TERRITORY) ACT 2008\nAn Act to establish a framework to enable third parties to gain access to\ncertain natural gas pipelines services, to repeal the Gas Pipelines\nAccess (Northern Territory) Act 1998, and for related purposes\nPart 1 Preliminary matters\n1 Short title\nThis Act may be cited as the National Gas (Northern Territory) Act\n2008.\n2 Commencement\nThis Act commences on the date fixed by the Administrator by\nGazette notice.\n3 Interpretation\n(1) In this Act:\nNational Gas (NT) Law means the provisions applying because of\nsection 7.\nNational Gas (NT) Regulations means the provisions applying\nbecause of section 8.\nSouth Australian Act means the National Gas (South Australia)\nAct 2008 (SA).\n(2) Words and expressions used in the National Gas (NT) Law and in\nthis Act have the same respective meanings in this Act as they\nhave in that Law.\n(3) This section does not apply to the extent that the context or subject-\nmatter otherwise indicates or requires.\n\nPart 2 National Gas (NT) Law and National Gas (NT) Regulations\nNational Gas (Northern Territory) Act 2008 2\n4 Act binds Crown\nThis Act, the National Gas (NT) Law and the National Gas (NT)\nRegulations binds the Crown in right of the Territory and, to the\nextent the legislative power of the Legislative Assembly permits, the\nCrown in all its other capacities.\n5 Application to coastal waters\n(1) This Act, the National Gas (NT) Law and the National Gas (NT)\nRegulations apply in the coastal waters of the Territory as if the\ncoastal waters were within the limits of the Territory.\n(2) In this section:\nadjacent area in respect of the Territory means the adjacent\narea of this jurisdiction under the National Gas (NT) Law (as\ndefined in section 9(1) of this Act).\ncoastal waters, in relation to the Territory, means any sea that is\non the landward side of the adjacent area in respect of the Territory\nbut is not within the limits of the Territory.\n6 Extra-territorial operation\nIt is the intention of the Legislative Assembly that this Act, the\nNational Gas (NT) Law and the National Gas (NT) Regulations\nshould, so far as possible, operate to the full extent of the extra-\nterritorial legislative power of the Territory.\nPart 2 National Gas (NT) Law and National Gas (NT)\nRegulations\n7 Application in Territory of National Gas Law\nThe National Gas Law set out in the Schedule to the South\nAustralian Act, as in force for the time being:\n(a) applies as a law of the Territory; and\n(b) as so applying may be referred to as the National Gas (NT)\nLaw.\nNote\nThe South Australian Act is available at www.legislation.sa.gov.au/index.aspx\n\nPart 2 National Gas (NT) Law and National Gas (NT) Regulations\nNational Gas (Northern Territory) Act 2008 3\n8 Application in Territory of regulations under National Gas Law\nThe regulations in force for the time being under Part 3 of the South\nAustralian Act:\n(a) apply as regulations in force for the purposes of the National\nGas (NT) Law; and\n(b) as so applying may be referred to as the National Gas (NT)\nRegulations.\n9 Interpretation of expressions in National Gas (NT) Law and\nNational Gas (NT) Regulations\n(1) In the National Gas (NT) Law and the National Gas (NT)\nRegulations:\nadjacent area of another participating jurisdiction means the\noffshore area of a State within the meaning of section 7 of the\nOffshore Petroleum and Greenhouse Gas Storage Act 2006 (Cth).\nadjacent area of this jurisdiction means the offshore area of the\nTerritory within the meaning of section 7 of the Offshore Petroleum\nand Greenhouse Gas Storage Act 2006 (Cth).\nCourt means the Supreme Court.\ndesignated minister means the Commonwealth Minister.\nLegislature of this jurisdiction means the Legislative Assembly.\nNational Gas Law or this Law means the National Gas (NT) Law.\nthis jurisdiction means the Territory.\n(2) The Acts Interpretation Act 1915 (SA) and other Acts of South\nAustralia do not apply to:\n(a) the National Gas Law set out in the Schedule to the South\nAustralian Act in its application as a law of the Territory; or\n(b) the regulations in force for the time being under Part 3 of the\nSouth Australian Act in their application as regulations in force\nfor the purposes of the National Gas (NT) Law.\n\nPart 4 Miscellaneous matters\nNational Gas (Northern Territory) Act 2008 4\nPart 3 Cross vesting of powers\n10 Conferral of powers on Commonwealth Minister and\nCommonwealth bodies to act in Territory\n(1) The Commonwealth Minister and the Commonwealth bodies have\npower to do acts in or in relation to the Territory in the performance\nor exercise of a function or power expressed to be conferred on\nthem respectively by the national gas legislation of another\nparticipating jurisdiction.\n(2) In this section:\nCommonwealth bodies means any of the following:\n(a) AER;\n(b) NCC;\n(c) the Tribunal.\n11 Conferral of powers on Ministers of participating States to act\nin Territory\nThe Minister of a participating jurisdiction has power to do acts in or\nin relation to the Territory in the performance or exercise of a\nfunction or power expressed to be conferred on the Minister by the\nnational gas legislation of another participating jurisdiction.\n12 Conferral of functions or powers on State Minister\nIf the national gas legislation of another participating jurisdiction\nconfers a function or power on the Minister, the Minister:\n(a) may perform that function or exercise that power; and\n(b) may do all things necessary or convenient to be done in\nconnection with the performance or exercise of that function or\npower.\nPart 4 Miscellaneous matters\n13 Exemption from taxes\n(1) Any duty or other tax imposed by or under a law of the Territory is\nnot payable in relation to:\n(a) an exempt matter; or\n\nPart 4 Miscellaneous matters\nNational Gas (Northern Territory) Act 2008 5\n(b) anything done (including, for example, a transaction entered\ninto or an instrument or document made, executed, lodged or\ngiven) because of, or arising out of, an exempt matter.\n(2) In this section:\nexempt matter means a transfer of assets or liabilities:\n(a) that is made for the purpose of ensuring that a person does\nnot carry on a business of producing, purchasing or selling\nnatural gas or processable gas in breach of any ring fencing\nrequirements of the national gas legislation or for the purpose\nof the separation of certain businesses or business activities\nfrom other businesses or business activities of a person as\nrequired by an AER ring fencing determination; and\n(b) that the Treasurer declares from time to time by Gazette\nnotice to be an exempt matter fro the purposes of this section.\n14 Actions in relation to cross boundary pipelines\n(1) If a pipeline is a cross boundary pipeline, any action taken under\nthe national gas legislation of a participating jurisdiction in whose\njurisdictional area a part of the pipeline is situated:\n(a) by, or in relation to, a relevant Minister; or\n(b) by the Court within the meaning of that legislation in relation to\naction taken by, or in relation to, a relevant Minister;\nis taken also to be taken under the national gas legislation of each\nparticipating jurisdiction in whose jurisdictional area a part of the\npipeline is situated (that other legislation):\n(c) by, or in relation to, a relevant Minister within the meaning of\nthat other legislation; or\n(d) by the Court within the meaning of that other legislation;\nas the case requires.\n(2) Despite subsection (1), no proceeding for judicial review or for a\ndeclaration, injunction, writ, order or remedy may be brought before\nthe Court to It also applies the regulations made under that South Australian Act as the National Gas (NT) Regulations in the NT (s 8).\n- Ensures the Act, the NGL and its regulations bind the Crown in the Territory (s 4) and extend to the Territory’s coastal waters as if those waters were within territorial limits (s 5).\n- Provides that NT courts and officials will interpret terms in the NGL according to definitions set out in this Act (s 3, s 9) and excludes application of South Australia’s interpretation Acts to the NGL as it operates in the NT (s 9(2)).\n- Confers powers across jurisdictions so Commonwealth ministers/bodies and ministers of other participating jurisdictions can perform functions or exercise powers in the NT that are expressed to be conferred by the national gas legislation of another participating jurisdiction (ss 10–12).\n- Creates a limited tax/duty exemption for certain transfers of assets or liabilities that are made to satisfy ring‑fencing or separation requirements arising under the national gas regime, subject to Treasurer Gazette declarations (s 13).\n- Provides special rules for actions affecting cross‑boundary pipelines so that actions taken under the NGL in one participating jurisdiction are treated as taken under the corresponding law in each jurisdiction where parts of the pipeline lie; and it restricts certain judicial challenges for cross‑boundary distribution pipelines to the jurisdiction most closely connected to the pipeline (s 14).\n- Allows the Administrator to make regulations (including transitional regulations with limited retrospective effect) (s 16) and repeals the previous Gas Pipelines Access (Northern Territory) Act 1998 (s 18).\n\n**Who is affected**\n\n- Pipeline owners and operators, and companies involved in producing, buying, transporting or selling natural/processable gas in the NT and adjacent offshore areas: they become subject to the National Gas (NT) Law and its regulatory regime (s 7, s 8, s 5).\n- Commonwealth bodies named in the Act (AER, NCC, Tribunal) and Commonwealth/State ministers: they gain express statutory power to act in the NT under the national gas legislative framework (ss 10–12, s 15).\n- The Territory government/treasury: may forgo certain duties or taxes where the Treasurer declares transfers to be “exempt matters” (s 13).\n- Consumers, contractors, and third parties with an interest in pipelines may be affected by cross‑jurisdictional decisions and by limits on judicial review for some cross‑boundary pipelines (s 14).\n\n**Why it matters (stated purpose and practical implications)**\n\n- Purpose claim (from the Act): to create a common, national framework for third‑party access to certain gas pipeline services by applying the National Gas Law in the NT and replacing the NT’s older access law (long title; s 18).\n\n- Practical implications and trade‑offs:\n  - Legal harmonisation: applying the South Australian NGL in the NT centralises the substantive regulatory rules (s 7–8). That reduces the need for distinct NT gas access rules, but creates legal dependence on a law text located in another jurisdiction and on the South Australian schedule/regulations continuing in force.\n  - Cross‑jurisdictional decision‑making: conferral provisions (ss 10–12) make it easier for national regulators or ministers to act consistently across borders, but they also mean decision‑making authority can be exercised in the NT by non‑NT ministers or Commonwealth bodies. That changes who decides and can complicate local accountability and administrative channels.\n  - Revenue and distributional effects: the exemption from duties for transfers required by ring‑fencing/separation (s 13) concentrates a financial benefit on the firms restructuring to comply with NGL ring‑fencing determinations, while the Territory foregoes tax/duty revenue to allow those restructures. The exemption operates only where the Treasurer declares a transfer to be an exempt matter (s 13(2)).\n  - Litigation and forum risk: for pipelines that cross jurisdictional boundaries, actions taken in one participating jurisdiction are treated as taken in the others (s 14(1)), and for cross‑boundary distribution pipelines judicial review is limited to the jurisdiction most closely connected (s 14(2)). That reduces duplicated litigation and the risk of inconsistent decisions, but concentrates legal challenges into a single jurisdiction and may restrict some avenues for affected parties.\n  - Compliance and administrative burden: entities in the NT must comply with a body of law located in another jurisdiction (the South Australian schedule and regulations), and they must monitor Gazette notices (for exempt matters) and any determinations or directions from interstate or Commonwealth decision‑makers exercising powers in the NT (s 13(2); ss 10–12).\n\n**Who pays, who decides, and how behaviour changes**\n\n- Who pays: pipeline companies and gas businesses pay compliance costs and may pay fees/penalties under the NGL. The Territory treasury may lose duty/tax revenue where transfers are declared exempt (s 13).\n- Who decides: regulatory decisions affecting NT gas pipelines can be taken by the national regulator(s) and ministers identified in the national gas framework, including Commonwealth bodies given explicit power by the Act (ss 10–12, s 15). The NT Administrator can make regulations under this Act (s 16).\n- Behaviour changes expected: firms may reorganise assets or liabilities to satisfy NGL ring‑fencing (and may seek a Treasurer declaration to obtain duty exemptions), operators of cross‑boundary pipelines will expect coordinated regulatory treatment across jurisdictions, and participants must follow the NGL rather than the prior NT statute (s 18).\n\n**Implementation risks and administrative observations**\n\n- Dependence on external text: the NT’s regime is implemented by adopting the South Australian schedule and regulations. That makes the NT regime sensitive to changes in how that text is kept, amended, or interpreted in South Australia (s 7–8).\n- Delegation and accountability: conferral of powers to non‑NT ministers and Commonwealth bodies centralises some functions (ss 10–12). This reduces duplication but can complicate lines of accountability and local oversight unless administrative arrangements are clear.\n- Discrete beneficiary/concentrated cost structure: exemptions (s 13) create concentrated benefits to specific corporate restructures, while costs (foregone duties; compliance with a national framework) are more diffuse.\n\n(References to sections are to this Act: s = section.)"},"kimi_summary":{"content_quality":"ok","complexity_score":4,"scope_assessment":{"changed":false,"description":"The legislation remains tightly focused on its original purpose of enabling third-party access to gas pipeline services and integrating the Northern Territory into the national gas regulatory framework. It essentially copies South Australia's gas access laws and makes them apply in the Territory.\n\n**What it does:**\n- **Adopts national rules**: It applies the National Gas Law (which is actually a South Australian law) as if it were Territory law. This creates a single set of rules for gas pipelines across multiple states and territories.\n- **Opens up pipelines**: The underlying law (the South Australian one) establishes a system where third parties can get access to natural gas pipeline services. This stops pipeline owners from blocking competitors and helps ensure gas can flow to where it's needed.\n- **Lets other jurisdictions act here**: It gives power to Commonwealth ministers and bodies (like the Australian Energy Regulator), as well as ministers from other states, to make decisions and take actions within the Northern Territory regarding gas pipelines.\n- **Handles cross-border pipelines**: Special rules apply when pipelines cross between the Territory and other jurisdictions, ensuring consistent regulation.\n- **Tax exemptions**: Certain transfers of assets related to gas businesses are exempt from Territory taxes.\n\n**Who it affects:**\n- Gas pipeline owners and operators in the Northern Territory\n- Companies wanting to transport gas through pipelines\n- Energy regulators and government bodies\n- Anyone involved in cross-border gas infrastructure\n\n**Why it matters:**\nBefore this law, the Territory had its own separate gas pipeline access rules (the 1998 Act, which this repeals). By joining the national scheme, the Territory ensures its gas industry plays by the same rules as the rest of Australia. This makes it easier to trade gas across borders, encourages investment, and helps keep energy prices competitive by preventing pipeline monopolies from restricting access."}},"importantCases":[],"_links":{"self":"/api/acts/national-gas-northern-territory-act-2008","history":"/api/acts/national-gas-northern-territory-act-2008/history","analysis":"/api/acts/national-gas-northern-territory-act-2008/analysis","conflicts":"/api/acts/national-gas-northern-territory-act-2008/conflicts","importantCases":"/api/acts/national-gas-northern-territory-act-2008/important-cases","documents":"/api/acts/national-gas-northern-territory-act-2008/documents"}}
