and\n\nSection 5\nR1\n03/12/21\nMotor Accident Injuries (Lawyer Information Collection)\nRegulation 2021\nEffective: 03/12/21\npage 3\nAuthorised by the ACT Parliamentary Counsel—also accessible at www.legislation.act.gov.au\n(b) for a motor accident claim—the period beginning when the\nnotice of claim was given to the insurer and ending when—\n(i) the payment for an award of damages or offer of settlement\nwas made; or\n(ii) in any other case—the court gave judgment in a proceeding\non the claim.\n(3) The lawyer must give the MAI commission reportable information\nabout the ACAT application or claim.\n(4) The reportable information must be given to the MAI commission—\n(a) within—\n(i) 28 days after the end of the relevant period; or\n(ii) if the lawyer stopped representing the client before the end\nof the relevant period—28 days after the lawyer stopped\nrepresenting the client; and\n(b) in the way stated on the MAI commission’s website.\nExample—par (b)\nelectronic lodgment using a portal on the MAI commission’s website\n(5) Failure to comply with this section by a lawyer can be professional\nmisconduct or unsatisfactory professional conduct under the Legal\nProfession Act 2006, chapter 4 (Complaints and discipline).\n(6) In this section:\nACAT application means an application for external review of an\nACAT reviewable decision.\nlaw practice—see the Legal Profession Act 2006, dictionary.\n\nSection 5\npage 4 Motor Accident Injuries (Lawyer Information Collection)\nRegulation 2021\nEffective: 03/12/21\nR1\n03/12/21\nAuthorised by the ACT Parliamentary Counsel—also accessible at www.legislation.act.gov.au\nreportable information, in relation to an ACAT application or motor\naccident claim, means the following information:\n(a) an estimate of the total amount of costs and disbursements at the\nstart of the application or claim, including amounts for party and\nparty costs;\n(b) the amount of costs and disbursements associated with making\nthe application or lodging the claim;\n(c) the amount of costs and disbursements billed by the lawyer or\nlaw practice representing the client and payable by the client,\nincluding the following:\n(i) any repayment to the client’s private health insurer;\n(ii) any advance payment to the client;\n(iii) any deductions from the amount—\n(A) ordered to be paid;
