaging manufactured in accordance with the design necessary for the safe use of the packaging to transport dangerous goods. (3.8, 4.25 and 4.26, amd)\n (4) A person must not construct, pack or fail to maintain packaging for use in the transport of dangerous goods, or use packaging to transport dangerous goods, if the person knows, or ought reasonably to know, that—\n (a) a condition about the construction, packing, maintenance or use of the packaging, as the case may be, was imposed in relation to the approval of the design for the packaging; and\n (b) the construction, packing, failure to maintain, or use is in contravention of the condition.\n\n## 69. (6.5, amd)\n (3) A person must not use an overpack to transport dangerous goods if the person knows, or ought reasonably to know, that—\n (a) a condition about the use of the overpack was imposed in relation to the approval of the method of preparing the overpack; and\n (b) the use is in contravention of the condition.\n\n4.2.8 Authorised body may issue approvals\n\n (1) The Competent Authority may authorise a person or body to issue approvals under {clauses} 4.2.4 and 4.2.7.\n (2) In giving its authorisation, the Competent Authority may impose in relation to the authorisation any condition it considers appropriate in relation to the issuing of approvals by the person or body.\n (3) In issuing an approval, in addition to complying with any condition imposed under {subclause (2)}, the person or body must also:\n (a) comply with any relevant requirements imposed by Part 6 of the ADG Code in relation to the issuing of the approval; and\n (b) give the Competent Authority, in relation to the approval, all of the information listed in {clause} 17.2.2.\n (4) If a person or body is authorised to issue approvals under this {clause}:\n (a) {clauses} 4.2.3, 4.2.4 and 4.2.7 apply as if a reference in those {clauses} to the Competent Authority was a reference to the person or body; and\n (b) Divisions 17.1 and 17.4, to the extent that they deal with approvals, apply as if a reference in those Divisions to the Competent Authority was a reference to the person or body; and\n (c) a reference in {this subordinate law} to an approval under {clause} 4.2.4 or 4.2.7 includes a reference to an approval given by the body or other person under {clause} 4.2.4 or 4.2.7 as applied under paragraph (a); and\n (d) {clauses} 19.1.1(e), (f) and (i) apply as if a reference in {clause} 19.1.1 to the Competent Authority was a reference to the person or body.\n (5) The Competent Authority may withdraw an authorisation granted under this {clause} at any time.\n (6) The withdrawal of an authorisation does not affect any approval issued by the person or body before the withdrawal took effect.”.\n\n## 71.
